Decree of the Ministry of Industry and Trade on emergency situations in the gas industry and on the control of the gas system

DECLARATION
Ministry of Industry and Trade
of 14 August 1995
on states of emergency in the gas industry and the dispatching management of the gas system
The Ministry of Industry and Trade pursuant to § 45 (6), having regard to § 12 (2) and (7) and § 13 (7) of Act No 222 / 1994 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on State Energy Inspection ("the Act '), provides:
§ 1
Subject matter
This decree regulates the procedure for the creation and removal of the consequences of emergency situations for the gas industry (hereinafter referred to as "emergency situations') and sets out the scope and manner of limiting the consumption of gas in emergency states and the rules of dispatching management (hereinafter referred to as the" Dispatching Regulations') of the gas system.
§ 2
Breakdown of emergencies
(1) The state of emergency, according to the cause of its occurrence, is subdivided into foreseeable and unpredictable states.
(2) Predictable situations are emergencies where the cause of creation is known in advance and cannot be removed by the commonly available means of the holder of the state authorisation.
(3) Unforeseeable situations are those which arise from disturbances or accidents on gas production or distribution facilities and which cannot be predicted.
§ 3
Consequences of emergencies
(1) As a result of emergencies, the limitation of gas consumption is as follows:
(a) limiting the sampling stages; the limiting demand level represents a certain percentage by which the supply of gas to customers in the category of wholesale gas collector for production purposes is reduced,
(b) emergency sampling steps which constitute a stop to supply gas to customers of all categories;
(c) limiting heating curves; the limiting heating curve refers to gas customers for heating purposes and represents a reduction in gas consumption to a level that allows heating of objects to a minimum temperature set by the recommended technical standard.
(2) The limiting sampling steps are derived from basic sampling step 3, according to which the gas supply is made in full of the agreed sample diagram.
(3) The limiting levels are:
(a) sample level 5 which reduces gas supply to customers of the category wholesale below the values given in the sample diagram;
(b) sample step 7, which reduces the supply of gas to customers of the category wholesale below the levels set by sample step 5 but above the safety and technological minimum,
(c) sample level 8, which reduces gas supply to customers of the category of medium-sized customer and wholesale customer to a minimum of safety and technology, i.e. the value necessary to ensure the safety of equipment and operators and to avoid damage;
(d) sampling stages 4 and 6 which reduce the gas supply below the values given in the sampling diagram but above the safety and technological minimum and are negotiated exceptionally for certain customers.
(4) The emergency sampling step is stage 10, the gas supply of which is interrupted to customers of all categories.
(5) The limiting heating curves are derived from the 1st heating curve, according to which the supply of gas for heating of objects is ensured without restriction, i.e. within the agreed amount of gas collected.
(6) The limiting rotation curves are:
(a) 2. a heating curve where the heating gas consumption is reduced only for certain groups of customers;
(b) (3) a heating-gas recovery curve which reduces the consumption of heating gas to all groups of customers other than household category customers to the level of safety and technological minimum temperature in heated areas.
(7) The announcement of restrictive sampling stages and heating curves in an emergency by the Central Gas Dispatch is carried out via the Czech Radio or other mass media.
(8) The announcement of an emergency emergency emergency demand stage by the Central Gas Dispatch is carried out via the Czech Radio and, where appropriate, other mass media, and is also communicated to the municipalities and authorities of the Czech Police Department mentioned in the emergency plan.
§ 4
Removal of emergencies
(1) When removing the consequences of emergency situations, the holders of state authorisation shall proceed according to approved emergency plans and the specific situation in the gas system.
(2) Emergency plans are processed for:
(a) the disposal of the consequences of disturbances and accidents;
(b) the procedure for the complete interruption of gas supply according to emergency sampling step 10 for territories, cities and municipalities.
(3) Emergency plans are notified to the Central Gas Dispatch.
