of 12 July 1948
on the adjustment of certain service and pay ratios of members of the National Security Corps.
The Government of the Czechoslovak Republic hereby orders pursuant to Article 29 of the Act of 11 July 1947, No. 149 Coll., on National Security ("the Act '):
§ 1.
(1) This Regulation shall apply to the members of the National Security Corps (hereinafter referred to as "the Corps') who have become members of:
(a) members of a criminal service under the provisions of § 6, § 1, § 2, point (a) of the Act; or
(b) of the employees for whom the conditions laid down in § 6 (1) (2) (b) of the Act have been met.
(2) The members of the criminal service referred to in paragraph 1 (a) shall be those of the staff who until 7 September 1947 were officials in charge of the criminal service (Class I), officials in the increased criminal service (Class II), officials in the Central Criminal Service (Class III) or gayists in the criminal service outside the service class.
(3) The staff referred to in paragraph 1 (b) shall be regarded as legal service officials (Ib Staff Class), senior administrative service officials (Ib Staff Class) and senior administrative assistant (II Staff Class) officials. In agreement with the Minister of Finance, the Minister of Interior shall designate, in the agreement with the Minister of Finance for which of the officials of the Administrative Assistance Service (Class III), of the officials of the Office Service (Class IV), of the staff of the Office's auxiliary service and of the contract staff, condition § 6, § 1, § 2, point (b) of the Act is fulfilled.
§ 2.
(1) The members of the Corps within the meaning of the provisions of Paragraph 1 shall be subject to the provisions of Part Four, Part II of the Act of 24 June 1926, No 103 Coll., on the adjustment of the salary and certain service conditions of civil servants (the Law of 4 July 1923, No 153 Coll., governing certain service conditions of the gendarmerie and certain gendarmerie, in particular rest and provision, as well as their respective implementing provisions, as amended by the Regulations, shall be amended and supplemented.
(2) The professional and salary ratios of staff members of the Corps (§ 1) shall be adjusted, mutatis mutandis, in accordance with the principles of Article 9 of the Government Decree of 24 December 1942, No 420 Coll., on the simplification and reorganisation of certain staff relationships in the public administration, and the Government Decree of 7 November 1930, No 163 Coll., on the taking-over and classification of employees of self-governing corporations in the public service, as if those employees had served from the outset in the former gendarmerie and had since been subject to the previous rules on the former gendarmory. This is based on the lowest salary scale, which is systemised for the relevant service category (Sections 98, 122 and 130 of the Law). The same applies to the initial service (§ 103, par. 2, § 124, 125 and 135 of the Law). For particularly serious service reasons, the Minister of the Interior may, in agreement with the Minister of Finance, authorise the staff member to be included in the scale of the same number and the designation provided for in Paragraph 103 (1) of the Law, as amended by the Law of 16 May 1946, No 139 Coll.
§ 3.
Officials in charge of the criminal service (1st class), officials in the legal service (1st class), officials in the increased criminal service (2nd class), officials in the higher administrative assistance service (2nd class) and officials in the secondary criminal service (3rd class).
(1) Under Paragraph 2, the following are assessed:
(a) a provision by an official of Ib. of the service class in the sixth scale, step (a) as a provision by an officer of the first service class in the seventh scale, step (b) (§ 124 of the salary law in conjunction with § 103 (2) (a) of the same law); and
(b) a provision by an official of the 2nd or 3rd grade on the 7th scale as a provision by an officer on the 8th scale, in the case of officials of the 2nd grade at step (a) (§ 124 of the Law in conjunction with § 103 (2) (c) of the same law).
(2) Staff members who have been transferred after 5 May 1945 to the category of officials of the increased criminal service or to the category of officials of the higher administrative assistance service (Class II) from among former members of the uniformed protectorate police, adopted at the time of infreedom, shall be classified as if such transfer had not taken place.
(3) Where the provisions of paragraph 2 do not apply to official candidates Ib. and II. These candidates will receive adjutum according to the provision of Section 100 of the Salary Act. An officer's post shall be granted to the candidate once he has completed the three-year waiting period and has complied with the general conditions and special conditions laid down for the provisions on the place of service from which he was reassigned to the Corps.
§ 4.
Auxiliary Administrative Service (Class III) and Office Service (Class IV) officials.
Officials of the auxiliary administrative service (Class III) and officials of the office service (Class IV) shall be classified either as officers of Class III or as gayers outside the class of service. The procedure for their inclusion shall be determined by the Ministry of the Interior, in agreement with the Ministry of Finance, taking into account, mutatis mutandis, the current accounting hours of service, the general and special conditions for the promotion of third-class executive officers and gayists outside the service classes of the Corps and the special circumstances which, in the event of an exceptional promotion in the current service relationship.
§ 5.
Staff of office support services.
The staff of the auxiliary office service shall be classified as outside the service classes, as if they had served from the outset in the former gendarmerie. In doing so, account shall be taken of the special circumstances which, in the case of which, justified an extraordinary promotion in the current service relationship. Staff on the 1st scale in the auxiliary office service may be transferred to the Ib. gayists' scale outside the service classes of the Corps at the most.
§ 6.
Contract staff.
The contract staff shall be assigned by the Ministry of the Interior in agreement with the Ministry of Finance, taking into account their qualifications, duration of service and use. Where, in view of the length of the previous service and the fulfilment of all other conditions for appointment, provision is made for the places the grant of which is reserved to the Government or the President of the Republic, the inclusion in that post may be effected only by the granting of that post by the appointing authority.
§ 7.
(1) Members of the Corps who were formerly military professional or agitators of a former Security Corps (gendarmerie or state police or municipal executive police) shall be classified as if they had not ceased to be military professional gayers, in the case of gayist of a gendarmerie or state police or municipal executive police.
(2) The appointment (promotion) which took place in the current service relationship is assessed in accordance with the provisions of Sections 2, 2 of this Regulation and 17, 4 and 5 of the salary law.
§ 8.
This Regulation shall enter into force on 7 September 1947; they shall be carried out by the Minister for the Interior in agreement with the Minister for Finance.
