on a technical plan for the transition of terrestrial digital television from DVB-T to DVB-T2 standard (Government Decree on the Technical Plan for the transition to DVB-T2 standard)
The Government orders pursuant to Article II (1) of Act No. 252 / 2017 Coll., amending Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Electronic Communications Act), as amended, and Act No. 483 / 1991 Coll., on Czech Television, as amended, ("the Act '):
Subject matter
(1) This Regulation establishes a technical plan for the transition of terrestrial digital television from DVB-T to DVB-T2.
(2) This Regulation shall apply to terrestrial digital television broadcasting distributed on the broadcasting networks listed in Annexes 1 to 4 to this Regulation and shall regulate the process of switching terrestrial digital television from DVB-T to DVB-T2 standard (hereinafter referred to as the "transition ') to release radio frequencies in the 694- 790 MHz frequency band.
Definition of terms
For the purposes of this Regulation:
a) a high power transmitter providing terrestrial digital television broadcasting in the Czech Republic with a maximum effective radiated power (ERPmax) of more than 30 dBW;
b) a small-power transmitter or television converter providing terrestrial digital broadcasting in the Czech Republic with a maximum effective radiated power (ERPmax) equal to or less than 30 dBW;
(c) a broadcasting network comprising a public communications network consisting of transmitters providing terrestrial digital television broadcasting;
(d) a digital multiplex aggregate data flow containing sub-data flows belonging to individual television and, where appropriate, radio programmes, programme-related services or additional services that are adapted for joint transmission and subsequent dissemination through the broadcasting network;
(e) an existing broadcasting network operated on the basis of radio frequency allocation in the 470- 790 MHz frequency band in which digital multiplex is distributed in DVB-T standard;
(f) a transmission network via a transmission network established and operated for a limited period pursuant to Article II (3) of the Law on the dissemination of simultaneous broadcasting using the radio channels listed in Annexes 1 to 4 to this Regulation;
(g) by simultaneous broadcasting of the time-limited simultaneous distribution of terrestrial digital television in DVB-T standard through existing broadcasting networks and terrestrial digital television transition networks in which digital multiplex is disseminated in DVB-T2 standard in the concerned geographical area corresponding at least to the territorial coverage of the relevant geographical area by terrestrial digital broadcasting in DVB-T standard operated on the basis of individual authorisations for the use of radio frequencies in force on the date of entry into force of this Regulation;
(h) a 8 MHz radio frequency block used for terrestrial digital television in DVB-T or DVB-T2 standard, marked with its number;
(i) the final transmission network of the transmission network operated on the basis of the allocation of radio frequencies in the 470- 694 MHz frequency band as modified in accordance with Article II (5) of the Act, in which digital multiplex is distributed in the DVB-T2 standard.
Transmission network designation
The transmission networks shall be identified by the following numbers:
(a) 1, 2, 3 and 4 in the case of an existing broadcasting network;
(b) 11, 12 and 13, in the case of a transitional network; and
(c) 21, 22, 23 and 24, for the final transmission network.
Definition of the territorial areas concerned
On the transition, the radio frequency allocation holders in DVB-T shall follow the relevant territorial areas defined for each existing transmission network separately according to the technical and frequency solution of the existing transmission network 1 to 4. The territorial areas concerned shall be defined on the basis of the value of the minimum planning intensity of the terrestrial television signal from the relevant high power transmitters and small power transmitters.
Basic transition conditions
(1) The switching off of terrestrial digital television in the DVB-T standard within the deadlines set out in Annexes 1 to 4 to this Regulation may take place where the coverage of the population in the area concerned is ensured by the signal of the final or transitional broadcasting network of the terrestrial digital television in the DVB-T2 standard at least within the scope of the transmission of existing DVB-T networks and where natural or justified technical barriers do not prevent this, while:
(a) the final transmission network 21 replaces the existing transmission network 1;
(b) the final transmission network 22 replaces the existing transmission network 2;
(c) the final transmission network 23 replaces the existing transmission network 3; and
(d) the final transmission network 24 replaces the existing transmission network 4.
(2) The extent of coverage of the geographical area concerned by terrestrial digital television broadcasting is ascertained by the operator (1) of the broadcasting network by calculation or verified by measurement in accordance with the Decree on the method of determining the coverage of terrestrial television broadcasting signals (2). The coverage of the terrestrial digital television broadcasting area concerned shall be assessed by the broadcasting network operator in accordance with the planning parameters set out in Annex 5 to this Regulation. The target coverage of terrestrial television broadcasting signals for the final broadcasting networks 21 to 24 is assessed by the network operator in accordance with § 11 (2).
