DECLARATION
of 13 April 2006
amending Decree of the Ministry of Transport and Communications No. 31 / 2001 Coll., on driving licences and on the register of drivers, as amended
The Ministry of Transport provides pursuant to § 137 (2) and for the implementation of § 113 (9), § 116 (4) and (7), § 118b (6), § 125b (8) and § 125c (3) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended by Act No. 478 / 2001 Coll., Act No. 53 / 2004 Coll. and Act No. 411 / 2005 Coll.:
Decree No 31 / 2001 Coll., on driving licences and on the register of drivers, as amended by Decree No 154 / 2003 Coll. and Decree No 177 / 2004 Coll., is amended as follows:
1. The following Section 10a is inserted after Section 10:
Conditions for the recognition of driving licences of other foreign States for the purpose of exchanging driving licences
(1) A driving licence issued by a foreign State which by its implementation does not comply with the requirements of the Convention on Road Traffic (Vienna 1968) or the Convention on Road Traffic (Geneva 1949) may be exchanged for a driving licence if the issuing State is not a Member State of the European Communities and is listed in Annex 6a and the holder of that driving licence resides in the Czech Republic on the basis of a long-stay visa.
(2) For the purposes of the exchange of a driving licence referred to in paragraph 1, a valid international driving licence issued by a foreign State shall be considered as an official translation. The categories of driving licences to be entered on the driving licence where a valid international driving licence issued by a foreign State is presented as an official translation shall correspond to the scope of the categories of driving licences registered on the international driving licence.
(3) The manner and scope of the transcription of the categories of driving licence, if not in the cases referred to in paragraph 2, is set out in Annex 6a. In order to limit the driving authorisation of a foreign State which does not comply with the definition of Section 81 of the Act, the relevant harmonisation code under Section 11 or the national harmonisation code under Section 11a shall be used. ';
2. In Section 11a, the following national harmonisation codes 151 and 160 are inserted after the harmonisation code 150, including footnote 4a:
"151. Restrictions on category A driving licences up to 400 cm3.
160. Exemptions from age for group driving licences A subgroup A1 of a person holding a licence for a motorist athlete, granted only for driving in a sports contest4a).
(4a) Paragraph 83 (5) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws, as amended. '
3. Paragraph 14, including the title, reads:
Submission of a driving licence and international driving licence
(1) The surrender of a driving licence or an international driving licence shall be recorded by the municipal authority of the municipality with extended scope in the driver's registration card.
(2) The surrendered driving licence or international driving licence which is invalid or expired, as well as the driving licence or international driving licence, which will no longer be able to return to the person in whose name it is issued, shall be invalidated by cutting off the upper right corner.
(3) In the list annexed to the shredding protocol, the municipal authority of the municipality with extended scope when submitting a driving licence or an international driving licence shall record the following:
(a) the name and surname of the holder of the surrendered driving licence or international driving licence;
(b) the natural number of the holder referred to in (a); if no birth number has been assigned to the holder, the date of birth shall be indicated;
(c) the series and registration number of the surrendered driving licence or international driving licence and the date of surrender;
(d) the series, registration number and date of issue of the new driving licence or international driving licence.
(4) According to paragraphs 2 and 3, the municipal authority of the municipality with extended scope shall not proceed in cases:
(a) when a found driving licence or an international driving licence has been handed over;
(b) where the reason for the invalidity of a surrendered driving licence or an international driving licence is only the loss of a driving licence as a result of a final penalty imposed or a penalty for the prohibition of driving a motor vehicle or as a result of a total of 12 points in the score.
(5) The model of the document of surrender of a driving licence or an international driving licence is set out in Annex 8. ';
4. The following Section 15a, 15b, 15c is inserted after Section 15:
Forms of certificate of detention
(1) The certificate of retention of the driving licence shall be drawn up in the Czech language and shall contain:
(a) the designation of the department of the Police of the Czech Republic (hereinafter referred to as the "police") of which the police officer who has detained the driving licence is a member,
(b) the name, surname and address of the holder of the detained driving licence;
(c) the natural number of the holder of the detained driving licence, if any, or the date of birth;
(d) the number and date of issue of the seized driving licence and the designation of the office which issued the detained driving licence;
(e) the reason for the detention of a driving licence, including a brief description of the action on the basis of which the driving licence was detained, indicating the place and time of the offence,
(f) information on the consequence of the retention of a driving licence;
(g) the date of issue of the certificate of possession and the signature of the officer holding the licence;
(h) the statement of the holder of the detained driving licence, if he wishes to comment on the retention of the driving licence;
(i) the signature of the holder of the detained driving licence or, where applicable, by a police officer who has refused to sign the holder of the detained driving licence.
