DECLARATION
of 13 January 2010
amending Decree No. 197 / 2004 Coll., implementing Act No. 99 / 2004 Coll., on the Pond, the exercise of fishing law, the fishing guard, the conservation of marine fisheries resources and amending certain laws (Fisheries Act), as amended by Decree No. 239 / 2006 Coll.
The Ministry of Agriculture provides, pursuant to Section 32 of Act No. 99 / 2004 Coll., on Pond, the exercise of fishing law, the fishing guard, the conservation of marine fishery resources and the amendment of certain laws (Law on Fisheries):
Decree No. 197 / 2004 Coll., implementing Act No. 99 / 2004 Coll., on Pond, Enforcement of Fishing Law, Fisheries Guard, Conservation of Marine Fishery Resources and amending certain laws (Fisheries Act), as amended by Decree No. 239 / 2006 Coll., is hereby amended as follows:
1. Paragraph 2, including the title and footnotes 1a, 1b and 1c, reads as follows:
Record keeping of pond management
[K § 3 (5) (b) of the Act]
(1) The record of the management and the economic result achieved in the farming and fishing of fish or in the production of aquatic organisms in the pond and in the special establishment consists of the management of the management data and of the economic result achieved using mass-efficient methods of fishing and fishing for fish for fish. These figures (1a) are shown in Annex 1, Tables A to E. Tables A to D shall only be submitted if the pond pond producer has produced and marketed more than 150 fish of salmon or of omnibus (salmon) in a calendar year or more than 100 kg of other fish or aquatic organisms. The data in Table E shall be submitted only on request to the authority of the State Fisheries Administration responsible pursuant to § 19 to 24 (hereinafter referred to as the competent fisheries authority).
(2) The record of caught eel (Anguilla anguilla) 1b and salmon (Salmo salar) 1c contains the information set out in Annex 1, Table F.
(3) The data referred to in paragraphs 1 and 2 shall be submitted in writing or by electronic means, certified by the guaranteed electronic signature, where appropriate via the data box to the competent fishing authority.
(1a) Regulation (EC) No 762 / 2008 of the European Parliament and of the Council of 9 July 2008 on the submission by Member States of statistics on aquaculture and repealing Council Regulation (EC) No 788 / 96.
(1b) Council Regulation (EC) No 1100 / 2007 laying down measures for the recovery of the stock of eel.
(1c) Council Regulation (EC) No 199 / 2008 establishing a Community framework for the collection, management and use of data in the fisheries sector and for the promotion of scientific advice for the common fisheries policy. ';
2. Paragraph 3 (2) is deleted.
Paragraphs 3 and 4 shall become paragraphs 2 and 3.
3. Paragraph 8, including the title, reads:
Record keeping of management and profit achieved in the fisheries sector
[Paragraph 11 (10) (d) of the Law]
The record of the management and the economic result achieved in the fisheries sector shall consist of the management of the data listed in Annex 5. This data shall be submitted in written or electronic form, certified by an guaranteed electronic signature, or, where appropriate, by means of a data box, to the competent fishing authority, supplemented by the identification of the user of the fishing area, as set out in Annex No 1 to Table A. ';
4. In Article 9, the following paragraph 3 is inserted after paragraph 2:
"(3) Exemptions from the fishing bans provided for in Section 13 (2) (c) of the Act may be granted for a maximum period of 2 years from the date of the acquisition of legal power of the decision authorising the exemption. '
Paragraphs 3 and 4 shall be renumbered paragraphs 4 and 5.
5. in Paragraph 11 (2) (r), "45" is replaced by "50."
6. In Article 11, at the end of paragraph 3, the dot is replaced by a comma and the following point (o) is added:
"(o) eel (Anguilla anguilla) 50 cm."
7. Annex 1 shall read as follows:

8. Annex 5 shall read as follows:
"Annex No 5 to Decree No 197 / 2004 Coll.
Efficacy
This Decree shall take effect on the date of its publication, with the exception of the provisions of Article 5 (1) (a), (b) and (c). I, points 6 and 7, which take effect on 1 January 2011.
