amending Act No. 563 / 2004 Coll., on pedagogic workers and amending certain laws, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 563 / 2004 Coll., on pedagogic workers and amending certain laws, as amended by Act No. 383 / 2005 Coll., Act No. 179 / 2006 Coll., Act No. 264 / 2006 Coll., Act No. 189 / 2008 Coll., Act No. 384 / 2008 Coll., Act No. 223 / 2009 Coll., Act No. 227 / 2009 Coll., Act No. 422 / 2009 Coll., Act No. 159 / 2010 Coll., Act No. 420 / 2011 Coll., Act No. 198 / 2012 Coll., and Act No. 333 / 2012 Coll., is amended as follows:
1. In Article 6 (1) (b), the words "in the field of pedagogical sciences aimed at the preparation of primary school teachers or education or free-time pedagogy or study field of pedagogy 'are replaced by the words" pedagogical field of study or, where appropriate, in an accredited study programme in the field of pedagogical studies aimed at the preparation of first-degree teachers of primary school, education or teaching of leisure,'.
2. In Article 7 (1) (b), the words "in the field of pedagogical sciences aimed at the preparation of teachers of a parent school or of a teaching profession 'are replaced by the words" in the field of pedagogical studies or, where appropriate, in an accredited study programme in the field of pedagogical sciences aimed at the preparation of teachers of a parent school, education or leisure education'.
3. In Article 8, the following paragraph 3 is added:
"(3) A staff member who is an executive artist (7), an artistic artist or who has a professional qualification as referred to in Article 10 (1) or (21) may accept in writing the presumption of professional qualifications as a teacher of an object of the second grade of a primary school corresponding to the artistic focus or professional qualification of the staff member as having been met, provided that the weekly working hours of that staff member for a legal person engaged in the school do not exceed half of the prescribed weekly working hours and that staff member, outside of the employment relationship with the legal person engaged in the school, carries out artistic performances, creates works of art or carries out an activity for which he fulfils the professional qualifications referred to in Article 10 (1) or Article 21. Recognition of the fulfilment of the professional qualification requirement shall be valid for the purposes of this Act for the period during which the staff member fulfils the conditions laid down in the first sentence. ';
4. In Article 9, the following paragraph 8 is added:
"(8) A staff member who is an executive performer (7), an artistic artist, a recognised professional in the field, or who has a professional qualification as referred to in Paragraph 21, may accept in writing the presumption of professional qualifications as a teacher of a secondary school subject corresponding to the artistic or professional focus or professional qualification of the staff member as having been met if his / her weekly working hours of a legal person engaged in the activity of the school do not exceed half of the prescribed weekly working hours and if he / she, outside of the legal relationship with the legal person performing the activity of the school, creates works of art, carries out an activity in the field in which he / she / she / she is a recognised as a professional or an activity for which he / she / she meets the professional under Paragraph 21. Recognition of the fulfilment of the professional qualification requirement shall be valid for the purposes of this Act for the period during which the staff member fulfils the conditions laid down in the first sentence. ';
5. Paragraph 10 (2) reads as follows:
"(2) For those who are or have been an performer) or an artist, the principal of the primary art school, secondary school or conservatory may, in justified cases, recognise in writing the presumption of professional qualifications of the teacher of the subject corresponding to the artistic orientation of the staff member for the purposes of this Act at that school as having been fulfilled. '.
6. Paragraph 11 (4) reads as follows:
"(4) For those who are, or have been, performers7) or art artists, the Director of the Higher Vocational School may, where justified, recognise in writing the presumption of professional qualifications as a teacher of the subject corresponding to the artistic orientation of the staff member for the purposes of this Act at the school in question. '
7. In Article 11, the following paragraph 5 is added:
"(5) A staff member who is a recognised expert in the field or who has a professional qualification as referred to in Article 21 may accept in writing the presumption of professional qualifications as a teacher of a higher vocational course corresponding to the professional course or professional qualification of the staff member, if that staff member's weekly working hours for a legal person carrying out a school activity do not exceed half the prescribed weekly working time and if he or she, outside of the employment relationship, carries out an activity in the field in which he or she is a recognised expert, or an activity for which he or she has a professional qualification under Section 21. Recognition of the fulfilment of the professional qualification requirement shall be valid for the purposes of this Act for the period during which the staff member fulfils the conditions laid down in the first sentence. ';
8. In Article 17, the following paragraph 3 is added:
"(3) A staff member who is an executive artist (7), an artistic artist or who has a professional qualification as referred to in Article 10 (1) or (21) may recognise in writing the presumption of professional qualifications of a leisure teacher for the activities of interest education corresponding to the artistic focus or professional qualification of the staff member as having been met if the weekly working hours of that staff member for a legal person engaged in the activities of the school do not exceed half the prescribed weekly working hours and if that staff member, outside of the employment relationship with the legal person carrying out the activities of the school, produces works of art or carries out an activity for which he fulfils the professional qualifications referred to in Article 10 (1 or 21. Recognition of the fulfilment of the professional qualification requirement shall be valid for the purposes of this Act for the period during which the staff member fulfils the conditions laid down in the first sentence. ';
9. In Section 22 of the heading "acquisition of professional qualifications', the words" professional qualifications' are replaced by the words "professional qualifications'.
10. In Paragraph 22, the following paragraph 5 is inserted after paragraph 4:
"(5) A pedagogical worker for whom the foreign language is a native language or who controls it at the level of the native language, fulfils, for the purposes of this law, the presumption of professional qualifications for teaching conversation in that foreign language if he has received at least a secondary education with a graduate examination or for teaching that foreign language if he has received a higher education."
Paragraph 5 shall become paragraph 6.
11. In Paragraph 22, the sentence "The first sentence may not be applied to a pedagogical worker who is qualified only for the subject or activity referred to in paragraph 5 or § 8 (3), § 9 (8), § 10 (2), § 11 (4) and (5) and § 17 (3) shall be added at the end of paragraph 6."
12. In Section 22, the following paragraph 7 is added:
"(7) The legal person carrying out the activities of a school or educational establishment may provide education and training for the necessary period and to the extent necessary by a pedagogical worker who does not meet the requirement of professional qualifications, provided that he is demonstrably unable to provide such activities by a teaching staff with professional qualifications. This is without prejudice to the responsibility of the school or educational director for the professional and pedagogical level of education and education services under the special legislation21).

13. In Paragraph 32, at the end of paragraph 1, the dot is replaced by "or 'and the following point (d) is added:
"(d) if, on 1 January 2015, it has reached at least 55 years of age and has been engaged in direct teaching activities on the school type concerned for at least 20 years."
14. § 32a is deleted.
Transitional provision
Section 32a of Act No. 563 / 2004 Coll., as effective until the date of entry into force of this Act, shall apply to the head of the school or school establishment which was appointed to the post of chief of staff before the date of entry into force of this Act.
Efficacy
This Act shall take effect on 1 January 2015.
