THE LAW
of 7 June 2017
amending Act No. 349 / 1999 Coll., on the Ombudsman, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 349 / 1999 Coll., on the Ombudsman, as amended by Act No. 265 / 2001 Coll., Act No. 309 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 626 / 2004 Coll., Act No. 381 / 2005 Coll., Act No. 342 / 2006 Coll., Act No. 129 / 2008 Coll., Act No. 314 / 2008 Coll., Act No. 198 / 2009 Coll., Act No. 227 / 2009 Coll., Act No. 427 / 2010 Coll., Act No. 303 / 2011 Coll., and Act No. 396 / 2012 Coll., is amended as follows:
1. In Article 1, the following paragraph 7 is inserted after paragraph 6, including footnote 6:
"(7) The guardian monitors the implementation of an international contract governing the rights of persons with disabilities (6).
6) Convention on the Rights of Persons with Disabilities, published under No 10 / 2010 Coll. s. '.
Paragraphs 7 to 9 shall be renumbered paragraphs 8 to 10.
2. The following Section 21c is inserted after Section 21b:
(1) In monitoring the implementation of the international contract governing the rights of persons with disabilities (6), the Ombudsman systematically addresses the issue of the rights of persons with disabilities and, to this end, in particular:
(a) promote the exercise of the rights of persons with disabilities and propose measures aimed at protecting them;
(b) carry out research;
(c) publish reports and make recommendations on issues relating to the exercise of the rights of persons with disabilities; and
(d) exchange available information with relevant foreign and international bodies.
(2) Paragraph 15 and 16 shall apply mutatis mutandis in the performance of the tasks referred to in paragraph 1.
(3) In the event of failure to comply with the obligation to provide synergies resulting from Paragraph 15 or 16, the Ombudsman may inform the public, including the names and surnames of persons authorised to act on behalf of the compulsory authority. ';
3. The following Section 25a is inserted after Section 25:
(1) The guardian shall set up an advisory body for cooperation in monitoring the implementation of an international treaty governing the rights of disabled persons (6).
(2) Persons with disabilities and persons defending their rights and interests are members of the advisory body. The members of the advisory body shall be appointed by the protector after consultation with the organisations of persons with disabilities.
(3) Details of the organisation and tasks of the advisory body are laid down in its Statute issued by the guardian. '
Efficacy
This Law shall enter into force on 1 January 2018.
