of 27 December 2001
on the method and frequency of measuring the amount of water
The Ministry of Agriculture, after consulting the Ministry of the Environment and the Ministry of Health, provides pursuant to § 10 (3) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act):
Subject matter
This decree provides
(a) the method and frequency of measuring the quantity of water for each type of authorised water management,
1. if it is surface water and not general handling, for collection, use of such waters for the production of fish or aquatic poultry or other aquatic animals, where appropriate, for the purpose of business and other handling, 1)
2. if groundwater is used, for collection, accumulation, pumping to reduce its level, artificial enrichment of groundwater sources with surface water and other handling, 2)
3. for the extraction of surface or groundwater and subsequent discharges into those waters in order to obtain heat energy;
4. to draw on contaminated groundwater for the purpose of reducing their pollution and subsequent discharges into those waters or surface waters, where appropriate;
(b) the method and frequency of measurement of the quantities of water which is a natural source of medicinal or natural mineral water or which is a reserved mineral;
(c) the method of measuring the amount of surface water airborne by the water part in the water stream or by the surface water accumulated by the water part;
(d) the scope, manner and frequency of the transmission of the results of the measurements to river basin management.
Method and frequency of measurement of the quantity of surface or groundwater taken
(1) The quantity of surface or groundwater collected shall be determined by:
(a) measurements in pressure sections of pipes; or
(b) measurements in open-water sections.
(2) In the case where the technical conditions for the method of measurement referred to in paragraph 1 are not established, the measurement shall be made by deriving from the proven electricity consumption necessary for the extraction of surface or groundwater.
(3) When measuring, in the case of paragraph 1 (a), measurements shall be made by a working meter established, 3) measuring continuously the volume of water flowing through the flow profile per unit of time. This measuring instrument, operational year-round, secured before theft and interference by unauthorised manipulation and allowing the reading or calculation of the amount of surface or ground water collected, shall be equipped with a local non-destructive record and, in the event of a power failure, shall be secured to store the measured data.
(4) For measurements in the case referred to in paragraph 1 (b), measurements shall be made by a measuring system, metrologically coupled within the meaning of a specific legislation, (4) measuring continuously the height of the water level, or, where appropriate, the rate of water flow and the functional dependence of the measured values to the volume of water flowing through the specific profile. This measuring system, operable year-round, secured prior to theft and tampering and enabling the reading or calculation of the amount of water collected, shall include a fixed flow to check the accuracy of the measurement in the range of the whole specific profile, linked to the Balt height system after levelling and equipped with a local non-destructive recording and in case of power failure by securing the measured data. Measurement must eliminate the effect of waves of the level on its correctness.
(5) In the case of different hydrogeological structures, when groundwater is sampled in one site, the amount of groundwater collected shall be measured separately from the individual groundwater levels used.
(6) The amount of surface or ground water collected during the period of proven non-functioning of the meter or measuring system shall be calculated from the number of hours of non-functioning and from the average hourly water flow over the period from the beginning of the year to the occurrence of the failure and, for seasonal sampling, surface or groundwater from the measured data of the previous year.
(7) For measurements in the case referred to in paragraph 1 (c), the quantity of surface or ground water collected in the pressure section of the pipeline shall be measured by deriving from the proven electricity consumption of the pumps installed in the transport circuit by multiplying the electricity consumption by the conversion factor, as determined from the control measurement of the flow through the pipeline, established in a conclusive manner. The conversion coefficient shall be the ratio between the volume of surface or groundwater taken and the electricity consumption. The conversion factor shall be determined on the basis of a picture of a control measurement of at least 7 days continuously. The condition of this measurement method is the separate measurement of the electricity consumed by the relevant pump unit or system of pumping units.
(8) Measurement of the amount of surface or groundwater taken shall be carried out once every 30 days.
Method and frequency of measuring the quantity of water for the artificial enrichment of groundwater water sources by surface water
Measurement of the amount of surface water for the artificial enrichment of groundwater sources by surface water shall be carried out in the manner set out in § 2 once a month.
Method and frequency of measuring the amount of groundwater pumped to reduce their level
Measurement of the amount of groundwater pumped to reduce their levels shall be carried out in the manner set out in § 2 once a month.
In other cases of water handling referred to in § 1 (a), the quantity of water shall be measured in accordance with the conditions laid down in the authorisation of the authority responsible for water handling.
Method and frequency of measurement of the amount of water collected which is a natural source of natural mineral water or a source of mineral water
(1) The method and frequency of measurement of the quantities of water collected, which is a natural medicinal source or source of natural mineral waters, shall be carried out in accordance with Article 2, unless otherwise provided for in the authorisation for the use of that source, issued under a special legislature6.
(2) Measurement of the quantities of water reserved for mineral purposes shall be carried out in a manner and frequency according to the conditions laid down in the permit for the disposal of such waters.
Method of measuring the amount of surface water airborne in the water stream or surface water accumulated in the water
The amount of surface water airborne in the water stream or surface water accumulated by the water part shall be determined from the functional dependence of the measured water level and volume of surface water by the air part or accumulated by the water part. To check the accuracy of the water level measurement, a fixed waterset is used, linked to the Balt height system after leveling. When measuring water level levels, the influence of water level waves on the accuracy of measurements must be eliminated, ensuring the year-round operation and protection from alienation and tampering.
Scope, method and frequency of transmission of measurement results to river basin managers
(1) The results of the measurements of the quantity of surface water collected shall be transmitted by the natural or legal person holding a valid permit for the handling of waters, (7) (hereinafter referred to as "authorised ') to the competent river basin administrator, to the extent that the quantity of surface water collected for each calendar month is determined on the fifth working day of the following calendar month. Such results shall be transmitted by the authorised person in writing and, where appropriate, in a manner agreed in advance with the competent river basin administrator.
(2) The results of the measurements of the quantities of groundwater and water collected, which is a natural source of natural mineral water or a reserved mineral water, and the results of the measurements referred to in paragraphs 4 to 6, shall be transmitted by the authorised river basin manager in writing and, where appropriate, in a manner that the authorised person agrees in advance with the relevant river basin manager, on 31 January of the following year, to the extent that the quantity of water found for each calendar month is present.
(3) The results of the measurement of the amount of surface water airborne in the water flow or surface water accumulated shall be transmitted by the competent river basin administrator authorised to the extent of the amount of surface water determined for each calendar month of the calendar year on 31 January of the following year. Such results shall be transmitted by the authorised person in writing and, where appropriate, in a manner agreed in advance with the competent river basin administrator.
Efficacy
This decree shall take effect on the day of its publication.
