about ID cards.
The National Assembly of the Czechoslovak Republic decided on the following Act:
§ 1.
The concept of ID.
A citizen's card under this law is a public document which generally certifies the identity of the person to whom the card relates, following other relevant legal facts concerning that person.
§ 2.
Who's entitled to a citizen's card.
(1) Entitlement to issue a card shall, if the 15th year of age:
(a) citizens of the Czechoslovak Republic and persons deemed to be under the applicable rules;
(b) temporarily also persons who are resident in the Czechoslovak Republic and who have not been found to be foreign nationals or stateless persons.
(2) The entitlement of the persons referred to in paragraph 1 (b) to issue a identity card shall cease on the date laid down in the Regulation by the Minister for the Interior.
(3) Only one identity card may be issued to the same person.
§ 3.
Contents of ID.
(1) The ID has two sections.
(2) The first section of the identity card shall contain all the essential facts needed to establish the identity of the person who testifies.
(3) The second section of the ID card may include a certificate of Czechoslovak citizenship of the person who testifies to it, a certificate of the essential facts of its personal status and the personal condition of children under the age of 15 years and of the spouse, as well as a certificate of other significant legal facts, if the Ministry of the Interior so determines in an agreement with the participating ministries as referred to in the following paragraph.
(4) The official model of the identity card and the details of its issue as well as the applications for its issue shall be determined by the Ministry of the Interior by means of a decree in the Official Gazette, which it shall issue as regards the second section of the identity card, in agreement with the participating ministries. Civil ID forms are strictly negotiable.
§ 4.
Power of proof.
(1) A certificate of identity in the first section of the ID card may attest to the identity of the person to whom the card relates before all the authorities, public authorities and courts.
(2) The Certificate of Czechoslovak Citizenship in the second section of the Civil Card replaces the Certificate of Citizenship of the Czechoslovak Republic according to the applicable regulations.
(3) The other certificates in the second section of the identity card replace the relevant authentic documents to the extent indicated on the card.
§ 5.
Period of validity.
(1) The ID is issued for a period of 10 years. If issued for a shorter period, it may be extended for up to 10 years.
(2) Before the expiry of the period of validity, a new identity card may be issued only in cases provided for by the Ministry of Interior Decree pursuant to § 3, paragraph 4.
§ 6.
Who issues ID?
(1) Civil ID is issued by the District National Committee. The District National Committee may authorise the local national committees of its district to issue on its behalf civil ID cards. This authorisation shall be declared in the municipality in the usual manner.
(2) If the district national committee itself issues the identity card, the application for the issue of the identity card may also be submitted to the local national committee.
(3) The local authority shall be the national committee in whose territory the tenderer is resident or, if he is not resident in the country in whose territory he is resident.
(4) The entries in the second section of the ID shall be made by the national committee responsible for issuing the identity card, either on the basis of the authentic instrument required to certify the relevant legal fact or, if the applicant does not have such document at hand, on the basis of an investigation carried out ex officio. The entries in this section may also be made by the Office or by an authority which is competent in substance and locally to certify the relevant legal fact. The entries in the second section may also be made after the issue of the identity card. The entries in this Section shall be made on request or ex officio.
§ 7.
Changes and repairs.
(1) Any change in the legal facts established on the identity card is notified within 8 days to the local national committee responsible for the place of residence (residence); The card is attached to the notification. This obligation shall be waived if the Office or the authority referred to in paragraph 3 changes the relevant fact in the identity card before the expiry of the period laid down in the first sentence.
(2) The Local National Committee makes amendments, additions and corrections to the registration of family status, occupation and residence. If he was authorised to issue citizens' passes pursuant to § 6 (1), second sentence, he shall also make other amendments, additions and corrections. Otherwise, other than in the sentence of the first subparagraph, it shall make the changes, additions and corrections to the Regional National Committee competent by residence (residence).
(3) Amendments, additions and corrections to the entries in the second section of the ID may also be carried out by the Office or by an authority which is competent in substance and locally to certify the relevant legal fact.
§ 8.
Invalid ID cards.