§ 5
Radio Regulations
The Dispute Order of the Gas System is annexed to this Decree.
§ 6
Efficacy
This decree shall take effect on the day of its publication.

Gas systems
Preliminary provisions
The Dispute Order sets out the rules for the dispatching management of the gas system.
The gas system shall comprise:
(a) a system of transit pipelines for the international transport of natural gas and for the national transport of natural gas imported into the Czech Republic by transit pipelines;
(b) national high-pressure gas pipelines with operating pressure above 4,0 MPa;
(c) underground gas containers;
(d) equipment for the production of gas,
(e) national high-pressure gas pipelines and gas installations with an operating pressure greater than 0,3 MPa up to 4,0 MPa.
In terms of the functional arrangement of the individual sets of gas installations, there are:
(a) international transit pipelines, including compression stations;
(b) national high-pressure gas pipelines and underground containers,
(c) separate regional distribution systems;
(d) distribution network in cities and municipalities.
Functional files are linked to each other by transmission and control stations.
The Dispatcher's Order provides:
(a) activities related to long-term and short-term preparation of heating gas balance sheets and consumption and preparation of gas supply schemes for a specific period;
(b) regular gas supply and consumption management activities including national systematic monitoring and evaluation of the state of security of balance between sources and gas consumption;
(c) supply management activities and reduction of heating gas consumption in emergency states;
(d) evaluation, statistical, information and international activities.
The following shall be taken to mean, by means of the controlled heating gases:
(a) natural gas oil;
(b) natural gas of carbon,
(c) mining gas;
(d) lamp gas,
(e) coke oven gas technically pure;
the specifications of which are laid down in the relevant Czech technical standards.
The dispatching process in the provision of supply and consumption of pipeline heating gases in the Czech Republic provides continuous dispatches established pursuant to § 13 (4) and (5) of the Act.
The gas system in the Czech Republic controls:
(a) National Central Gas Dispatch;
(b) in the defined sections of the gas system provided for by the state authorisation granted
- dispatch of the holder of a state authorisation for divorce on very high pressure pipelines,
- dispatches of holders of state authorisation for divorce in the designated areas of high pressure pipelines,
- dispatches of holders of State authorisations for the production of gas,
in accordance with separate dispatching rules respecting the rules of the gas system control system.
(1) Central Gas Dispatch
in a complex of services for holders of a State authorisation for the production and distribution of gas under the Association Treaty
(a) during the period of the regular gas supply and consumption regime in the Czech Republic, carry out a national systematic monitoring and evaluation of the state of security of the balance between resources and gas consumption provided by the holders of State authorisation, in accordance with the rules on the collection of information and data as defined in the Dispecial Order of the Central Gas Dispatch; the result of the evaluation will be reflected in the primary stage of demand and basic heating curves, with the exception of the limitation of gas supply pursuant to Section 9 (4) of the Act, which the Central Gas Dispatch will proclaim nationwide by the Czech Radio, with responsibility for this declared stage of demand and the heating curve,
(b) carry out an evaluation of the emerging risk of an emergency and produce analytical documentation for the Ministry of Industry and Trade for the decision to declare an emergency within the meaning of Section 12 of the Act, with responsibility for the accuracy of the analysis carried out and for the recommended solution;
c) takes over the management of heating gas supply in the Czech Republic after the announcement of an emergency.
(2) Dispatch of the holder of state authorisation for distribution on very high pressure pipelines
in regular gas supply arrangements in the Czech Republic under gas supply contracts
(a) international transport and import of natural gas by transit pipelines according to commercial contracts;
(b) ensure the coverage of the basic consumption diagram of gas consumption in the Czech Republic by the basic import of natural gas, by purchasing gas from sources and by creating seasonal stocks of natural gas in underground storage under gas supply contracts concluded under the Commercial Code;
(c) ensures the transport of gas by very high pressure pipelines and is responsible for the safe and non-fault operation of the installation.
