GOVERNMENT REGULATION
of 9 May 2012
amending Government Regulation No. 596 / 2006 Coll., establishing the permissible level of public support in the cohesion regions of the Czech Republic
The Government orders pursuant to § 11 of Act No. 72 / 2000 Coll., on investment incentives and on the amendment of certain laws (the Act on Investment Incentives), as amended by Act No. 19 / 2004 Coll., Act No. 159 / 2007 Coll. and Act No. 192 / 2012 Coll., to implement § 6 (1) and (3) of the Act:
Government Regulation No. 596 / 2006 Coll., establishing the permissible level of public support in cohesion regions in the Czech Republic, is amended as follows:
1. in Article 1 (1) (g) and (i), the words "investment incentives" shall be deleted;
2. In Section 2, the words "eligible costs' are replaced by" eligible costs', the words "investment incentives' are deleted and the words" eligible costs' are replaced by the words "eligible costs'.
3. In Article 3 (1), the words "costs which may be supported 'are replaced by the words" eligible costs which' and the words "the Commission of the European Communities' are replaced by the words" the European Commission '.
4. In Article 3 (2), the words "eligible costs' are replaced by the words" eligible costs' and the words "eligible costs' are replaced by the words" eligible costs'.
5. Article 4, including footnotes 3 and 4, reads as follows:
If the entire investment in production is not implemented
(a) in a district in which the unemployment rate at the date of submission of the intention to obtain an investment incentive is at least 50% higher than the average unemployment rate in the Czech Republic as indicated in the statistics of the Ministry of Labour and Social Affairs for the past two half-years;
(b) within the territory of officially supported regions defined by the Government in accordance with other legislationm3; or
(c) mostly in the manufacturing industry, which falls under the definition of activities falling within Sections 20, 21, 26 to 30 or Section 32, Section 32.50, Classification of Economic Activities (CZ-NACE) 4), issued by the Czech Statistical Office,
the maximum public aid intensity for an investment action is 75% of the permissible public aid rate in the individual regions of the cohesion of the Czech Republic established under this Regulation.
3) Article 4 of Act No. 248 / 2000 Coll., on the promotion of regional development.
4) Communication from the Czech Statistical Office No. 244 / 2007 Coll., on the introduction of the Classification of Economic Activities (CZ-NACE). "
Transitional provisions
1. The permissible level of public aid for investment incentives granted before the date of entry into force of this Regulation shall be assessed in accordance with existing legislation.
2. In proceedings initiated before the date of entry into force of this Regulation and until that date definitively completed, the permissible rates of public aid under the existing legislation shall apply.
Efficacy
This Regulation shall take effect on the 30th day following its publication.