(1) A citizen's card is invalid if the person who has been issued has not, from the outset, been entitled to issue it (Paragraph 2) or if that entitlement has expired at a later date, or if the period of validity of the licence has expired, or if the card is not complete, identifiable or legible in the first section.
(2) An invalid identity card must be immediately surrendered to the district or local national committee responsible for the place of residence (residence).
(3) Any district national committee shall withdraw an invalid identity card. Any local national committee and authority of the National Security College may also withdraw an invalid identity card, but it shall, without delay, inform the superior national committee which shall decide whether or not the licence has been withdrawn.
§ 9.
Charging and batch relief.
(1) Civil ID cards are issued for replacement of purchase costs.
(2) Submissions under this Act and their annexes shall be exempt from fees.
(3) The ID and the additional registration are not subject to fees. The issue of a card shall be subject to the payment of an official fee in administrative (municipal official fee) cases, to the extent provided for by the rules on such benefits (charges), provided that, at the time of issue of the card, the entries in the second section have also been made in the form of an official inquiry; the dose (fee) is collected even if the new identity card is issued as a replacement for the lost or damaged card, even if it does not contain the entries in the second section.
§ 10.
The obligation to have an ID.
(1) In the customs border zone, any person entitled to the issue of an identity card (§ 2) must have an identity card, even if it is only temporarily present in that zone, and be shown at any time at an official invitation. The list of persons entitled to submit a card in that zone shall be determined by the Ministry of the Interior by a decree in the Official Journal. In the same way, relief from the provisions of the first sentence may be granted.
(2) The Ministry of the Interior may provide for a decree in the Official Gazette in which other parts of the national territory and, in the case of which special conditions, the identity card of the person entitled to issue it must be issued and be shown at any time at an official invitation.
(3) In the same way, the Ministry of the Interior may at last state that all persons or certain groups of persons listed are required to obtain an identity card within the prescribed time limit and to prove themselves at any time at an official invitation.
§ 11.
Civil ID and other ID cards up to now.
(1) General Civil Immunity, issued pursuant to the Government Decree of 8 August 1919, No 481 Coll., introducing universal Civil Immunity, shall cease to be valid on the date laid down by the Ministry of Interior by the Order in the Official Journal.
(2) Prior to the expiry of this period, the holder of a universal civil ID may at any time obtain an identity card under this Act, which shall be issued to him for fulfilling the legal requirements, in which he is obliged to return the universal civil ID.
(3) Personal cards intended for a general identity certificate and issued under other provisions or without legal basis to persons entitled to issue an identity card (§ 2) may no longer be used from the date laid down by the Ministry of the Interior in the Official Journal.
§ 12.
Criminal provisions.
Who
1. make false or incomplete details of his or her person, or other facts necessary for the issue, modification, addition or repair of the identity card, or use them to lure the issue, modification, addition or repair of the identity card;
2. fails to fulfil any of the obligations under § 7, § 1 or § 8, § 2,
3. use a card issued to another person,
4. Leads another to use his identity card,
5. has more than one identity card,
6. he intentionally destroys his or her identity card,
7. infringes the obligation laid down in § 10, paragraph 1 or the regulation issued pursuant to § 10, paragraph 2 and paragraph 3; or
8. Infringes any other provision issued under this Act;
he will be punished - unless it is a more severe criminal act - by the District National Committee by a fine of up to 25,000 CZK or by prison (lockdown) within 3 months. If a fine has been imposed, a replacement prison sentence shall be imposed at the same time in the event of its imperfections, depending on the rate of guilt within 3 months.
§ 13.
Repeal of existing regulations.
Government Decree No. 481 / 1919 Coll. and the provisions issued for its implementation are repealed.
§ 14.
Cooperate with public authorities.
All public authorities, authorities and courts shall be obliged to cooperate in the implementation of this law and the provisions laid down therein.
§ 15.
Efficiency and execution.
(1) This Act shall take effect on 1 October 1948, with the exception of the provisions of Paragraph 10 (1), which shall take effect on 1 January 1949.
(2) This law will be implemented by the Minister of the Interior in agreement with participating members of the Government.
