DECLARATION
Ministry of Transport and Communications
of 30 June 2000
on the method of proving financial capacity to carry out telecommunications activities
The Ministry of Transport and Communications provides pursuant to § 109 (2) and for the implementation of § 17 (4) of Act No. 151 / 2000 Coll., on Telecommunications and on the amendment of other laws:
Method of proving financial capacity to perform telecommunications activities
(1) The financial capacity to carry out the telecommunications activity for which a telecommunications licence is required shall be demonstrated by the applicant for the issue of a telecommunications licence by the following documents signed by his statutory authority:
(a) an overview of the state of assets broken down by type of asset on the last day of the calendar month preceding the last completed calendar month before the date of application;
(b) evidence of the amount of all available funds, including documents on the status of bank accounts, loans granted on the last day of the calendar month preceding the last completed calendar month before the date of application, bank guarantees and schedule of repayment of the loans granted,
(c) an overview of the working capital situation broken down by short-term debt, stocks and short-term liabilities at the last day of the calendar month preceding the last completed calendar month before the date of application;
(d) a business plan, broken down by year for the first five years of operation of a public telecommunications network or the provision of a public telecommunications service or the interconnection of telecommunications networks to the extent and structure set out in the Annex to this Regulation;
(e) an affidavit stating that the State does not register with the applicant for a telecommunications licence claims on taxes, duties and charges, fines, social security contributions and contributions to national employment policy or general health insurance, and an affidavit stating that no bankruptcy of the applicant's property has been declared, no compensation is allowed or has not entered into liquidation;
(f) the financial statements, i.e. the financial statements The balance sheet of the POD 1 - 01 and the Result statement of the POD 2 - 01 and the statistical accounts of FET 1 - 02 for the previous year and, where applicable, the last financial statements verified by the auditor, including an annex thereto, to the full extent possible, where the applicant for the telecommunications licence has carried out business during the previous annual financial year.
(2) The financial data referred to in the business plan referred to in paragraph 1 (d) shall be presented in Czech currency.
Efficacy
This decree shall take effect on the day of its publication.

The estimated costs for the business entity in total pursuant to paragraphs 2.1 and 2.2 for the public telecommunications network, for interconnection and for public telecommunications services will be further broken down by type of cost, i.e. for production consumption, labour costs, social and health insurance costs, other personnel costs, taxes and charges, depreciation of tangible and intangible assets, other operating costs, cost interest, other financial costs. The expected costs of non-telecommunications activities shall be indicated by one amount.

Entry data used in calculating the financial volumes specified in the business plan
9. The business plan shall include all economic input data and expected non-economic effects, in particular:
9.1. Estimated individual prices excluding VAT (tariffs)
9.2. Estimated interconnection prices
9.3. Estimated number (as of 31.12 each year and increment) of users of services
9.4. Estimated average number of employees
9.5. Estimated traffic volumes, e.g. in minutes, impulses etc.
9.6. Other data necessary to assess the viability of the business plan (e.g. number of interconnection points, assumed inflation index, income tax, average investment costs for setting up 1 main telephone station, estimated number of tariff impulses or minutes per main telephone station, etc.)
9.7. Expected new services, to be broken down in particular following indicators to which they have already been reflected.
