of 2 May 2012
amending Act No. 563 / 2004 Coll., on pedagogic workers and amending certain laws, as amended
Parliament has decided on this law of the Czech Republic:
Čl. I
Act No. 563 / 2004 Coll., on pedagogic workers and amending certain laws, as amended by Act No. 383 / 2005 Coll., Act No. 179 / 2006 Coll., Act No. 264 / 2006 Coll., Act No. 189 / 2008 Coll., Act No. 384 / 2008 Coll., Act No. 223 / 2009 Coll., Act No. 227 / 2009 Coll., Act No. 422 / 2009 Coll., Act No. 159 / 2010 Coll. and Act No. 420 / 2011 Coll., is amended as follows:
1. In Paragraph 2 (1), the words "specifically pedagogical 'are replaced by the words" specialpedagogical'.
2. in Paragraph 2 (2), the following point (i) is inserted after point (h):
"(i) prevention methodologies in pedagogic- psychological counselling 20),
20) Paragraph 5 (3) of Decree No. 72 / 2005 Coll., on the provision of advisory services in schools and school institutions, as amended. '
Point (i) shall be renumbered as point (j).
3. In Part One of Title II, the words "AND REQUIREMENTS 'are deleted.
4. Paragraph 6 (1), including footnote 8, reads as follows:
"(1) The teacher of the nursery school is qualified
(a) higher education obtained by studying in an accredited study programme in the field of pedagogical sciences aimed at the preparation of teachers of the parent school;
(b) higher education obtained by study in an accredited study programme in the field of pedagogical sciences aimed at the preparation of teachers of the first degree of primary school or education or free-time pedagogy or the educational field of pedagogy and education in the programme of lifelong learning carried out by the university and the preparation of teachers of the parent school;
(c) higher vocational education obtained by the termination of the accredited higher vocational education programme (1) in the field of education aimed at the preparation of school teachers;
(d) higher vocational education obtained by the termination of an accredited higher education programme in the field of education aimed at the preparation of educators and training in a programme of lifelong learning carried out by a higher education institution and at the preparation of teachers of the parent school;
(e) secondary education with a graduate examination completed by the end of the secondary education programme (1) in the field of education aimed at the preparation of school teachers;
(f) secondary education with a graduate examination obtained by the completion of a secondary education programme in the field of education aimed at the preparation of educationsand the carrying out of individual examinations (8), which corresponds in its content and form to the test of the profile part of the secondary examination from the subject of the pedagogy of the pre-school age; or
(g) the training referred to in paragraph 2 (a) or (b).
8) § 113 of the Education Act. '
5. in Articles 6 (2) (a), 7 (2) (a), 8 (2) (a), 9 (2) (a) and 21 (c), the word "or" shall be deleted;
6. in Article 6 (2), the following point (b) is inserted after point (a):
"(b) higher vocational education obtained by the termination of an accredited higher education programme in the field of education aimed at special pedagogy; or"
Point (b) shall be renumbered (c).
7. In Article 6 (2) (c), the words "pre-school education 'are replaced by the words" kindergarten'.
8. Paragraph 7 (1) reads as follows:
"(1) First-degree primary school teacher gains professional qualifications in higher education obtained by study
(a) in an accredited Master's study programme in the field of pedagogical sciences aimed at preparing first-degree teachers of primary school;
(b) in an accredited Master's study programme in the field of pedagogical sciences aimed at the preparation of teachers of the parent school or of the educational field and education in the programme of lifelong learning carried out by the university and the preparation of teachers of the primary school;
(c) in an accredited Master's study programme in the field of pedagogical sciences aimed at preparing teachers of general secondary school subjects or in preparing teachers of general secondary school subjects and general secondary school subjects; and
1. education in a programme of lifelong learning carried out by a university and aimed at the preparation of first-degree teachers of primary school; or
2. an additional study to extend the professional qualification referred to in Paragraph 22 (2) (hereinafter referred to as "additional study to extend the professional qualification"),
(d) in an accredited Master's study programme in the field of pedagogical sciences aimed at the preparation of teachers of general subjects of secondary school and education in the programme of lifelong learning carried out by a university and the preparation of teachers of the first degree of primary school;
(e) in an accredited Master's study programme in the field of pedagogical sciences aimed at preparing teachers of the primary art school of study, which corresponds to the nature of the subject being taught;
(f) in accordance with Section 12, only for the teaching of a foreign language; or
(g) as referred to in paragraph 2 (a) or (b). ";
9. in Article 7 (2), the following point (b) is inserted after point (a):
"(b) higher education obtained by studying in an accredited Master's study programme in the field of pedagogical sciences, in the field of special pedagogy, in the field of study, and in the programme of lifelong learning carried out by a university and aimed at the preparation of teachers in the first degree of primary school, or"
Point (b) shall be renumbered (c).
