DECLARATION
of 15 June 2023
amending Decree No. 206 / 2012 Coll., on professional competence for the handling of products, as amended by Decree No. 17 / 2018 Coll.
The Ministry of Agriculture, in cooperation with the Ministry of Health, pursuant to § 88 (4) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the amendment of certain related laws, as amended by Act No. 199 / 2012 Coll. and Act No. 299 / 2017 Coll.:
Decree No. 206 / 2012 Coll., on professional competence for the handling of products, as amended by Decree No. 17 / 2018 Coll., is amended as follows:
1. In Paragraph 1a (2) of the Introductory Part of the provision, the words "or higher education programmes' are deleted.
2. in Paragraph 1a (2), the comma at the end of point (e) shall be replaced by a dot and point (f) shall be deleted;
3. In Article 1a, the following paragraph 3 is added:
"(3) Higher education programmes, after which a person is considered to be holder of a second-degree certificate for a period of 3 years, are those in which that person has passed an examination of articles focusing on plant production and plant protection."
4. In Paragraph 4 (5), the words "a plant health professional with a valid third-degree certificate 'are replaced by the words" a person who fulfils the qualification criteria for professional trainers'.
5. In Article 5 (1) (f), the words "the examiner 'are replaced by the words" the examiner who fulfils the qualification criteria for professional trainers'.
6. In Paragraph 5 (2), the words "to be transmitted by the Institute 'are replaced by the words" to be transmitted'.
7. Paragraph 6a (3) reads as follows:
"(3) Immediately after completion of the course organised by the employer, the employer shall provide the Institute in electronic form with the following information on persons who have completed the course and are therefore considered to be holders of a first-degree certificate:
(a) the name and, where appropriate, the name, surname, place of permanent residence or residence, date and place of birth; and
(b) the date of completion of the course. "
8. In Paragraph 6a (4), the words "surname," shall be inserted after the words "residence," the words "or residence," and the words "signature of the training instructor" shall be replaced by the words "first name, surname and signature of the holder of the second or third degree certificate who provided knowledge within the course of the course."
9. Annexes 2 to 4 shall read as follows:

Efficacy
This Decree shall take effect on 1 July 2023.
