of 16 January 1951
on transfers of competence in the field of agricultural credit.
The Government of the Czechoslovak Republic orders pursuant to § 8 (4) of Act No. 280 / 1948 Coll., on Regional Establishment, and § 1 (1) of the Act No. 143 / 1949 Coll., on changes in the organisation of public administration and within the scope of its bodies:
The acceptance of the State guarantee for the agricultural credit and its accessories pursuant to Article 8 of Act No. 43 / 1948 Coll., on the Agricultural Loan (hereinafter referred to as "the Act ') shall be transferred to the Regional and Regional National Committees, to the extent specified below by the Ministry of Agriculture and Finance.
It is for the Regional National Committee to take over the State guarantee for the agricultural credit granted
(a) single agricultural cooperatives, if they are for credit
(aa) long-term (§ 5 of the Act) up to an amount of CZK 1,000.000;
bb) short-term (§ 4 of the Act) above the amount of CZK 250.000 up to the amount of CZK 1,000.000;
(b) farmers referred to in § 2 (a), (b) and (d) of the Act, if the area of the holding does not exceed 20 ha, if the loan is long-term (§ 5 of the Act), with the exception of the loan for construction investment and land purchase, up to an amount of CZK 50,000.
It is for the District National Committee to take over the State guarantee for the short-term agricultural credit (Section 4 of the Act)
(a) single agricultural cooperatives up to an amount of CZK 250.000;
(b) farmers referred to in § 2 (a), (b) and (d) of the Act, if the area of the holding does not exceed 20 ha, up to an amount of CZK 50,000.
The amounts mentioned in § § 2 and § 3 include outstanding claims with credit facilities previously granted.
The scope of the Regional National Committees under § 15 to 17 of the Act, transferred to them by the Regional Agricultural Credit Commissions, remains unaffected.
The National Committees shall check whether the agricultural loans for which they have taken over the State guarantee have been used for the purposes for which they have been authorised and shall also ensure that credit claims are repaid within the specified deadlines. This is without prejudice to the control obligation of creditor money institutions.
Government Decree No. 12 / 1950 Coll., on Transfers in the Field of Agricultural Credit, is hereby repealed.
This Regulation shall enter into force on 1 February 1951. They shall be carried out by the Ministers for Agriculture, Home Affairs and Finance.
