DECLARATION
of 27 June 2011
amending Decree No. 356 / 2008 Coll., implementing Act No. 91 / 1996 Coll., on Feed, as amended
The Ministry of Agriculture provides, pursuant to Article 3 (7) of Act No. 91 / 1996 Coll., on Feed, as amended by Act No. 33 / 2011 Coll., ("the Act '):
Decree No. 356 / 2008 Coll., implementing Act No. 91 / 1996 Coll., on Feed, as amended, as amended, as amended by Decree No. 178 / 2009 Coll., Decree No. 169 / 2010 Coll. and Decree No. 336 / 2010 Coll., is amended as follows:
1. footnote 1 shall read:
"(1) Commission Directive 82 / 475 / EEC of 23 June 1982 determining the groups of feed materials which may be used to designate compound feedingstuffs for domestic animals, as amended. Directive 2002 / 32 / EC of the European Parliament and of the Council of 7 May 2002 on undesirable substances in animal feed, as amended. Commission Directive 2008 / 38 / EC of 5 March 2008 establishing a list of intended uses of feed for particular nutritional purposes. Commission Directive 2008 / 76 / EC of 25 July 2008 amending Annex I to Directive 2002 / 32 / EC of the European Parliament and of the Council on undesirable substances in animal feed. Commission Directive 2008 / 82 / EC of 30 July 2008 amending Directive 2008 / 38 / EC as regards feed intended to support renal function in the case of chronic renal insufficiency. Commission Directive 2009 / 8 / EC of 10 February 2009 amending Annex I to Directive 2002 / 32 / EC of the European Parliament and of the Council as regards maximum levels for unavoidable cross-contamination of non-target feed with coccidiostats or histomonostats. Commission Directive 2009 / 141 / EC of 23 November 2009 amending Annex I to Directive 2002 / 32 / EC of the European Parliament and of the Council as regards maximum levels for arsenic, theobromine, Datura sp., Ricinus communis L., Croton tiglium L. and Abrus precatorius L. Commission Directive 2010 / 6 / EU of 9 February 2010 amending Annex I to Directive 2002 / 32 / EC of the European Parliament and of the Council as regards mercury, free gossypol, nitants and Mowrah, Bassia, Madhuka. '
2. Article 2 shall be deleted;
3. Article 3, including footnote 2, shall be deleted;
4. In the reference under section 4, "paragraph 9 (b) and (c) 'is replaced by" paragraph 7 (a) and (b)'.
5. In the reference under section 5, "paragraph 9 (e) 'is replaced by" paragraph 7 (c)'.
6. In Part Three, Title I, including the title and footnotes 3 and 4, is deleted.
7. Sections 11 and 12 are deleted.
8. In the reference under section 13, "paragraph 9 (h) 'is replaced by" paragraph 7 (d)'.
9. In the reference under section 14, "paragraph 9 (i) 'is replaced by" paragraph 7 (e)'.
10. Sections 15 and 16 are deleted.
11. Article 17 to 19 shall be deleted, including the title and footnote 6 to 12.
12. Paragraph 20, including the title, reads:
Feed for non-food producing animals
The list of categories of feed materials which may be indicated instead of individual feed materials in the labelling of feed for non-food-producing animals, with the exception of fur animals, is set out in Annex No 4, Part E. '.
13. Paragraph 21, including the title and footnote 5b, reads as follows:
Labelling of feedingstuffs intended for particular nutritional purposes
The labelling requirements for feed intended for particular nutritional purposes are laid down directly by the European Union5b Regulation. Further mandatory indications on the labelling, including the declaration and use, are given in Annex 10 to this decree.
5b) Regulation (EC) No 767 / 2009 of the European Parliament and of the Council of 13 July 2009 on the placing on the market and use of feed and amending Regulation (EC) No 1831 / 2003 and repealing Council Directive 79 / 373 / EEC, Commission Directive 80 / 511 / EEC, Council Directives 82 / 471 / EEC, 83 / 228 / EEC, 93 / 74 / EEC, 93 / 113 / EC and 96 / 25 / EC and Commission Decision 2004 / 217 / EC. ';
14. In Paragraph 24 (1), the introductory part of the provision reads: "Homogeneity is a property which expresses the uniform dispersion of individual components in the premixture or feed in general. The operator of the institute shall demonstrate the effectiveness of the agitator in terms of homogeneity by means of the document it contains'.
15. in Article 25 (b), (c) and (d), the words "certain protein feed" and "and processing of certain protein feed" shall be deleted;
16. in Article 28 (4), the words "certain protein feedingstuffs" shall be deleted;
17. in Paragraph 28, paragraph 5 is deleted;
18. In Article 30 (1), the words "certain protein feedingstuffs' are deleted.
19. Annex No 1 is deleted.
20. In Annex 4, Parts A to D are deleted. in Part E, the words "domestic animals' are replaced by the words" non-food animals, except fur animals';
21. Annexes 5 to 8 are deleted.
22. In Annex No 11, Part B, Preservatives, the entry "E 490 Propan- 1,2diol 'is deleted.
23. In Annex No 11, Part B, Emulsifiers, stabilisers, thickening and gelling agents, the entries "E 440 Pektin '," E 470 Na-, K- or Ca- salts of edible fatty acids alone or in mixtures derived from edible fats or distilled edible fatty acids', "E 471 Mono- and diglycerides of fatty acids'," E 472 Mono- and diglycerides of edible fatty acids esterified with acetic acid, wine, lemon, milk or mono- and diacetyltaric acid 'and "E 490 Propan- 1,2-diol' are deleted.
24. In Annex 11, Part B, Binders, anti-caking agents and coagulants, the entries "E 470 Sodium, Potassium and Calcium Stearties' and" E 516 Calcium sulphate dihydrate 'are deleted.
25. In Annex No 11, Part B, Acid Regulators, the entries "E 170 Calcium carbonate '," E 339 (i) Nadihydrogen orthophosphate', "E 339 (ii) Nahydrogenorthophosphate '," E 339 (iii) Calcium orthophosphate', "E 341 (i) Catetrahydrogen orthophosphate '," E 341 (ii) Cahydrogen orthophosphate', "E 450a (iii) Nadiphosphate '," E 450b (i) Na-triphosphate', "E 500 (i) Sodium carbonate '," E 500 (ii) Hydrogencarbonate sodium' and "E 540 calcium diphosphate 'are deleted.
26. In Annex No 11, Part B, Vitamins, Provitamins and chemically defined substances having similar effects, the entry "Vitamin E as vitamin E preparations' is deleted.
27. In Annex 11, Part C is deleted.
28. Annex No 16 is deleted.
Efficacy
This decree shall take effect on the day of its publication.
