DECLARATION
Ministry of Transport and Communications
of 30 June 2000
determining the types and characteristics of the terminal points and the interfaces of the public telecommunications network
According to § 109 (2) of Act No 151 / 2000 Coll., on Telecommunications and on the amendment of other laws (hereinafter "the Act '), the Ministry of Transport and Communications provides for the implementation of § 2 (4) and § 39 (9) of the Act:
§ 1
Interface types
Interface types 1) public telecommunications networks 2) are
(a) the end point of a public fixed telecommunications network enabling the user to access the telecommunications services provided through that network;
(b) the end point of the public mobile telecommunications network;
(c) interfaces for connecting public telecommunications networks (interconnection point),
(d) an interface for access by the operator of a public or non-public telecommunications network or for access by the telecommunications service provider to a public telecommunications network operated by the licence holder (access point); or
(e) an interface for specific network access outside the public telecommunications network end points established under a network access contract pursuant to § 41 (1) and (2) of the Act.
Public fixed network end point
§ 2
(1) The end point of the public fixed telecommunications network is the subscriber's socket, terminal board, cable terminal, switchboard or other telecommunications equipment which enables the connection of the terminal equipment (3) or the non-public telecommunications network to the public telecommunications network.
(2) The subscriber's socket is the end point of the public telecommunications network when the terminal equipment is connected to the public telecommunications network by a connection or connection cable equipped with a plug.
(3) The end point of the public telecommunications network is part of that network. It shall be established in an object or on a plot to which the participant has (4) ownership or other rights. Technical specifications of individual types of end point will be published by the Czech Telecommunications Office in the Telecommunications Bulletin. The technological solution and location of the end point is part of the network connection contract. 5)
(4) The end point shall be located in such a way as to allow connection of the end device, installation, maintenance, service and performance of the control activity.
§ 3
(1) The installation, maintenance and service of the end point of the public telecommunications network may be carried out only by a natural or legal person authorised under special legislation (6) and authorised by the operator of the public telecommunications network concerned.
(2) Where a public telecommunications network operator uses a telecommunications line owned by another legal entity to set up a terminal point, it shall manage the maintenance and removal of the defects in that management in agreement with its owner or with the person authorised by it.
§ 4
Public mobile network end point
The end point of a public mobile network shall be an interface in the area where the operator of that network provides the relevant public telecommunications service in accordance with the licensed.
Interface for interconnection, access and specific approach
§ 5
(1) The interface for connecting public telecommunications networks is the interconnection point for which the electrical and physical execution of the interface and the transmission and signalling protocol are specified in the technical specifications, as well as the data needed to ensure the integrity of the services in the interconnected networks and the data to ensure other functions that the interface allows.
(2) The interface for access to the public telecommunications network is established on the basis of a network access contract. (7) The technical specification of the interface at the access points corresponds to the specifications for end or interconnection points of the network.
(3) The interface for specific access to the public telecommunications network outside its end points to users of telecommunications services provided on the public telecommunications network shall be established on the basis of individual contracts between the network operator and the service user. The technical specifications of these interfaces will be agreed in these individual contracts.
(4) The contractual arrangement shall include a technological solution to the interconnection of networks or to the security of network access at an interconnection point or access point located by mutual agreement of the network operators, unless otherwise provided by law. 8)
§ 6
The radio equipment technical specifications published in accordance with the provisions of Section 5 (4) and the parameters of the radio channel set out in the Decision on the approval or recognition of the type of radio equipment (9) or in the permit for the operation of radio transmission equipment10) are determined by the interface of those devices.
§ 7
Transitional and final provisions
(1) The technological solution to the end point of the public fixed telecommunications network established under the former rules is considered to be established under this Decree.
(2) Decree No. 130 / 1997 Coll., on the end point of telecommunications networks is hereby repealed.
§ 8
Efficacy
This decree shall take effect on the day of its publication.