10. in Article 7 (2) (c), the word "bachelor" shall be deleted;
11. in Paragraph 8 (1):
"(1) The second degree teacher is awarded a vocational qualification by higher education obtained by study in an accredited Master's degree programme.
(a) in the field of pedagogical sciences, aimed at the preparation of teachers of general subjects of the second degree of primary school;
(b) in the field of pedagogical sciences aimed at the preparation of teachers of general secondary school subjects and general secondary school subjects;
(c) in the field of pedagogical sciences aimed at preparing teachers of general secondary school subjects;
(d) the field of study which corresponds to the nature of the subject being taught; and
1. higher education obtained by study in an accredited Bachelor's degree programme in the field of pedagogical sciences aimed at the preparation of teachers of general subjects of the second degree of primary school or secondary school; or
2. education in a programme of lifelong learning carried out by a university and aimed at the preparation of second-degree teachers of primary or secondary school;
(e) in the field of pedagogical sciences, focusing on special pedagogy for teachers and education in the Lifelong Learning Programme of the College and on the preparation of second-degree teachers of primary or secondary school;
(f) in the field of pedagogical sciences aimed at preparing teachers of the first degree of primary school; and
1. higher education obtained by study in an accredited Bachelor's Study Programme in the field of pedagogical sciences aimed at the preparation of teachers of general subjects of the second degree of primary school,
2. education in a programme of lifelong learning carried out by a university and aimed at the preparation of second-degree teachers of a primary school; or
3. an additional study to extend professional qualifications,
(g) in the field of pedagogical sciences aimed at preparing teachers of the primary arts school of study, which corresponds to the nature of the subject being taught;
(h) focusing on physical education and sport only for the teaching of physical education; or
(i) according to Section 12, only for the teaching of a foreign language. "
12. in Article 8 (2), the following points (b) and (c) are inserted after point (a):
"(b) higher education obtained by study in an accredited Master's degree programme in the field of pedagogical sciences focusing on special pedagogy, a special pedagogical field; and
1. a university degree obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at the preparation of primary or secondary school teachers; or
2. education in a programme of lifelong learning carried out by a university and aimed at the preparation of primary or secondary school teachers,
(c) a university degree obtained by studying in an accredited Master's study programme in the field of pedagogical sciences aimed at the preparation of first-degree teachers of primary school and education in a programme of lifelong learning carried out by a university and aimed at special pedagogy, or '.
Point (b) shall be renumbered (d).
13. the following Sections 8a and 8b are inserted after Section 8, including the headings and footnotes No 16 and 17:
„§ 8a
Primary School Preparation Class Teacher
Primary School Preparation Class Teacher 16) receives professional qualifications in education under § 6 or § 7.
§ 8b
Primary School Training Teacher Special
The teacher of the primary school special17) receives vocational training according to § 7 (2).

14. in Paragraph 9 (1):
"(1) Teachers of general secondary school subjects receive vocational qualifications in higher education obtained by study in an accredited Master's degree programme
(a) in the field of pedagogical sciences, focusing on the preparation of teachers of general secondary school subjects;
(b) in the field of pedagogical sciences aimed at the preparation of teachers of general secondary school subjects and general secondary school subjects;
(c) in the field of study which corresponds to the nature of the general subject, and
1. a university degree obtained by studying in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at the preparation of secondary school teachers or second-degree primary school; or
2. education in a programme of lifelong learning carried out by a university and aimed at the preparation of secondary school teachers or second-degree primary school,
(d) in the field of pedagogical sciences aimed at the preparation of teachers of general subjects of the second degree of primary school; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at the preparation of teachers of general school subjects,
2. education in a programme of lifelong learning carried out by a university and aimed at the preparation of secondary school teachers; or
3. an additional study to extend professional qualifications,
(e) in accordance with Paragraph 8 (1) (a), only for teaching at the lower stage of the multiannual school;
(f) focusing on physical education and sport only for the teaching of physical education; or
(g) according to § 12 only for the teaching of a foreign language. "
15. in Article 9 (2), the following points (b) and (c) are inserted after point (a):
"(b) in the field of pedagogical sciences, aimed at the preparation of teachers of general subjects of the second degree of primary school and general subjects of secondary school of study, which corresponds to the nature of the vocational course taught,
(c) in the field of pedagogical sciences, aimed at the preparation of teachers of general subjects of the secondary school of study, which corresponds to the nature of the vocational subject taught, or '.