(3) Holders of state authorisation for distribution in designated areas of high pressure pipelines and their dispatching
in the regular gas supply and consumption arrangements under gas supply contracts
(a) ensure the coverage of the sample diagram on a defined section of the gas system;
(b) are responsible for ensuring a balance between sources and gas consumption and for the safe and non-fault operation of the installation.
Preparation of the dispatching procedure
Dispatch activities
As part of the preparation of the dispatching control to ensure balance sheet balance between supply and gas consumption in its area and scope
1. dispatches of holders of state authorisation for divorce in defined areas of high pressure pipelines
(a) take over the output of processed long-term, medium-term, short-term and operational supply and consumption of heating gases on the basis of long-term forecasts, the results of supply analyses, the results of marketing surveys of the development of gas consumption and of the gas supply contracts concluded, processed by the competent services of the holder of the State authorisation;
(b) ensure the processing of annual, quarterly and monthly supply and consumption schemes and discuss them with the gas supplier's dispatcher; the schemes establish a balanced balance of supply and gas needs to cover the demand diagram in the defined section of the gas system, the outage plan of the gas installations substantially affecting the transport of gas and the set of measures to address any emergency. Copies of documents shall provide the central gas dispatcher with a national assessment of the security of balance between sources and gas consumption;
2. dispatches of holders of state authorisation for the production of lamp gas
(a) with the dispatching of the holder of the state authorisation for the distribution on very high pressure pipelines, process and discuss the system of production of the lamp and the basic outages of production facilities for the remaining period of the existence of the gas subsystem, respecting the real process of the transfer of pipelines and customers for the use of natural gas;
(b) process quarterly and monthly gas production schemes resulting from gas supply contracts.
The documents shall provide the Central Gas Dispatch with a national evaluation of the balance between resources and consumption;
3. dispatches of holders of state authorisation for the production of coke oven gas technically pure
(a) process and discuss long-term, medium-term, short-term and operational balance of gas production, including repair, shutdown and quick performance programmes, with the dispatching of the holder of a state authorisation for divorce in a defined area of high-pressure pipelines;
(b) process annual, quarterly and monthly gas production schemes resulting from gas supply contracts, including outages;
4. dispatch of the holder of state authorisation for divorce on very high pressure pipelines
(a) discuss with foreign partners the annual, quarterly and monthly arrangements for the international transport of natural gas by Czech transit pipelines resulting from closed transport contracts; process and discuss the outage programme of equipment affecting the prompt performance of the facility's transport capacity,
(b) discuss annual, quarterly and monthly gas import arrangements with foreign gas suppliers for supply to the Czech Republic;
(c) participate in technical negotiations when discussing international transit contracts and imports of natural gas by Czech gas pipelines;
(d) regularly evaluate the real transport capacity of very high pressure pipelines and address the concept of developing very high pressure international and national pipelines and underground containers;
(e) carry out a systematic analysis of gas supply and consumption on very high-pressure pipelines as a basis for drawing up long-term balances of gas sources to cover the annual, quarterly, monthly and daily sampling diagram over a period of several years;
(f) in cooperation with dispatches following point 1 and point 2 of this Article, it shall process and issue binding annual final balances of sources, supplies and consumption of gas and annual and quarterly schemes covering the consumption diagram of gas consumption in the Czech Republic, resulting from concluded gas supply contracts; process the system of gas supply in Czech underground containers and in leased capacity of foreign containers; the documents provide the central gas dispatcher with an evaluation of the balance between sources and gas consumption;
(g) discussions and prepares long-term agreements on mutual gas supply assistance for the supply of gas in the process of international transport of natural gas with the dispatching of foreign high-pressure natural gas pipelines;
h) draws up a set of emergency measures in the Czech Republic;
(i) process the concept of technical systems for dispatching the transit and domestic transport of gas;