(2) The model of the certificate of retention of a driving licence is set out in Annex 9a.
Forms of confirmation of deposit
(1) Confirmation of deposit shall be drawn up in the Czech language and shall contain:
(a) a designation of the police department of which the police officer who has chosen bail is a member;
(b) the name, surname and address of the driver from whom the deposit was collected;
(c) the natural number of the driver from whom the deposit was collected, if allocated, otherwise the date of birth;
(d) the number and date of issue of the driver's licence from which the deposit was collected and the identification of the office which issued the licence;
(e) the amount of the bail collected, including its indication by words,
(f) the method of deposit collection (cash, cashless),
(g) the reason for the collection of the bail, including a brief description of the action on the basis of which the bail was collected, indicating the place and time of the action, and the facts on the basis of which the officer suspected that the driver from whom the bail was collected would avoid infringement proceedings;
(h) lessons learned about the consequence of the deposit collection and the conditions for its repayment;
(i) the date of issue of the certificate of acceptance of the bail and the signature of the officer who made the bail;
(j) the statement of the driver from whom the deposit has been collected if he wishes to express his or her wish to withdraw the deposit,
(k) the signature of the driver from whom the bail was collected and, where appropriate, by the officer who made the remark that the driver of the detained driving licence refused to sign.
(2) The model of the acceptance certificate is set out in Annex 9b.
Forms of delegation for the exercise of state professional supervision and top state professional supervision
(1) The authorisation to exercise state professional supervision and the mandate to exercise the supreme state professional supervision of the power of delegation in road traffic matters shall be in writing and shall include:
(a) the designation of the administrative office which issued the mandate;
(b) an indication that it is a mandate for the exercise of national professional supervision or the chief national professional supervision of the exercise of delegated powers in road traffic matters;
(c) the authorisation number,
(d) the name and surname of the authorised official and, where appropriate, the title and his personal number;
(e) the date of issue of the mandate,
(f) the stamp and signature of the Head of Administration issuing the mandate.
(2) The authorisation shall have a rectangular shape and shall be printed on a paper size of 70 x 100 mm, with protective features, and shall contain, in addition to the particulars referred to in paragraph 1, a photograph of the holder of the licence with a holographic adhesive. The authority to exercise top state professional supervision is green. The authority to exercise state professional supervision is the color blue.
(3) The model of the mandate for the exercise of state professional or top national professional supervision is set out in Annex 9c. "
5. in Article 17 (2) (g):
"(g) data on offences committed against road safety and continuity,"
6. in Article 17 (2), the following points (m), (n), (o) and (p) are inserted after point (l):
"(m) details of licences issued for the lost, stolen, destroyed or damaged driving licences of the European Communities;
(n) data on the points achieved in the driver score and on the netting and deduction of points;
(o) data on the cancellation of the driving licence and data on the return of the driving licence,
(p) data relating to the waiver of the right to drive a motor vehicle within the territory of the Czech Republic for a period of one year by reaching a number of 12 points in the score, in the case of a driver holding a European Community driving licence, a driving licence issued by a foreign State, an international driving licence issued by a foreign State, '.
Point (m) shall be renumbered as point (q).
7. in Article 17 (3) (e), the words "and the application for a licence for a lost, stolen, destroyed or damaged driving licence of the European Communities" shall be inserted after the words "destroyed."
8. In Paragraph 17 (3) (i), the words "for which a fine of more than CZK 2,000 has been imposed," shall be deleted.
9. Paragraph 17 (3) (k) reads as follows:
"(k) a notification of the imposition by the competent authority of a fine for offences against road safety and continuity imposed in block management;"
10. in Article 17 (3), the following points (l), (m), (n), (o), (p), (q) and (r) are added:
"(l) a final decision imposing a penalty for an offence committed by an act included in the scores, or a notice of the acquisition of legal authority for such a decision;
(m) notification by the Court of Justice of the acquisition of legal power of a judgment punishable by a criminal offence committed by an act of assessment;
(n) the decision of the authority responsible for dealing with an offence under a law other than the law on offences which has been declared guilty of an offence committed by an act included in the score;
(o) a copy of the document with the driver's objections against the record of points in the score and a copy of the written notification of the correction made to the record of points or a copy of the final decision rejecting the objection and confirming the record of points made;
(p) a driving licence issued by a foreign State in accordance with Paragraph 116 (5) of the Act,
(q) a detained driving licence pursuant to Article 118c (1) of the Act,
(r) a copy of the acknowledgement of deposit. ';
11. the following Annex 6a is inserted after Annex 6:
