DECLARATION
Ministry of Transport and Communications
of 30 June 2000
on the details of the proposal for the conclusion of a network interconnection and access contract and on the technical and operational conditions for network access and interconnection of networks and the connection of private telecommunications networks to public telecommunications networks
According to § 109 (2) of Act No. 151 / 2000 Coll., on Telecommunications and on the amendment of other laws (hereinafter referred to as "the Act"), the Ministry of Transport and Communications provides for the implementation of § 38 (7) and § 41 of the Act:
For the purposes of the decree:
(a) access to the network - connection of telecommunications equipment of the telecommunications service provider to a public telephone network or leased telecommunications circuits under contract with a public telephone network operator or with a telecommunications circuit hire service provider (1) at the network interface or circuit in a way that allows the provision of such services to subscribers who are in a contractual relationship with the telecommunications service provider, as well as to subscribers and users of public telephone network services, or other networks connected to the network of the public telephone network operator,
(b) essential requirements - ensuring network operability and maintaining network integrity even in crisis situations, interconnectivity of services and the protection of traffic data and network users.
Forms of the proposal to conclude a network access contract
The applicant's proposal to conclude a network access contract (2) shall contain:
(a) where the applicant is a natural person: name and surname, residence of the applicant, birth number or date of birth, place of business and certified copy of the applicant's business authorisation;
where the applicant is a legal person: business name, registered office, identification number and certified extract from the commercial register;
(b) a copy of the licence or registration certificate provided for in Article 51 of the Act;
(c) a description of the services provided,
(d) type and number of access points, (3) estimate of their need for up to 1 year, where appropriate;
(e) the type designation of the connected telecommunications equipment and its interfaces and the verification, approval or recognition of its technical capability;
(f) point of connection;
(g) the date of the requested access and the date of commencement of the service.
Forms of the proposal to conclude a interconnection agreement
The proposal of the applicant for the conclusion of the interconnection contract (2) shall contain:
(a) the commercial name of the applicant, the registered office, the legal person's identification number, a copy of the licence and a certified extract from the commercial register;
(b) design of technical solutions for interconnection:
1. location of interconnection points (3) (precise addresses, or simple situation sketch according to the cadastral map),
2. interconnection capacity for individual points in the number of circuits or interfaces under the Specific Legislation (3) for commencing operations, their expected number in the next period up to 1 year and a 3-year outlook;
3. the type of telecommunications equipment used and its interface data and the verification of the technical capability of the interface, as well as the interconnection of services with the network with which interconnection is proposed;
4. the proposed type of interface used (reference to technical specifications of the interface, signal or synchronisation where applicable),
5. Numbering (decision to allocate the number capacity),
6. the structure of the network and the means of transmission used to the extent necessary for the conclusion of the interconnection contract, the way in which the network is synchronised,
7. Proposal for a method of supervision and management of interconnected networks;
(c) an estimate of the volume of the operational load for the first interconnection with a view to 1 year and 3 years, broken down into the operation in the telephone circuit (local), between the telephone circuits (interurban) and the international, additional operator services, emergency calls, etc., according to the type of service required, at the main operating hour, indicating the expected degree of concentration of the service load to the main operating hour or, where appropriate, in other ways than telephone service,
(d) specifications and scope of required services:
1. services provided in cooperation between the Contracting Parties (including service parameters),
2. technical and surveillance services for network operation provided in cooperation between both Contracting Parties, design of operational and control measurements at interconnection point,
3. services provided to users;
4. ancillary services,
(e) draft project dates:
1. the date of acceptance and operation tests;
2. the start date of the service,
3. start date,
(f) a proposal for a method of measuring traffic between interconnected networks:
1. measurement of operating losses, quality and reliability of service;
2. measurement of the underlying operation for billing;
(g) a proposal for a method of clearing traffic, a proposal for interconnection prices for the applicant's network,
(h) a proposal for the provision of data, user protection and a proposal for the protection of the business secrets of the Contracting Parties pursuant to a special legislation.
Technical and operational conditions for network access
(1) The network access contract must contain, in addition to the formalities laid down in the specific legislation, (4)
(a) the types of services and their description and, where appropriate, a reference to their technical specifications;
(b) indicators of service quality and methodology for its verification;
(c) time limits for the establishment of services;
(d) time limits for correction of failures;
(e) the method of payment for non-compliance with points (b) to (d) by the operator;
(f) the method of billing and payment of services.
(2) Where a network access applicant is authorised to provide services paid in a non-usual way, such as subscriptions, cash accounts, return calls and so on, access to an agreement on the payment of such services between a network operator and a service provider in relation to network operators and service providers connected to the network operator's network is a condition.
(3) If the applicant's terminal equipment is ready to be connected, the network operator shall make the connection within the time limit specified in the contract or without delay after having received the decision of the Czech Telecommunications Office (hereinafter referred to as the Office). 5)
Technical and operational conditions for interconnection
(4) In addition to the formalities laid down in the specific legislation, the interconnection agreement must contain:
(a) a description of the interconnected services to be provided in cooperation;
(b) references to the technical regulations, specifications, standards and measures issued by the Office under which the interconnection will be carried out;
(c) indicators of quality and reliability of services and their verification methodology;
(d) the agreement on the allocation and compliance with the parameters established by the network plans;
(e) the location of interconnection points, where appropriate, the sharing of facilities and buildings and its conditions;
(f) making interconnection points available for maintenance, measurement and repair;
(g) access to other services provided to users;
(h) ensuring the selection of the public telecommunications network operator;
(i) tests for the interconnectivity of services;
(j) traffic routing data;
(k) measuring the operation for billing;
(l) prices for interconnection, for the establishment, extension and cancellation of interconnection, the method of accounting and payment including interest on late payments and contractual penalties;
(m) measures to meet essential requirements to ensure continuity of service and operation, including crisis situations;
(n) definitions and limits of liability, compensation, compensation for non-compliance with service quality and reliability indicators;
(o) the means of resolving disputes between the parties, the consequences of breach of contract, the termination of contract,
(p) ways of dealing with changes in interconnection and cancellation or extension of services;
(q) management and supervision of operations and networks, training of operators, conditions of controlled access and authentication in the exchange of data and data shared by databases for operator services,
(r) control of service interconnection, method of measuring agreed parameters;
(s) intellectual property rights, the protection of confidential information and business secrets;
(t) the definition of confidential and unpublished parts of the contract;
(t) the duration of the contract and the way in which changes to the contract or the new contract are discussed.
Technical and operational conditions for the connection of private telecommunications networks to the public telecommunications network
(1) A public telecommunications network operator may connect a non-public telecommunications network to a public telecommunications network to ensure that participants in a non-public network access to, or through, public telecommunications network services.
(2) The technical and operational condition of the connection of a non-public telecommunications network is the measures of the operator of that network which effectively prevent the provision of access by users of a public telecommunications network to the services of another or the same public telecommunications network through a non-public telecommunications network.
(3) The connection of the non-public network is subject to the conclusion of a contract between the public and non-public telecommunications network operator.
(4) The terms of connection are subject to the provisions of Sections 2 and 4 of the Order.
Special network access
(1) The network operator (1) shall comply with the network access requirements at points other than the defined interface, where such access is technically possible.
(2) A proposal to conclude a specific network access contract may be rejected by the network operator only if such a requirement does not comply with the access options or if technical and operational conditions for its implementation are not established. The network operator must notify the Authority of the rejection of the proposal under Paragraph 40 (1) of the Act.
(3) Special access to the network is subject to the provisions of Sections 2 and 4 of the Decree.
Efficacy
This decree shall take effect on the day of its publication.
