DECLARATION

laying down in more detail the conditions for the supply of gas and the method for calculating the damage caused by unauthorised gas collection
The Ministry of Industry and Trade pursuant to § 45 (6), having regard to § 23 (8) and (10) and § 29 (2) of Act No 222 / 1994 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on State Energy Inspection ("the Act '), provides:
The share of the customer in the supplier's cost-effectively incurred associated with the connection and securing the required supply
(1) The share of the customer in the supplier's cost effectively incurred in connection with the connection and the provision of the required supply is part of the costs incurred by the supplier to connect a specific demand point to the distribution facility and to provide the customer with the required gas supply.
(2) The share of the customer in the supplier's cost-effectively incurred associated with the connection shall be negotiated separately for each case in accordance with the price regulation.1)
(3) The effective costs incurred by the supplier in securing the required supply are those incurred by the supplier to build new or increase the performance of existing distribution facilities directly related to that supply.
(4) The amount of the supplier's cost effectively incurred to ensure the required supply per customer shall be determined by the calculation set out in Annex 1 to this Order.
(5) The share of the customer in the supplier's cost-effectively incurred to secure the required supply shall be a maximum of 50% of the costs calculated in accordance with paragraph 4.
Efficacy
This decree shall take effect on the day of its publication.

Method of calculating the supplier's cost effectively incurred to ensure the required supply
The amount of the supplier's cost effectively incurred to ensure the required gas supply per customer shall be determined as follows:
UNO = Ni. P / k
where
UNO - effectively incurred costs incurred by the supplier associated with the provision of the required supply per customer,
Ni - investment costs incurred by the supplier for the distribution equipment directly related to the supply,
P - the required hourly consumption of the customer,
k - installed hourly capacity of the distribution facility directly related to the supply.
