DECLARATION
of 14 January 2016
on the publication of the National Natural Monuments of the European Union and establishing its closer protection conditions
The Ministry of the Environment provides pursuant to § 79 (4) (h) of Act No. 114 / 1992 Coll., on the Conservation of Nature and Landscape, as amended by Act No. 218 / 2004 Coll., Act No. 312 / 2008 Coll. and Act No. 349 / 2009 Coll.:
Announcement of a national natural monument
(1) The National Natural Monument of Zhejl (the "National Natural Monument") is announced.
(2) A natural service, as defined in paragraph 3, shall be declared a national natural monument, with the presence of:
(a) shrubbery and forest ecosystems of wetlands, meadow forests, spruce and beech trees;
(b) aquatic and wetland ecosystems of macrophyte vegetation of naturally eutrophic and mesotrophic standing waters, vegetation of persistent amphibious herbs, reeds and vegetation of high oysters, saltwine and transition peat;
(c) grassland and grassland, lowland to mountain heaths and fornicates;
(d) biotope of the community of nesting aquatic and wetland species, including the populations of such birds;
(e) biotopes of rare and endangered plant species of broccoli (Montia hallii), iceberg (Pilularia glolifera), uniflorous coastal (Littorella uniflora), roundfish (Drosera rotundifolia) and currant (Carex diandra), including their populations; and
(f) biotopes of rare and endangered species of rasperd (Melitaea diamina) and spiny-nosed (Rana arvalis) species, including their populations;
forming the object of the protection of the national natural heritage.
(3) The national natural monument is situated in the region of Vysočina, in the cadastral territory of Klatovec and in the territory of the South Bohemian Region, in the cadastral territories of the Upper Pole and Svělá pod Javorice. The boundaries of the national natural monument shall be determined by closed geometric patterns with direct sides whose vertices are determined by coordinates of the uniform trigonometric network of the cadastral1). The list of coordinates of the vertices of geometric patterns, as they follow, is given in Annex 1 to this decree.
(4) The protection zone of the national natural heritage is situated in the region Vysočina, in the cadastral territory Klatovec. The boundaries of the national natural heritage protection zone shall be determined by a closed geometric pattern with direct sides whose vertices are determined by coordinates of a single trigonometric network of cadastral1). The list of coordinates of the vertices of geometric patterns as they follow in the pattern are given in Annex 2 to this decree.
(5) An indicative graphical representation of the territory of the national natural heritage and its protection zone is given in Annex 3 to this Decree.
Closer protection conditions
Only with the consent of the competent nature conservation authority can the national natural monument:
(a) permit or make changes to the types of land or to their exploitation (2);
(b) permit or carry out construction or permit or make changes to completed or changes to construction before completion or placing in place of construction, advertising and information equipment;
(c) to adjust the surface of the road using non-local natural material of the same geological origin;
(d) design or characterise cycling routes or tourist routes;
(e) to enter or stay with motor vehicles and trailers off-road and local roads, except for owners, tenants and smugglers of land and their contractors working in the national natural monument, as well as persons providing for the performance of government administration, forest and agricultural management, hunting, water flow management, state defence, fire protection, health and veterinary services in the performance of this activity;
(f) interfere with the soil surface using wheel or belt machinery;
(g) fertilise the land or use chemical agents on the land, except for treatment of wood in landfills against bark, the use of repellents against the culling of game trees, and treatment of seed trees against clicochore pine;
(h) planting or planting plants with the exception of forest renewal or release animals; or
(i) authorise or make changes to the water regime; the modification of the water regime is not considered to be handling the water parts of Zešal and Karhov in accordance with the applicable operating rules and cases of the use of the competences of the water authorities or flood authorities for the regulation of extraordinary handling and, where appropriate, urgent handling in the event of an imminent water work accident.
Efficacy
This Decision shall enter into force on 1 February 2016.
