DECLARATION
of 18 June 2025
determining the duration of the soldier's service relationship and the amount of the study remuneration if they do not comply with the duration of the service
The Ministry of Defence provides for the Act No. 221 / 1999 Coll., on professional soldiers, as amended by Act No. 254 / 2002 Coll., Act No. 332 / 2014 Coll. and Act No. 99 / 2025 Coll.:
Determination of the duration of the service relationship
(1) The term of service after completion of a soldier's studies shall be determined:
a) at preschool or daily studies in schools in the Czech Republic and in courses in the Czech Republic
1. lasting continuously more than 5 months for twice the duration of the study; or
2. paid by the Ministry of Defence with a value of more than CZK 50,000 for a period of 2 months, plus another 2 months for each additional CZK 50,000 paid for study, but not more than CZK 24 months,
b) for study abroad or on secondment to study abroad under the study programme of the school in the Czech Republic
1. lasting at least 30 days per triple study duration; or
2. paid by the Ministry of Defence in excess of CZK 100,000 for a period of 3 months, plus another 3 months for each additional CZK 100,000 paid for study, but not more than 36 months,
(c) for studies in the course of service or courses
1. in which teaching within a study lasting more than 10 months takes place in the form of study centres, for a period equal to the duration of the study; or
2. paid by the Ministry of Defence worth more than CZK 50,000 for a period of 1 month, plus another 1 month for each additional CZK 50,000 paid for study, but not more than 12 months,
(d) for preschool or daily studies in schools and courses lasting continuously for more than 5 months, linked to pilot and flight instruction, to three and a half times the duration of the study.
(2) The performance of the obligation to remain in service after completion of the studies shall take place on the first day of the calendar month following the end of the studies. If the former obligation to remain in service after completion of the studies has not been fulfilled, the performance of the prescribed period shall not take place until the first day following the completion of the former obligation. The period of study from which the obligation to remain in service arises shall be counted only once and only in the performance of an earlier obligation.
(3) The duration of the study is calculated for the whole calendar month. The period of each day in less than calendar months shall be added up and evaluated every 30 days as a month.
(4) If the Ministry of Defence pays a study fee under the Higher Education Act (1), which a public university provides for a soldier to study in a study programme for longer than the standard study period, it shall be included in the study period referred to in paragraph 3 for every 2 months for which a study fee has been paid for 1 month.
(5) For the purposes of determining the duration of the post-graduate service, the end of secondary education or the proper termination of a higher education course (2), the issue of a course certificate, the exclusion from the course, the failure to meet the requirements of the study programme, the abandonment of the study programme and the termination of the service by discharge of the service, withdrawal of military rank or loss of military rank on the basis of a final decision of the court.
(6) Only the fees related to the study paid by the Ministry of Defence to the training establishment for the soldier shall be included in the amount of money for the study of the soldier referred to in paragraph 1 (a) to (c).
(7) If the duration of the service after graduation can be determined both with regard to the length of the study and the amount of fees paid by the Ministry of Defence, the duration of service after graduation shall be determined according to the longer of them.
Amount of study remuneration
(1) The amount of remuneration for the study in the event of failure to fulfil the period for which the soldier is obliged to remain in service after completion of the study (hereinafter referred to as "the period") is for each month of study in the Czech Republic
(a) at the present or daily study
1. study programmes in the education group Special and interdisciplinary fields, associated with training of pilots and flight ducts, carried out by university, CZK 30,000,
2. study programmes in the group of fields of medical science and pharmaceutical science, carried out by university, 12,000 CZK,
3. in Bachelor's, Master's or Doctoral studies, carried out by a university in other study programmes not listed in points 1 and 2, 9,000 CZK,
4. in language courses 6 000 CZK, or
5. in other cases, not listed in points 1 to 4, 4 000 CZK,
(b) study in the performance of duty
1. in the study programme carried out by the university 3,000 CZK, or
2. in other cases CZK 2,000.
(2) The amount of compensation for failure to meet the required period for each month of study abroad shall be three times the amounts referred to in paragraph 1.
(3) The amount of the remuneration referred to in paragraphs 1 and 2 shall be increased by the amount of money paid by the Ministry of Defence to a school or educational establishment in a non-military school in the Czech Republic, up to a maximum of CZK 500,000 for a study in the Czech Republic and CZK 1 000 000 for a study abroad.
(4) If a soldier does not take up studies in a non-military school in the Czech Republic or abroad without serious reason, he or she is bound to pay the amount of money or part of it paid to the school or educational establishment by the Ministry of Defence if the amount of money or part of it is not refunded to the Ministry of Defence.
(5) The amount to be paid by a soldier shall be determined by the service authority by dividing the total amount of remuneration calculated in accordance with paragraphs 1 to 3 by the number of months that have been determined to remain in service after completion of the study and multiplying the result by the number of months that are missing until the time specified.
Transitional provisions
(1) The period of service of a soldier after completion of a study initiated before the date of entry into force of this Decree is governed by the provisions in force at the time of commencement of the study. In the event of a change in the duration of the study and, consequently, a change in the period for which the soldier is required to remain in service after the completion of the study, after the date of entry into force of this decree, the new duration of the service shall be determined by decision of the service authority, depending on the actual duration of the study.
(2) In the event of failure to comply with an agreement concluded under the legislation effective at the time of commencement of the studies, the reimbursement of the costs referred to in the agreement shall be deemed to have been paid for the study under this order as from the date of entry into force of this decree.
Repeal
They shall be deleted:
1. Decree of the Ministry of Defence No. 265 / 1999 Coll., which provides for the duration of service in the service of professional soldiers who are preparing for the performance of their duties and the amount of remuneration which may be required for the professional soldier if he fails to comply with the agreement.
2. Decree No. 455 / 2002 Coll., amending Decree No. 265 / 1999 Coll., determining the duration of service for professional soldiers preparing for the performance of their duties, and the amount of remuneration which may be required on the professional soldier if he fails to comply with the agreement.
3. Decree No. 390 / 2005 Coll., amending Decree No. 265 / 1999 Coll., which provides for the duration of service in respect of professional soldiers preparing for the performance of their duties and the amount of remuneration which may be required on the professional soldier if he fails to comply with the agreement, as amended by Decree No. 455 / 2002 Coll.
4. Decree No. 232 / 2010 Coll., amending Decree No. 265 / 1999 Coll., laying down the duration of service for professional soldiers preparing for the performance of their duties, and the amount of remuneration which may be required on the professional soldier if he fails to comply with the agreement, as amended.
5. Decree No. 130 / 2012 Coll., amending Decree No. 265 / 1999 Coll., which provides for the duration of service in respect of professional soldiers who are preparing for the performance of their duties by study, and the amount of remuneration which may be required on the professional soldier if he does not comply with the agreement, as amended.
6. Decree No. 171 / 2019 Coll., amending Decree No. 265 / 1999 Coll., which provides for the duration of service in respect of professional soldiers who are preparing for the performance of their duties by study, and the amount of remuneration which may be required on the professional soldier if he fails to comply with the agreement, as amended.
Efficacy
This Decree shall take effect on 1 July 2025.
