DECLARATION
of 25 April 2006
amending Decree No. 72 / 1988 Coll., on the use of explosives, as amended
According to § 27 (6) and § 33 (5) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, as amended by Act No. 542 / 1991 Coll. and Act No. 315 / 2001 Coll.:
Decree No. 72 / 1988 Coll., on the use of explosives, as amended by Decree No. 173 / 1992 Coll., Decree No. 340 / 1992 Coll., Decree No. 99 / 1995 Coll., Decree No. 341 / 2001 Coll., Decree No. 338 / 2004 Coll. and Decree No. 298 / 2005 Coll., is amended as follows:
1. the first part shall read:
GENERAL PROVISIONS
Preliminary provisions
This decree has been notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and rules and of rules on information society services, as amended by Directive 98 / 48 / EC. ';
2. In the second sentence of Article 24 (1), the words "as required by the relevant Czech technical standard (6) or equivalent technical standard of a Member State of the European Union, of the European Free Trade Association which is a Contracting Party to the Agreement on the European Economic Area, or of Turkey, shall be inserted after the words" or explosion of explosives, "provided that they guarantee at least an equivalent level of health and safety protection. ';

"6) ČSN EN 33 23 40 Electrical equipment in environments with a risk of fire or explosion of explosives."
3. Paragraph 25 (1) reads as follows:
"(1) The functional reliability of detonators and ohms shall be tested in accordance with the conditions laid down by the manufacturer."
4. In Paragraph 27, the sentence "The correctness of the data in the record shall be confirmed by another staff member present acting as storer or marksman or assistant to the gunsmaster or technical manager of the shooting or head of the workplace or fireworks launcher. ';
5. In Section 61 (1) of the Introductory Part of the provision, the words "In order to protect electricity from the effects of electrostatic energy, the provisions of the Technical Standard (11) must be ensured 'shall be replaced by the words" In order to protect the electrical current from the effects of electrostatic energy, the words "In accordance with the relevant Czech Technical Standard (11) or equivalent technical standard of a Member State of the European Union, a State of the European Free Trade Association which is a Contracting Party to the Agreement on the European Economic Area, or Turkey, provided that they guarantee at least an equivalent level of health and safety protection'.

6. Annexes 1 to 3, including footnote 18, shall be deleted;
This decree shall take effect on the day of its publication.
