Law on the Lease of Higher Military Degree Titles

on lending degrees of higher military rank.
The National Assembly of the Czechoslovak Republic decided on the following Act:
§ 1.
The title of a military rank higher than that which they actually possess may be given to professional or advance military persons for as long as they are required by the duties or duties which they have been temporarily entrusted with.
§ 2.
Military persons in retirement or in reserve may be given the title of military rank closest to that which they actually possess if:
(a) have served properly and successfully for at least 20 years in Czechoslovak armed forces; or
(b) are participants in the national exemption fight pursuant to the Act of 19 December 1946, No. 255 Coll., on the members of the Czechoslovak army abroad and on certain other participants in the national exemption fight; or
(c) in carrying out military services associated with increased health or life threats, they have suffered, without any fault, an accident or a disorder causing permanent incapacity for military service.
§ 3.
The title of a higher rank referred to in § 1 or 2 shall be given by the authority to which it is for the appointment or promotion of military persons to the rank of the title to be given.
§ 4.
(1) By granting the title of higher military rank, the military ratio of the person concerned remains unchanged. Unless otherwise provided for by the Ministry of National Defence in respect of the purpose of conferring a title of higher military rank, they shall be liable to the person to whom the title of higher military rank has been granted, all rights and obligations which would have been incumbent upon it if it had actually been promoted to the same rank; However, the grant of the title of a higher military rank shall not give rise to the right to adjust service (rest, provision) salaries or to any other secondary regular or occasional formalities.
(2) The grant of the title of a higher military rank shall cease to exist at the end of the period for which it was granted or by the withdrawal of the military rank which the military person concerned actually has.
(3) The provisions of paragraphs 1 and 2 shall also apply to cases where the title of higher rank (honorary degree) has been awarded in accordance with the provisions of the present provisions.
§ 5.
The applicability of the Government Decree of 2 March 1939, No 60 Coll., on the honorary titles of civil servants and other public servants, shall be revoked where it provides for the conferral of honorary degrees to military persons.
§ 6.
This Act shall take effect on the day of its publication; to be carried out by the Minister for National Defence.
