DECLARATION
of 18 June 2003
amending Decree No 432 / 2001 Coll., on documents of application for a decision or observations and on the formalities for authorisation, consent and statement of the water authority
The Ministry of Agriculture in cooperation with the Ministry of the Environment provides, pursuant to § 115 (2) of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act):
Decree No. 432 / 2001 Coll., on the documents of the application for a decision or observations and on the formalities for the authorisation, the consent and the opinion of the water authority, shall be amended as follows:
1. In Annex 1, point 2, the list of Annexes, including footnote 5, reads:
'2. Other information required for the registration of decisions of the water authorities under specific legislation, 5) except:
(a) the water authority code;
(b) the name of the water authority;
(c) the classification code for the type of subject-matter of the decision;
(d) the decision taken at the same time;
(e) link to previous decisions issued under the Water Act;
(f) the date of the decision;
(g) the date on which the decision becomes final;
(h) the validity of the decision;
(i) the number of the decisions;
(j) the item number and the date of establishment;
(k) the person who made the entry in the register of the decision;
(l) the county identifier, the municipality identifier, the cadastral territory identifier, the water flow identifier, the water works register identifier in the property register, the hydrological order and suborder numbers, the river water flow km and the hydrogeological area and other details of the place of the decision.
5) Decree No. 7 / 2003 Coll., on Water Registration. '.
2. In Annex 3, point 2 of the list of Annexes reads:
'2. Other information required for the registration of decisions of the water authorities under specific legislation, 5) except:
(a) the water authority code;
(b) the name of the water authority;
(c) the classification code for the type of subject-matter of the decision;
(d) the decision taken at the same time;
(e) link to previous decisions issued under the Water Act;
(f) the date of the decision;
(g) the date on which the decision becomes final;
(h) the validity of the decision;
(i) the number of the decisions;
(j) the item number and the date of establishment;
(k) the person who made the entry in the register of the decision;
(l) the county identifier, the municipality identifier, the cadastral territory identifier, the water flow identifier, the water works register identifier in the property register, the hydrological order and suborder numbers, the river-km watercourse and the hydrogeological area and other details of the object of the decision. ';
3. In Annex 4, point 7, the words "in the case of § 8 (1) (a), (c) of the Water Act 'are replaced by the words" in the case of the grant of consent to the Water Flow'.
4. In Annex 4, point 7, the words "(if construction, equipment or activity affects the water flow) 'shall be inserted after the words" water flow name'.
5. In Annex 4, point 8, the words "in the case of § 8 (1) (b), (c) of the Water Act 'are replaced by the words" in the case where consent may affect groundwater'.
6. In Annex 4, point 8, the words "hydrological order number 'are replaced by the words" hydrogeological area number' and the words "(if construction, installation or activity may affect groundwater) 'are added.
7. In Annex 4, point 2 of the list of Annexes reads:
'2. Other information required for the registration of decisions of the water authorities under specific legislation, 5) except:
(a) the water authority code;
(b) the name of the water authority;
(c) the classification code for the type of subject-matter of the decision;
(d) the decision taken at the same time;
(e) link to previous decisions issued under the Water Act;
(f) the date of the decision;
(g) the date on which the decision becomes final;
(h) the validity of the decision;
(i) the number of the decisions;
(j) the item number and the date of establishment;
(k) the person who made the entry in the register of the decision;
(l) the county identifier, the municipality identifier, the cadastral territory identifier, the water flow identifier, the water works register identifier in the property register, the hydrological order and suborder numbers, the river-km watercourse and the hydrogeological area and other details of the object of the decision. ';
Efficacy
This Decree shall take effect on 1 July 2003.