(3) The simultaneous transmission shall be provided by a high-performance transmitter in the area concerned for at least the period specified in Annexes 1 to 4 to this Regulation, whereby:
(a) the migration network 11 is intended to ensure simultaneous transmission to the existing network 1;
(b) the transition network 12 is intended to ensure simultaneous transmission to existing transmission networks 2 and 3 and, where appropriate, to regional broadcasters;
(c) the transition network 13 is intended to ensure simultaneous transmission to the existing broadcasting network 4 and, where appropriate, to regional broadcasters.
(4) The switching off of large-power transmitters of existing transmission networks 1 to 4 in the DVB-T standard shall be carried out by the transmission network operators within the time limits set out in Annexes 1 to 4 to this Regulation, provided that simultaneous transmission is ensured for at least 6 months.
(5) Small-power transmitters of existing broadcasting networks will be transferred by network operators to terrestrial digital television broadcasts disseminated in DVB-T2 following the switching off of high-power transmitters in DVB-T in the area concerned. In the event that, due to natural or justified technical barriers, such conversion of small power transmitters using radio frequencies from the 470- 694 MHz band will not be possible, the transmission network operator may, if the technical impediments permit, even after the deadline set out in § 11 (1) or, if the technical barriers cannot be resolved, end its transmission on 1 February 2021. The transmission of small power transmitters operated using radio frequencies from the 694- 790 MHz band shall be completed by 31 October 2020 at the latest.
The final broadcasting network of 21 broadcasters by law
(1) The final transmission network 21 for the dissemination of the digital multiplex of public service (3) of terrestrial digital television in DVB-T2 is composed of radio channels 26, 33 and 39. Other radio channels may be used for small power transmitters under the conditions set out in Section 10 (8).
(2) Radio channels for terrestrial digital television multiplex public service broadcasting in DVB-T standard, radio channels to provide a transverse broadcasting network of 11 and radio channels to the final broadcasting network 21 and the deadlines for switching off the existing broadcasting network 1 are set out in Annex 1 to this Regulation.
(3) The broadcasting operator of the Act (hereinafter "Czech Television") fulfils the conditions of the Czech Television Act and the Czech Radio Act for the operation of the digital multiplex of public service once at least 95% of the population is covered by the terrestrial digital television signal in the DVB-T2 standard by calculation according to the Decree on the method of determining the coverage of terrestrial television signals. If the coverage value set by the first sentence is achieved, Czech TV can make changes in DVB-T including complete or partial disconnection of DVB-T.
(4) From the time the coverage of at least 95% of the population under paragraph 3 is reached, the availability of individual Czech Television programmes is assessed in the sum of all the channels used to disseminate digital terrestrial television. Czech television shall end its digital terrestrial broadcasting in the DVB-T standard or part thereof, depending on its technical and economic capabilities, and in particular after reaching at least 95% of the population coverage referred to in paragraph 3.
Final transmission network 22
(1) The final transmission network 22 for the dissemination of terrestrial digital television in DVB-T2 is composed of radio channels 22, 27, 28, 34, 38 and 40. Other radio channels may be used for small power transmitters under the conditions set out in Section 10 (8).
(2) Radio channels for terrestrial digital television in the DVB-T standard within the existing broadcasting network 2, radio channels for the transition broadcasting network 12 and radio channels for the final broadcasting network 22 and the deadlines for the termination of terrestrial digital television in the DVB-T standard are set out in Annex 2 to this Regulation.
Final transmission network 23
(1) The final broadcasting network 23 for the dissemination of digital terrestrial television in DVB-T2 is composed of radio channels 22, 23, 31, 33, 34 and 35. Other radio channels may be used for small power transmitters under the conditions set out in Section 10 (8).
(2) Radio channels for terrestrial digital television in DVB-T standard within the existing broadcasting network 3, radio channels for the transition broadcasting network 12 and radio channels for the final broadcasting network 23 and the deadlines for the termination of terrestrial digital television in DVB-T standard are set out in Annex 3 to this Regulation.
Final transmission network 24
(1) The final broadcasting network 24 for terrestrial digital television broadcasting in DVB-T2 is composed of radio channels 21, 30, 42, 43, 44, 45 and 46. Other radio channels may be used for small power transmitters under the conditions set out in Section 10 (8).
(2) Radio channels for terrestrial digital television in DVB-T standard within the existing broadcasting network 4, radio channels for the transitional broadcasting network 13 and radio channels for the final broadcasting network 24 and the deadlines for the termination of terrestrial digital television in DVB-T standard are set out in Annex 4 to this Regulation.
Other transition conditions
(1) The holder of the radio frequency allocation for the spread of terrestrial digital broadcasting shall request the Authority to amend the allocation in accordance with the terms of Article II (5) of the Act and Annexes 1 to 4 to this Regulation.
(2) Following a decision by the Authority to modify the allocation of radio frequencies necessary for the operation of the final transmission networks, the holder of an individual authorisation for the use of radio frequencies shall, within the time limits set out in Annexes 1 to 4 to this Regulation, request the Authority to:
(a) the withdrawal of an individual authorisation to use radio frequencies for existing broadcasting networks or transition networks in accordance with Section 19 of the Electronic Communications Act; and
(b) the issue of an individual authorisation for the use of radio frequencies necessary for the operation of the final transmission networks.