Point (b) shall be renumbered (d).
16. in Article 9 (2) (d):
"(d) the field of study which corresponds to the nature of the vocational subject being taught; and
1. higher education obtained by study in an accredited study programme in the field of pedagogical sciences aimed at the preparation of secondary school teachers or second degree primary school;
2. education in a programme of lifelong learning carried out by a university and aimed at the preparation of secondary school teachers or second degree primary school; or
3. study of pedagogy in accordance with § 22 (hereinafter referred to as "study of pedagogy"). "
17. in Paragraph 9 (3):
"(3) The teacher of practical teaching is qualified
(a) higher education obtained by study in an accredited study programme of the field of study corresponding to the nature of practical teaching; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at the preparation of secondary school teachers or second degree primary school;
2. education in a programme of lifelong learning carried out by a university and aimed at the preparation of secondary school teachers or second degree primary school; or
3rd study of pedagogy,
(b) higher vocational education obtained by the termination of an accredited training programme of a higher vocational school in the field of education which corresponds to the nature of practical teaching; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at the preparation of secondary school teachers or second degree primary school;
2. education in a programme of lifelong learning carried out by a university and aimed at the preparation of secondary school teachers or second degree primary school; or
3. study of pedagogy, or
(c) secondary education with a graduate examination completed by the completion of a secondary education programme in the field of education corresponding to the nature of the subject being taught; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at the preparation of secondary school teachers or second degree primary school;
2. education in a programme of lifelong learning carried out by a university and aimed at the preparation of secondary school teachers or second degree primary school; or
3rd study of pedagogy. '
18. in Paragraph 9 (5):
"(5) Teacher of vocational training is qualified
(a) in accordance with paragraph 3; or
(b) secondary education with a certificate obtained by the termination of the secondary education programme in the field of education which corresponds to the nature of the subject being taught; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences aimed at the preparation of secondary school teachers or second degree primary school;
2. education in a programme of lifelong learning carried out by a university and aimed at the preparation of secondary school teachers or second degree primary school; or
3rd study of pedagogy. '
19. Paragraph 9 (6) reads:
"(6) The teacher of vocational training in the health field of education shall receive vocational qualifications in education under paragraphs 3 and 4."
20. In Article 9, the following paragraph 7 is added:
"(7) A secondary school teacher who educates in a classroom or a school set up for pupils with special educational needs shall receive professional qualifications.
