DECLARATION

amending and supplementing Decree No. 126 / 1964 Coll., on contact between national and tugboat railways and on relations between participating organisations (trawl conditions)
The Federal Ministry of Transport provides in the agreement with the participating central authorities pursuant to § 4 (2) and § 29 of Act No. 51 / 1964 Coll., on Railways:
The Decree of the Ministry of Transport No 126 / 1964 Coll., on contact between national and tugboat tracks and on relations between the participating organisations (the trawl conditions) is amended as follows:
1. In Paragraph 5 (1), the first sentence is replaced by two new sentences:
"If the railway wagon is damaged on a tractor and the tractor is responsible for the damage, it is obliged to pay the CSD, in addition to compensation (or flat-rate compensation) of the damage caused on the railway vehicle, a fine equal to three times the damage caused, or a flat-rate compensation. In addition, the tractor shall pay the amount of the import fee, including, where appropriate, the repair fee. ';

Conditions of transport
The provisions of the Railway Regulations shall apply to the carriage of goods by road loaded or unloaded and transported by rail, to the carriage of goods by car in international transport, to the Agreement on the International Carriage of Goods by Rail (SMGS), to the International Convention on the Carriage of Goods by Rail (CIM) and to the Directive on the Carriage of Goods by Rail in International Carriage, unless otherwise provided for in Decree No 126 / 1964 Coll. The conditions for the transport of consignments by local transport and for the transport of consignments by tractor shall be laid down by a tariff. ';
This Decree shall take effect on 1 February 1980.
