DECLARATION
of 24 June 2024
amending Decree No. 505 / 2006 Coll., implementing certain provisions of the Social Services Act, as amended
The Ministry of Labour and Social Affairs provides, pursuant to § 119 (2) of Act No. 108 / 2006 Coll., on Social Services, as amended by Act No. 261 / 2007 Coll., Act No. 206 / 2009 Coll., Act No. 366 / 2011 Coll., Act No. 313 / 2013 Coll. and Act No. 254 / 2014 Coll., to implement § § 35 (2), § 75 (1) and § 116 (5) and 6 of this Act:
Decree No. 505 / 2006 Coll., implementing certain provisions of the Social Services Act, as amended by Decree No. 166 / 2007 Coll., Decree No. 340 / 2007 Coll., Decree No. 239 / 2009 Coll., Decree No. 162 / 2010 Coll., Decree No. 391 / 2011 Coll., Decree No. 389 / 2013 Coll., Decree No. 218 / 2016 Coll., Decree No. 387 / 2017 Coll., Decree No. 34 / 2022 Coll., Decree No. 440 / 2022 Coll. and Decree No. 378 / 2023 Coll., are amended as follows:
1. In Section 3 of the Introductory Part of the provision, the words "under Section 37 (2) of the Social Services Act 'shall be inserted after the words" advice'.
2. In Article 3, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The basic social advice for the provision of social services of personal assistance, care services, relief services and day care centres may also provide activities providing support to carers and activities consisting in training the skills of carers to manage the care of those dependent on their assistance. '.
3. In Article 4, at the end of point (c), the dot is replaced by a comma and the following point (d) is added:
"(d) activities providing support to carers and activities consisting of training carers' skills to manage the care of those dependent on their assistance.";
4. In Article 5, at the end of paragraph 1, the dot is replaced by a comma and the following point (h) is added:
"(h) assistance in ensuring the safety and possibility of staying in a natural social environment: supervision that a person dependent on assistance does not endanger himself or his surroundings."
5. In § 5 (2) (a), § 6 (2) (a) (1), § 8 (2) (a), § 9 (2) (a), § 10 (2) (a) (1), § 11 (2) (a) (1), § 12 (2) (a) (1), § 17 (2) (c) (1) and in § 35 (2) (c) (1), "CZK 155" is replaced by "CZK 165."
6. In § 5 (2) (b), § 6 (2) (a) (2), § 8 (2) (b), § 9 (2) (b), § 10 (2) (a) (2), § 11 (2) (a) (2), § 12 (2) (a) (2), § 17 (2) (c) (2) and § 35 (2) (c) (2), "CZK 135" is replaced by "CZK 145."
7. In Article 6, at the end of paragraph 1, the dot is replaced by a comma and the following points (f) and (g) are added:
"(f) assistance in the exercise of rights, legitimate interests and in the provision of personal affairs:
1. assistance in communication leading to the exercise of rights and legitimate interests,
2. assistance in the handling of common affairs,
(g) assistance in ensuring the safety and possibility of staying in a natural social environment: supervision that a person dependent on assistance does not endanger himself or his surroundings. "
8. the words "to (g)" shall be added at the end of the introductory part of the provisions in Paragraph 6 (2) (a).
9. In Paragraph 6 (2) (c), the amount "50 CZK" is replaced by "60 CZK."
10. in Paragraph 6 (2) (d), the amount "160 CZK" is replaced by "170 CZK."
11. In Paragraph 6 (2) (e), the amount "90 CZK" is replaced by "100 CZK."
12. In Article 10, at the end of paragraph 1, the dot is replaced by a comma and the following point (i) is added:
"(i) assistance in ensuring the safety and possibility of staying in a natural social environment: supervision that a person dependent on assistance does not endanger himself or his surroundings."
13. in Article 10 (2) (a), "h" is replaced by "i";
14. in Paragraph 20 (a), the word "telephone" is replaced by the word "distance" and the words "telephone contact of a person with the workplace of telephone crisis intervention" are replaced by "contact by means of distance communication."
15. In Paragraph 22, the dot is replaced by a comma at the end of paragraph 1 and the following point (d) is added:
"(d) socio-therapeutic activities:
social therapy activities, the provision of which leads to the development or maintenance of personal and social skills and skills promoting social inclusion of persons. ';
16. Annex 4 shall read as follows:
"Annex No 4
Education courses where no qualification course for social services workers is required
The qualification course for social services workers is not required for a natural person who has obtained a secondary education, a secondary education with a certificate or a secondary education with a graduate degree in education aimed at:
(a) charitable services;
(b) care services;
(c) nursing;
(d) nursing work;
(e) preschool and extracurricular education;
(f) social legal activity;
(g) social education;
(h) social activity;
(i) welfare;
(j) social welfare;
(k) social services;
(l) education,
(m) educational and humanitarian activities. ';
Efficacy
This Decree shall take effect on 1 July 2024.