(a) education provided for secondary school teachers under paragraphs 1 to 6; and
1. higher education obtained by study in an accredited study programme in the field of pedagogical sciences aimed at special pedagogy; or
2. education in a programme of lifelong learning carried out by a university and aimed at special pedagogy,
(b) study in an accredited Master's study programme in the field of pedagogical sciences aimed at special pedagogy for teachers and education in a Lifelong Learning Programme carried out by a higher education institution aimed at preparing second-degree teachers of primary school or secondary school; or
(c) for teaching at a practical school of one year and a practical school of two years by studying in an accredited Master's study programme in the field of pedagogical sciences aimed at special teaching for teachers. "
21. Paragraph 10, including the title and footnote 7, reads as follows:
„§ 10
Teacher of art specialized subjects in primary art school, secondary school and conservatory
(1) The teacher of artistic subjects at primary art school, secondary school and conservatory is awarded professional qualifications
(a) higher education obtained by study in an accredited study programme of the field of study corresponding to the nature of the subject of art taught; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences;
2. education in a programme of lifelong learning carried out by a university and aimed at pedagogy; or
3rd study of pedagogy,
(b) a university degree obtained by studying in an accredited Master's degree programme in the field of pedagogical sciences aimed at preparing teachers of primary art school only for teaching at primary art school;
(c) higher education obtained by studying in an accredited Master's study programme in the field of pedagogical sciences aimed at the preparation of teachers in general education subjects in the field of musical instrument play or solo singing only for the teaching of such subjects at primary art school;
(d) higher education obtained by study in an accredited Master's study programme in the field of pedagogical sciences aimed at the preparation of teachers in general education subjects in the field of art education only for the teaching of the art field in primary art school,
(e) higher vocational education obtained by the completion of an eight-year or six-year training programme in the field of conservator1), which corresponds to the character of the subject of art taught;
(f) higher vocational education obtained by the termination of an accredited training programme of a higher vocational school in the field of education which corresponds to the nature of the subject of art taught; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences;
2. education in a programme of lifelong learning carried out by a university and aimed at pedagogy; or
3rd study of pedagogy,
(g) secondary education with a graduate examination obtained by the completion of the corresponding part of the conservatory training programme; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences;
2. education in a programme of lifelong learning carried out by a university and aimed at pedagogy; or
3. study of pedagogy, or
(h) secondary education with a graduate examination obtained by the termination of the secondary education programme in the field of education which corresponds to the character of the subject of art taught; and
1. higher education obtained by study in an accredited Bachelor's study programme in the field of pedagogical sciences;
2. education in a programme of lifelong learning carried out by a university and aimed at pedagogy; or
3rd degree in teaching.
(2) The director of the primary art school, secondary school and conservatory may, where justified, decide to waive the presumption of professional qualifications of a teacher of an artistic subject who carries on an artistic teaching activity if he or she is or has been an performer). The decision shall be given in writing. This decision shall, for employment purposes, be deemed to be satisfied by the presumption of professional qualifications of the teacher at the school concerned.
7) Act No. 121 / 2000 Coll., on copyright law, on copyright law and on the amendment of certain laws (copyright law), as amended. '
22. in Article 11 (1), the words "general education" shall be replaced by "general education" and the words "general education" shall be replaced by "general education."
23. in Article 11 (2) (c), the words "and practice in the field of at least 3 years' shall be deleted;
24. Sections 12 and 13, including the headings, read:
„§ 12
Language School Teacher with State Language Examination Law
Teacher of a language school with the right of state language examination gets professional qualifications in higher education obtained by study
(a) in an accredited Master's study programme in the field of teaching science aimed at preparing teachers of the relevant foreign languages;
(b) an accredited study programme in the field of pedagogical sciences other than those referred to in (a), by conducting a language examination of the relevant foreign language corresponding to at least level C1 of the Common European Framework of Reference for Languages and by complementary didactic study of the language concerned;
(c) in an accredited master's study programme in the field of social sciences aimed at relevant foreign languages; and
1. higher education obtained by study in an accredited study programme in the field of teaching science aimed at teacher preparation;
2. education in a programme of lifelong learning carried out by a university and aimed at teacher training; or
3. study of pedagogy, or
(d) an accredited master's programme other than those referred to in (a), (b) and (c); and
1. higher education obtained by study in an accredited study programme in the field of teaching science aimed at teacher preparation; or
2. training in a programme of lifelong learning carried out by a university and aimed at teacher training, and carrying out a language examination of the relevant foreign language corresponding to at least level C1 of the Common European Framework of Reference for Languages and additional didactic studies of the language concerned.
§ 13
Pedagog in the establishment for the further education of teaching staff
The pedagogist in the establishment for the further education of teaching staff shall acquire the professional qualifications of higher education obtained by study in an accredited Master's study programme which corresponds to the nature of the educational subject and to the teaching or training experience in the field which corresponds to the character of educational subjects of at least 4 years. '

„§ 16
Farmer
(1) The breeder receives professional qualifications
(a) higher education obtained by study in an accredited study programme in the field of pedagogical sciences;
(b) higher education under Sections 7 to 10, 12 and 14;
(c) higher education obtained by the termination of an accredited study programme other than those referred to in (a) and (b); and
1. education in a lifelong learning programme in the field of pedagogical sciences carried out by a university; or