(3) Individual permissions for the use of radio frequencies referred to in paragraph 2 (b). (b) The Office shall not grant decisions on the withdrawal of an individual authorisation issued pursuant to paragraph 2 (a) until such time as it has acquired legal authority.
(4) In addition to ensuring the transition, terrestrial digital television broadcasting by regional television broadcasters under the Broadcasting Act can be disseminated to the geographical extent given by the technical solutions and the frequency possibilities of these networks in the transition networks 12 and 13 and the final networks 22 to 24.
(5) Where, during the period of parallel broadcasting, coverage of the geographical area concerned by digital terrestrial broadcasting in standard DVB-T2 by a cross-border network in which programmes are located
(a) the licensed broadcasters do not achieve at least the same value of the coverage of the territory as the coverage of that territory by digital terrestrial broadcasting in DVB-T standard; or
(b) the broadcasters by law do not reach the coverage of at least 95% of the population of the final network in the area concerned;
the operator of the relevant transmission network shall make use of the radio channel allocated to the area concerned and to the transmitters at sites in the relevant geographical area other than those listed in Annexes 1 to 4 to this Regulation. If the allocated radio channel cannot be used for such a solution, the network operator shall proceed in accordance with paragraph 7.
(6) For the use of the radio channel at stations not listed in Annexes 1 to 4 to this Regulation, within networks using the same radio channel in the relevant geographical area, the operator of the transmission network shall request the Authority to grant an individual authorisation for the use of radio frequencies so that the time limits set for the initiation and termination of simultaneous broadcasting, the start of the operation of the final broadcasting networks and the shut-off of terrestrial digital television in the DVB-T standard may be fulfilled, but at least:
(a) 6 months for large power transmitters; or
(b) 2 months for small power transmitters
before the planned launch of such a transmitter.
(7) Where the network operator cannot ensure coverage of the territory by terrestrial digital television broadcasting within the technical barriers area concerned, to the extent provided for in this Regulation, even in accordance with the procedure laid down in paragraphs 4 and 5, it shall immediately inform the relevant broadcasters and the Authority. When removing technical barriers to ensuring the coverage of the territory by terrestrial digital television broadcasting as referred to in the first sentence, the Authority shall provide the operator of the network with the necessary synergies at its request.
(8) The radio channels set out in Annexes 1 to 4 to this Regulation for small-power transmitters shall be modified by the Authority, depending on the technical possibilities of the transmission networks, on the basis of the successful frequency coordination and a reasoned request by the operator of the relevant transmission network for the change of the specified radio channel.
Completion of the transition
(1) The digital terrestrial broadcasting in DVB-T standard using radio frequencies of the 694- 790 MHz band in existing broadcasting networks 1 to 4 shall end on 31 October 2020 at the latest, for which radio frequencies of the 694- 790 MHz band will be released.
(2) By 1 February 2021, Czech television will ensure coverage of the territory by digital terrestrial broadcasting in the DVB-T2 standard of the final broadcasting network of 21 to at least 95% of the population. The coverage of the population by the final transmission networks 22, 23 and 24 shall be ensured by the broadcasters of the broadcasting networks to the extent that the population is covered by the territory by digital terrestrial television broadcasting in the DVB-T standard by existing transmission networks 2, 3 and 4 on the date of entry into force of this Regulation.
(3) Transmission via existing broadcasting networks disseminating digital multiplex in DVB-T standard using 470- 694 MHz radio frequencies shall be terminated by 1 February 2021 at the latest.
Efficacy
This Regulation shall enter into force on the 15th day following its publication.

Determination of coverage by terrestrial digital television broadcasting
The coverage of the population of the Czech Republic by terrestrial digital television broadcasting networks shall be assessed in accordance with the procedure laid down in the Decree on the method of determining the coverage of terrestrial television signals using the calculation method according to the ITU-R P.1546-2 Recommendation and the following planning parameters:
(a) for existing broadcasting networks:
1. modulation scheme of sixty-four-state quadrature amplitude modulation (64-QAM),
2. an operating mode with a number of 6817 carrier frequencies (8k);
3. a code ratio indicating the level of security of the transmission system against errors of two thirds;
4. a protective interval to ensure the intake of undisturbed unwanted reflections of one quarter.
(b) for transition networks and final transmission networks:
1. modulation scheme for two fifty-six-state quadrature amplitude modulation (256-QAM) with rotation,
2. operating mode with 27841 carrier frequencies (32k extended),
3. a code ratio indicating the level of security of the transmission system against errors of two thirds;
4. a protective interval to ensure the intake of undisturbed unwanted reflections of one eighth;
5. distribution of pilot carrier PP2.
