Ordinance of the Ministry of Transport and Communications laying down the characteristics, parameters and quality indicators of the services provided by the universal service holder to the telecommunications licence

determining the characteristics, parameters and quality indicators of the services provided under the universal service to the telecommunications licence holder
According to § 109 (2) of Act No. 151 / 2000 Coll., on Telecommunications and on the amendment of other laws, hereinafter referred to as "the Act", the Ministry of Transport and Communications provides for the implementation of § 29 (3) of the Act:
§ 1
For the purposes of this decree:
(a) telephone stations - a set of technical, operational and organisational means enabling the telecommunications network to use the telephone service;
(b) by a participating connection - a circuit enabling the creation of a speech route connecting the participating device to the telephone switchboard connection point,
(c) loss of service integrity - a phenomenon in which the quality of the transmission is exceptionally impaired during the connection;
(d) period of strong operation - period in which the operation is comparable to that of the main operating hour,
(e) a public telephone system - a card or coin telephone machine operated by a service provider accessible 24 hours a day;
(f) mobile subscriber equipment - equipment which is capable of communication while moving through mobile telecommunications network base stations.
§ 2
Indicators and service quality characteristics
The indicators and characteristics of service quality are:
(a) the time needed for the establishment of a telephone service through a public fixed telecommunications network is the time from the demonstrable ordering of that service by the customer to the time of connection of the subscriber's telephone device to the end point of the network and its start-up or the time of verification of the functionality of the end point of the network and its start-up if the subscriber's device is in the possession of the provider (this period also applies to the time required for the transhipment of an existing telephone station and is recorded in days);
(b) the frequency of failures on the subscriber's connection is the ratio of the number of valid failure reports submitted by participants for the interruption of the service or loss of the integrity of the service to the average number of participant connections in the evaluated time period (failure of terminal equipment connected to the end point of the telecommunications network and failure related to the characteristics of the telecommunications network not operated by the service provider),
(c) the time of removal of the fault status shall be the time from the time when the failure is reported by the participant to the provider of the service until the service has been returned to the prescribed operating condition (only the failure states defined in accordance with (b) are considered);
(d) the failure rate of establishing a connection in a public fixed telecommunications network is the ratio of unsuccessful attempts to establish a connection to the total number of strong traffic attempts expressed as a percentage, and the unsuccessful attempt to establish a connection is an attempt to call a valid telephone number, correctly chosen, at which the caller does not receive within 30 seconds of the end of the choice the last digit of the control ring tone, or a signal announcing that the call participant is currently talking, or another signal announcing a successful connection;
(e) the time required for the assembly of the connection shall be the time from the end of the last digit of the call number by the calling participant to receive the call tone, or a signal indicating that the call person is talking, or another signal announcing the successful connection;
(f) the claim for the accuracy of the bill is the proportion of the number of claims to the total number of all accounts issued, expressed as a percentage;
(g) the time of registration of the operator of the service centre at the reporting centre of the inter-urban and international traffic or at the workplace providing information on telephone numbers shall be the time from the time of sending the last digit of the service number until the operator (natural person) has logged in to the caller user to provide the requested service;
(h) the alert rate for public card and coin vending machines is the percentage of the number of installed public telephone machines in operable condition to the total number of installed public telephone machines, expressed as a percentage;
(i) the time needed for the establishment of a telephone service via a public mobile telecommunications network shall be the time from the demonstrable ordering of the service by the customer to the transmission of the mobile subscriber device in operation or the activation of the subscriber identification card to the customer;
(j) the degree of failure to establish connections in the public mobile telecommunications network is the proportion of unsuccessful attempts to connect to the total number of attempts to connect from mobile terminal equipment in the mobile telecommunications network during a period of strong operation, expressed as a percentage at any point in the territory where the telecommunications service is provided by that network;
(k) the degree of early termination or loss of service integrity in the public mobile telecommunications network is the proportion of the number of early termination connections or links with the occurrence of an exceptional deterioration in the quality of the transmission to the total number of test connections lasting 5 minutes during a period of strong operation, expressed as a percentage at any point in the territory where the telecommunications service is provided through that network.
§ 3
Specified parameters
The quality parameters of the services provided under the universal service are defined
(a) Annex 1 to the fixed telecommunications network;
(b) Annex 2 to the mobile telecommunications network.
§ 4
Evaluation of indicators
(1) The universal service provider carries out a survey of the parameter parameters achieved and their evaluation (1) on the basis of regular monthly monitoring within the framework of:
(a) the relevant NUTS-NUTS territorial units at NUTS level 32) for services provided through a fixed telecommunications network;
(b) the whole territory in which the services provided by the mobile telecommunications network are located.
(2) The universal service provider shall include in the evaluation of the indicators referred to in Article 2 (a), (b), (c), (f) and (i) data on all registered events carried out during the evaluation period.
(3) The universal service provider shall include in the evaluation of the indicators according to § 2 (d), (e), (g), (h), (j) and (k) data obtained by statistically significant data selection. The number of observations, ensuring sufficient accuracy and reliability of the results, corresponds to the requirement of a methodology approved by the Czech Telecommunications Office (hereinafter the Office).
(4) In the case of a crisis situation (3), the universal service provider submits to the Authority the parameters of the indicators achieved, justifying their impact on the crisis situation.
§ 5
Efficacy
This decree shall take effect on the day of its publication.
