of 31 December 1949
on the competence of national committees in the construction, administration and maintenance of national roads.
In agreement with the Minister of the Interior, the Minister of Technology hereby mandates, in accordance with § 6 (1) of Act No. 147 / 1949 Coll., to issue certain regulations on public roads:
§ 1.
(1) The District National Committee shall be responsible for the administration of all national roads within its perimeter (unless it is entrusted to the Regional National Committee pursuant to Article 2) and for maintaining them to the extent specified in paragraph 3.
(2) The management referred to in paragraph 1 shall in particular:
(a) budgetary matters and credit management;
(b) surveillance of compliance with road protection regulations (except for their accessories),
(c) the authorisation and registration of foreign facilities in the road body, with the exception of those built under Section 90 of the State Defence Act;
(d) representation of the State Road Administration at meetings in which that Administration is a party, unless representation is paid by the Regional National Committee;
(e) the acquisition and reporting of road users;
(f) road transport census,
(g) registration and statistics of state roads (excluding their accessories),
(h) registration of rights and obligations relating to national roads; and
(i) submission of ideas, proposals and comments on road matters.
(3) Maintenance shall include the district national road management committee and its components, provided that the relevant work is not of an investment nature and is carried out by the road authorities assigned to the district national road committee without the use of road machinery and motor vehicles; are in particular:
(a) care for the proper state of the roads and, in particular, for their good running;
(b) the maintenance and placing of transport signs; and
(c) road care for trees.
§ 2.
(1) The Regional National Committee is responsible for matters relating to national roads in its district
(a) management and maintenance, where referred to in paragraph 2;
(b) management activity;
(c) supervisory activities;
(d) investment activity.
(2) Management and maintenance
(a) budgetary and credit management matters, insofar as they relate to the scope referred to in this paragraph;
(b) road maintenance;
(c) the administration, maintenance and periodic inspection of bridges;
(d) administration and maintenance of equipment for state roads, in particular facilities for state road administration;
(e) transport and safety matters, where they belong to the Ministry of Technology department;
(f) laying down technical conditions for the transport of extremely heavy and large loads on roads and bridges;
(g) representation of the State Road Administration at meetings in which that Administration is party, if the Regional National Committee reserves such representation;
(h) the concentration of traffic reports;
(i) registration and statistics of state roads and bridges; and
(j) decision-making in the second storehouse in cases decided in the first storehouse by the district national committee.
(3) The management activities include in particular:
(a) organisation of the State Road Service;
(b) cooperation in the management of the road network with national aspects for regional plans and for land consolidation as well as in the design of other technical works;
(c) drawing up a draft road and bridge construction plan and checking the implementation of the approved plan;
(d) drawing up a draft financial and material supply plan in the field of road and bridge construction and checking the implementation of the approved plans;
(e) budgeting the maintenance of roads and bridges; and
(f) with the establishment of the State Road Administration.
(4) In particular, supervision of road services and the management of loans by district national committees shall be included in the supervisory work.
(5) Investment activities include in particular:
(a) designing road and bridge structures;
(b) the implementation and settlement of investment works under its own control;
(c) the award and supervision of the implementation of investment works; and
(d) taking over investment works.
§ 3.
The provisions of Government Decree No. 13 / 1949 Coll., on Technical Reports of Regional National Committees, in particular as regards tasks which provide technical reports of Regional National Committees in Prague, Brno and Bratislava for other Regional National Committees (§ 2 (4) of the Government Regulation) remain without prejudice.
§ 4.
This Regulation shall enter into force on the day of its publication.
