GOVERNMENT DECLARATION
of 19 January 1966
on cultural funds and the Coordination Committee of the Cultural Funds
The Government of the Czechoslovak Socialist Republic provides pursuant to § 41 paragraph 2 of the Copyright Act No. 35 / 1965 Coll.:
Cultural Funds
(1) Cultural funds provide support for the creative activities of literary, scientific and artistic institutions,
for writing, journalism and creative activities in the field of theatre and film:
Czech Literary Fund with section for scientific and professional literature, section for creative activities in the field of theatre and film and section for journalism and Slovak Literary Fund with the same sections,
for the field of music:
Czech Music Fund and Slovak Music Fund,
for the field of Fine Arts and Architecture:
Czech Fine Arts Fund and Slovak Fine Arts Fund.
(2) Cultural funds (hereinafter referred to as "funds") are socialist organisations which may acquire rights and commit themselves on their behalf; The seat of Czech funds is Prague, the seat of Slovak funds Bratislava.
(1) The mission of the funds is to promote the progressive literary, scientific and artistic creation and artistic activity of an idea and aesthetic level and social importance.
(2) It fulfils its mission of the Funds in particular by:
(a) create, in a universal manner, suitable conditions for the creation of literary, scientific and artistic works and works of art;
(b) establish and operate undertakings and special-purpose equipment in accordance with the mission of the Funds;
(c) establish homes and clubs for creative work;
(d) provide loans, scholarships and travel allowances to support creative activities, or provide various services;
(e) provide support to creative workers or their family members in urgent cases.
(3) In the field of science, the funds take care of the development of an activity which results in work within the meaning of the copyright law.
(4) Details of the tasks of each fund and its sections are laid down in the organisational rules of those funds (Section 16).
The financial basis for the fund's management is:
(a) contributions to funds under Government Decree No. 3 / 1966 Coll., on the contributions of authors and performers to cultural funds and under Government Decree No. 4 / 1966 Coll., on the contributions for the use of free works of literary, scientific and artistic works and on the contributions of users of works,
(b) the proceeds of their property, the surplus from the undertakings they manage and the special-purpose equipment, the gifts and the inheritance.
(1) The management of the Funds and their sections are provided by their committees.
(2) In the committees of literary funds, the Association of Czechoslovak writers (Association of Slovak writers) appoint five members, the Association of Czechoslovak composers (Association of Slovak composers) appoint five members, the Committees of Fine Arts (Association of Slovak Artists) appoint five members and the Association of Architects of ČSSR (Association of Slovak Architects) three members.
(3) Section Committees have five members appointed by the Czechoslovak Academy of Sciences (Slovak Academy of Sciences), the Union of Education and Culture Employees (Slovak Trade Council) and the Czechoslovak Scientific and Technical Society (Slovak Council of the Czech Scientific and Technical Society) to the sections for creative activities in the field of theatre and film Association of the Czechoslovak Theatre Artists (Slovak Theatre Artists Association), the Czechoslovak Society of Film and Television Artists (Slovak Film and Television Artists Association), taking into account the representation of artistic staff in the field of radio and in the sections for the journalism of the Czech Press (Slovak Journalists).
(4) The committees of the Funds and the sections shall elect a chairman and Vice-President from among their members.
(5) The Funds are represented and signed by their chairman or vice-chairman and other members of the Committee.
(6) The activities of the Fund Committee shall be carried out by the Director appointed by the Minister for Education and Culture, on a proposal from the Fund Committee, in Slovakia by the SNR Commissioner for Education and Culture. The Director of the Fund shall be responsible for his activities to the Fund Committee.
(7) The Section Committee shall be responsible for the activities of the section of the Literary Fund Committee. The Committees of Literary Funds shall discuss at least twice a year the activities and management of their sections, at a joint meeting of the Fund Committee with the Section Committee.
(8) The fund's management is under the responsibility of the Fund Committee to the Ministry of Education and Culture, in Slovakia, the SNR delegates for Education and Culture.
(9) The costs of the Fund's activities are borne by the Fund. The Section shall cover the costs arising from its own activities.
Coordination Committee on Cultural Funds
A Coordination Committee of the Cultural Funds (hereinafter referred to as the "Coordination Committee ') shall be set up to decide on matters common to all cultural funds and to ensure a common procedure for the implementation of uniform national cultural policy principles, as well as the application of social interests in the activities of cultural funds.