5. Central Gas Dispatch
(a) assess the concept of the long-term development of gas consumption in the Czech Republic and the way it is covered by resources and gives opinions;
(b) processes comments on the design and implementation programme for the development of a very high-pressure international and national transport system and storage capacity of underground storage tanks;
(c) participate in preparatory meetings and issue binding opinions on the preparation of the annual balance sheet and quarterly gas supply and consumption arrangements in the Czech Republic and its source coverage;
d) takes over drawn up annual balances and quarterly gas supply schemes in the Czech Republic for a specific year as a basis for the national systematic monitoring and evaluation of gas consumption coverage in the Czech Republic,
(e) it shall process a set of measures and proposals for decisions by the competent authorities of the State for the variant management of emergency situations in each defined section of the gas system and in the territory of the whole State, including the provision of non-contractually auxiliary gas supplies from abroad, and shall regularly specify and supplement them (Emergency Emergency Plan);
f) Negotiates with foreign gas companies connected with gas distribution facilities to the Czech gas system the real possibilities of these companies for providing emergency relief gas supply in emergency states in the Czech Republic,
(g) it shall process proposals for the establishment of national gas reserves in underground storage tanks applicable on the basis of decisions of the Central Gas Dispatch to prevent and dispose of an emergency.
Operational management
Activities of the Central Gas Dispatch
Central Gas Dispatch
(a) carry out a national systematic continuous monitoring and evaluation of the state of security of the balance between the supply and consumption of gas-operated dispatches on the defined sections of the gas system provided for by the state authorisation and issue a disposition to halt the resulting imbalance, the longer duration of which could result in an emergency situation;
(b) systematically monitor the supply of heating gases in the Czech Republic according to the annual balance of resources and consumption and quarterly gas supply schemes;
(c) assess changes in the balance between the supply and consumption of natural gas and lamp gas and address the measures developed by the relevant dispatches;
d) evaluate long-term changes in the balance between supply and consumption or a serious situation disrupting the smooth supply of gas in the Czech Republic and prepare analytical documents for the decision of the Ministry of Industry and Trade to apply the measures provided for in the emergency emergency plan;
(e) declares on a daily basis the Czech Radio a national level of consumption and gas consumption according to the heating curve and the demand level limiting the consumption of gas by customers with national or territorial coverage;
(f) take over national management of the supply of natural gas and gas in emergency situations and declare measures which go beyond the contracts concluded for the supply of gas
- on the basis of the requirements of the relevant dispatches of the holders of state authorisations for distribution on specified sections of the high-pressure transport system, issue guidelines on opening fittings connecting individual territories at a pressure level of 2,5 MPa and 4,0 MPa and on interregional gas supply without direct commercial measurement,
- setting priorities for the dispatch of holders of state authorisations for distribution on a very high-pressure transmission system for the supply of gas to individual territories managed by holders of state authorisations in emergency and accident situations,
- develop proposals to deal with situations of emergency, including economic consequences, and submit them for approval to the Ministry of Industry and Trade,
- declare measures to limit gas consumption in an emergency,
- has the exclusive right to declare emergency stage 10,
- issue national methodological guidelines for the processing of emergency emergency emergency plans,
- issue guidelines on changes in gas accumulation in transit pipelines in cases where international obligations may be compromised by this measure,
- issue decisions on the use of national gas reserves in underground storage tanks,
- discuss and ensure emergency outsourcing of natural gas for the Czech Republic in emergency situations in the event of a danger of default for foreign gas companies,
- discuss auxiliary and emergency supplies of gas in emergency situations in addition to closed import contracts and emergency assistance agreements;
(g) monitor the consistency of the dispatching orders of holders of state authorizations and make proposals for their modification;
h) assess and monitor the consistency of emergency plans of holders of state authorisation for emergency situations.
