DECLARATION
of 29 May 2008
amending Decree No. 487 / 2004 Coll., on personality competence which is a prerequisite for the performance of duty in the Security Corps, as amended
In agreement with the Ministry of Finance, the Ministry of Justice, the Security Information Service and the Office for Foreign Relations and Information, the Ministry of Interior provides, pursuant to § 15 (7) and § 79 (7) of Act No. 361 / 2003 Coll., on the service relationship of members of the Security Corps:
Decree No. 487 / 2004 Coll., on personality competence, which is a prerequisite for the performance of the service in the Security Corps, as amended by Decree No. 658 / 2004 Coll. and Decree No. 468 / 2005 Coll., is amended as follows:
1. In Article 2, at the end of point (c), the word "or 'is deleted.
2. in Article 2, the following point (d) is inserted after point (c):
"(d) the presumption that a member is temporarily or permanently unfit for service at a post in the Security Corps for which another specific requirement of personality is provided; or"
Point (d) shall be renumbered as point (e).
3. Paragraph 3 (2) reads as follows:
"(2) An official shall apply for the determination of his / her capacity. A doctor of a facility for racing preventive care applies for the determination of personality on the grounds referred to in § 2 (c) or (d) through a professional official. For the same reason, a member may request the identification of his or her personality. ';
4. Paragraph 3 (4) is deleted.
5. Paragraph 4 (3) reads as follows:
"(3) The psychological centre of the Security Corps, which previously identified the personality of the person under assessment, shall, with the written consent of that person, provide its documentation to another psychologist of the Security Corps if requested."
6. In Article 4 (4), the words "where appropriate, further 'are deleted.
7. in Paragraph 4, the following paragraph 5 is inserted after paragraph 4:
"(5) Where, in the context of the determination of personality for the reason set out in Section 2 (d), there is doubt that the person under assessment is temporarily or permanently unfit to serve in the Security Corps, the psychologist shall inform the staff member accordingly. ';
Paragraphs 5 and 6 shall become paragraphs 6 and 7.
8. In Paragraph 4 (7), the word "sent 'is replaced by" provided'.
9. In Article 5, at the end of the text in point (b), the words "or at the place of service of the Security Corps for which another specific requirement of personality is provided shall be added."
10. in Article 5 (f):
"(f) information on the possibility of making a proposal for a review of the conclusion to the head of the psychological centre of the Security Corps (hereinafter referred to as the head psychologist).";
11. in Article 6 (1) to (3):
"(1) The lead psychologist shall, on the basis of a proposal from the authorised person, examine the conclusion of a psychologist who has ascertained his or her personality, or designate a psychologist for his or her assessment of a security corps psychologist who did not identify his or her personality in the case under consideration. The assessment shall be carried out without undue delay and the lead psychologist shall inform the person under consideration no later than 30 days after the receipt of the proposal.
(2) The examination procedure shall assess the methods used in determining personality and the accuracy of their evaluation. In order to assess the accuracy of a psychologist's conclusion, a lead psychologist, as his advisory body, may set up a board composed of security services psychologists. The Commission may not be a member of a psychologist who, in the case at hand, has established his / her personality.
(3) The Head of the psychologist, the commission established by him or his designated psychologist of the Security Corps shall re-establish the personality of the person under consideration, if necessary for the assessment of the conclusion. The head psychologist or his designated psychologist of the Security Corps shall inform the person under consideration of the date of the reassessment of his / her personality through the official office. ';
12. in Article 6 (5), the word "sent" shall be replaced by "provided."
Efficacy
This Decree shall take effect on the 15th day following its publication.