(1) Coordination Committee
(a) discuss and approve the concept of the development of individual funds, their undertakings and special-purpose equipment;
(b) monitor the management of the funds and ensure that the proper cultural policy is implemented when the funds are used;
(c) discuss action plans, investment plans, work plans, budgets and final accounts of the Funds and require regular reports and reports of their activities and management from the Fund Committees;
(d) is active in the allocation of certain contributions to individual funds;
(e) approve the principles of the support activities of the Funds and monitor their implementation;
(f) it shall discuss other essential measures relating to all funds and, unless they require the consent of another authority, shall approve such measures.
(2) The decisions of the Coordination Committee are binding on the Funds; resolutions of an economic scope of a fundamental nature can only be implemented with the consent of the Ministry of Education and Culture, in Slovakia the SNR Commissioner for Education and Culture.
(3) The Coordination Committee shall be responsible for its activities to the Ministry of Education and Culture.
(1) The Coordination Committee has 32 members; its headquarters is Prague.
(2) The members of the Coordination Committee are the chairmen or authorised members of the committees of all six Funds, the directors of these Funds and other members, of which they appoint the Union of Czechoslovak writers, the Union of Czechoslovak Artists, the Union of Czechoslovak Artists, the Association of Czechoslovak Theatre Artists, the Union of Czechoslovak Film and Television Artists and the Federation of Czechoslovak Journalists, the corresponding associations in Slovakia, the Czechoslovak Academy of Sciences and the Slovak Academy of Sciences; appoint two members, the Ministry of Education and Culture and the SNR Commissioner for Education and Culture.
(3) The Chair and the two Vice-Presidents of the Coordination Committee shall be elected by the Committee from among their members.
(4) The Czech Literary Fund provides administrative work for the Coordination Committee. The costs of the activities of the Coordination Committee shall be borne by the Funds.
The function of the Coordination Committee in the resolution of the Fund's specific problems in Slovakia shall be performed by the members of the Coordination Committee from Slovakia. They shall be responsible for their activities to the Coordination Committee and to SNR delegates for education and culture. Paragraph 7 (4) shall apply mutatis mutandis.
Provisions common and final
The Funds are managed and supervised by the Ministry of Education and Culture in close cooperation with the Arts Union, the Union of Education and Culture Employees and the participating authorities and bodies. Within the scope of its competence, the SNR is responsible for education and culture against the Slovak funds.
(1) The term of office of the committees of the Funds, sections and coordination committee (hereinafter referred to as "committees") shall be three years.
(2) If a member of the Committee is removed or ceases to be a member before the expiry of his term of office, another member must be appointed as member for the remainder of his term of office.
Committees may invite experts to their meetings either on a permanent basis or in order to resolve a particular matter, or require expert opinions, proposals, etc. The costs associated with this shall be borne by the Funds from their own resources. The Director of the Fund shall participate in the Committee's deliberations.
(1) Membership of committees is an honest function.
(2) The costs incurred in the performance of the duties shall be reimbursed in accordance with the general rules.
Committees shall meet as necessary, but at least twice a month, the Coordination Committee at least four times a year.
(1) The committees are able to resolve in the presence of most members.
(2) A simple majority of the members present shall be required for the resolution to be in force and the President shall take a decision in the event of a tie.
(3) If the motion for a resolution of the Fund Committee contradicts the rules in force, the Director shall draw the attention of the Fund President.
Minutes shall be taken of the committee's deliberations, the accuracy of which shall be confirmed by the President.
(1) The Coordination Committee, approved by the Ministry of Education and Culture, shall issue its detailed rules of procedure and the Conditions of Employment within three months of the date of application of this Decree. The Rules of Procedure of the Coordination Committee shall also lay down the arrangements for the members of that Committee from Slovakia to deal with the specific problems of the Funds in Slovakia.
(2) The Committees of the Funds shall, after consultation in the Coordination Committee and with approval by the Ministry of Education and Culture (the SNR Director for Education and Culture in agreement with the Minister for Education and Culture), issue within six months of the effectiveness of this Decree detailed organisational and working rules of the Funds and sections.
(1) Government Decree No 128 / 1954 Ú. l. (No 154 / 1954 Ú. v.), which establishes the rules of organisation and procedure of the cultural funds, is hereby repealed.
(2) This Decree shall take effect on 1 February 1966.