Activity of dispatch of the holder of state authorisation for distribution on very high pressure pipelines
(1) Traffic management of transit pipelines
Dispatch of the holder of state authorisation for divorce on very high pressure pipelines
(a) discuss on a daily basis with a foreign gas supplier the distribution of transmission modes of supply to foreign customers and gas supplies to the Czech Republic;
(b) operational arrangements for the operation of transit pipelines according to any changes in the daily distribution;
(c) to ensure the gas supply contracts at border transmission stations and gas pressures at national transmission stations;
(d) manage the level of accumulation in the transit pipelines;
(e) the import of contracted and emergency supplies of natural gas to the Czech Republic and their domestic transport by transit pipelines;
(f) ensure the necessary measures provided for in the emergency plan for the disposal of disturbances, accidents and emergency situations arising from transit pipelines;
(g) transmit to the Central Gas Dispatch regular information on the import of gas for the Czech Republic, as well as any necessary information on the operational situations arising which affect the transport and import of gas; inform the opening, conduct and termination of the emergency work carried out in this context on the transit pipelines;
(h) agree to initiate scheduled shutdowns of sub-installations on the transit pipelines.
(2) Management of national very high pressure pipelines and a defined section of the distribution for the transport of gas
Dispatch of the holder of state authorisation for divorce on very high pressure pipelines
(a) ensure the transport of gas by transit pipelines to individual national transmission stations under the agreed regime;
(b) in the event of substantial deviations, resolve the situation through domestic natural gas sources, or submit a proposal to the transit pipeline control unit to discuss with the foreign supplier the change in the distribution of the gas to the Czech Republic;
c) Specifies daily contractually imported natural gas into the Czech Republic from other suppliers, including the re-transport of natural gas stored for the Czech Republic abroad;
(d) ensure a balance between the supply and consumption of natural gas and lamp gas according to the development of the sampling chart and resulting from the gas supply contracts concluded;
(e) requests, as a precautionary measure, changes in the supply of natural gas and changes in the production of lamp gas;
(f) give instructions on the insertion and extraction of gas into underground storage tanks and on the operational management of these activities in accordance with established annual and quarterly schemes for the production and drawing up of seasonal gas stocks;
(g) coordinate and agree on the partial and complete outages of gas sources, underground storage tanks and very high pressure pipelines and agree to carry out difficult operations;
(h) conduct regular dispatching during the day with the dispatches of the holders of state authorisations for distribution on high-pressure gas pipelines and with the dispatches of production sources of gas and operationally discuss and deal with any adjustments to daily deliveries in accordance with concluded gas supply contracts and the needs of such dispatches;
(i) transmit to the Central Gas Dispatch regular information on the progress of the supply of natural gas and light-gas and on major failures or changes in the management of very high pressure pipelines, including the measures taken;
(k) declares a check-hour deduction of gas supplies and consumption;
(l) systematically monitor the pressures at selected points of very high pressure pipelines and the gas subsystem and operationally ensure that their level is achieved under the gas transport regime;
(m) in agreement with the Central Gas Dispatch, changes gas flow and changes operating parameters for very high pressure pipelines;
(n) address, coordinate and develop automated collection of information from a defined section of the gas system and the information system for the needs of the control control process and its security through computer and control technology.
Activity of dispatches of holders of state authorisation for distribution on defined sections of high pressure pipelines
Dispatch of the holder of state authorisation for distribution on a defined section of high pressure pipelines
(a) manage, within its scope and scope, the supply of gas supplied from high-pressure, or very high-pressure gas pipelines to customers, cities and municipalities according to agreed sampling diagrams and according to the development of the demand curve, on the basis of the conditions for operational management and the provisions of its dispatching order with responsibility for ensuring a balance between supply and consumption;
b) with dispatch of the holder of the state authorisation for divorce on very high pressure pipelines
- discuss the daily requirements for gas supplies to its area and, according to the evolution of gas consumption, it shall specify those requirements operatively,
- discuss changes to the operational parameters of each transfer point related to any changes to the gas supply regime in the area,
