DECLARATION
of 12 May 2005
amending Decree No. 101 / 1995 of the Ministry of Transport Coll., which issues the Order on the Health and Proficiency of Persons in the Operation of Railways and Rail Transport, as amended by Decree No. 455 / 2000 Coll.
The Ministry of Transport, in agreement with the Ministry of Health and the Ministry of Interior, provides, pursuant to § 66 paragraphs 1, 2 and 3 of Act No. 266 / 1994 Coll., on Railways, as amended:
Decree No. 101 / 1995 Coll., published by the Order on the Health and Proficiency of Persons in the Operation of Railways and Rail Transport, as amended by Decree No. 455 / 2000 Coll., is amended as follows:
1. Paragraph 9, including footnotes 10, 11, 12 and 13, reads as follows:
(1) The conditions of education and competence of persons to drive an electric motor vehicle on a national, regional and tugboat track are:
(a) secondary education with graduation examinations (10);
(b) competence in electrical engineering qualified as "person trained,"
(c) the completion of the teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part A;
(d) professional experience in the repair and maintenance of electric power vehicles, training in the repair plant of electric power vehicles aimed at the knowledge of the design and maintenance of the vehicle and training for the technical inspection of towed railway vehicles of a duration of at least 20 weeks;
(e) driving training in the control and operation of an electric driving vehicle under supervision of at least 24 weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(2) The conditions of education and professional competence of persons to drive an electric motor vehicle on a tractor only are:
(a) secondary education with a teaching listes11) engineering, electrical, construction, transport or secondary education with a graduate examination 10);
(b) competence in electrical engineering qualified as "person trained,"
(c) the completion of the training of theoretical knowledge according to the content of the test referred to in Annex 4, Part A; the content of the test in Part 1 of the Annex is limited to the operation of the tractor;
(d) training in the repair plant of electric traction vehicles aimed at knowledge of vehicle design and maintenance of at least three weeks;
(e) driving training in the control and operation of an electric driving vehicle under supervision of at least four weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(3) The conditions of education and professional competence of persons to drive a motor propulsion vehicle on a national, regional and tug track are:
(a) secondary education with graduation examinations (10);
(b) competence in electrical engineering qualified as "person trained,"
(c) the completion of teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part B;
(d) professional experience in the repair and maintenance of motor propulsion vehicles, training in the repair plant of motor propulsion vehicles aimed at the knowledge of the design and maintenance of the vehicle and training for the technical inspection of towed train vehicles of a duration of at least 20 weeks;
(e) driving training in the steering and operation of a motor propulsion vehicle under supervision of at least 24 weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(4) The conditions of education and professional competence of persons to drive a motor-powered motor vehicle are only on a tractor;
(a) secondary education with a teaching listes11) engineering, electrical, construction, transport or secondary education with a graduate examination 10);
(b) competence in electrical engineering qualified as "person trained,"
(c) the completion of teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part B; the content of the test in Part 1 of the Annex is limited to the operation of the tractor;
(d) training at a motor propulsion vehicle repair plant aimed at knowledge of vehicle design and maintenance of at least three weeks;
(e) driving training in the steering and operation of a power-driven vehicle under supervision of at least four weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(5) The conditions of education and competence of persons to drive a steam vehicle on a national, regional and tugboat track are:
(a) secondary education with graduation examinations (10);
(b) competence in electrical engineering qualified as "person trained,"
(c) completion of teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part C;
(d) evidence of knowledge of the operator of the locomotive chop (12);
(e) experience in the operation of a locomotive boiler of at least four weeks;
(f) professional practice in the repair and maintenance of steam-powered vehicles, training in the steam-driven vehicle repair plant aimed at the knowledge of the design and maintenance of the vehicle and training to carry out a technical inspection of towed railway vehicles of a duration of at least 20 weeks;
(g) driving training in the control and operation of a steam-powered vehicle under supervision of at least 24 weeks;
(h) the examination of professional theoretical and practical knowledge before the Examination Committee.
(6) The conditions of education and professional competence of persons to drive a special driving vehicle on a national, regional and tug track are:
(a) secondary education with a teaching listes11) engineering, electrical, construction, transport or secondary education with a graduate examination 10);
(b) competence in electrical engineering qualified as "person trained,"
(c) the completion of teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part D;
(d) operator training in the special part of the propulsion vehicle, maintenance and repair of at least four weeks;
(e) driving training in the control and operation of a special propulsion vehicle under supervision of at least four weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.
(7) The conditions of education and professional competence of persons to drive a special driveline are
(a) basic education13),
(b) competence in electrical engineering qualified as "person trained,"
(c) the completion of the teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part D; the content of the test in Part 1 of the Annex is limited to the operation of the tractor;
(d) operator training in the special part of the propulsion vehicle, maintenance and repair of at least four weeks;
(e) driving training in the control and operation of a special propulsion vehicle under supervision of at least four weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee.

2. in Article 10 (1) (a):

"(3) The conditions of education and competence of persons to drive an electric driving vehicle on a special track for handling trips in a depot are
(a) secondary education with a teaching listes11) engineering, electrical, construction, transport or secondary education with a graduate examination 10);
(b) competence in electrical engineering qualified as "person trained,"
(c) the completion of the teaching of professional theoretical knowledge according to the content of the test referred to in Annex 4, Part E; the content of the test according to the Annex is limited to handling operations in the depot;
(d) training aimed at knowledge of the design, maintenance and removal of vehicle failures of at least one week;
(e) driving training under the supervision of a driving vehicle of at least two weeks;
(f) a test of professional theoretical and practical knowledge before the Examination Committee. ";
7. in Article 11 (a), the word "completed" shall be deleted;
8. in Article 11 (f), including footnote 14,
"(f) knowledge of road traffic rules (14) to the extent specified for tram drivers;

18.Paragraph 15 (1) reads as follows:
"(1) According to § 9 to 12, professional competence to drive a train is demonstrated for:
(a) the relevant type of propulsion vehicle
1. Electric DC power vehicles (E1),
2. electric AC power vehicles (E2),
3. multi-system electric traction vehicles (E3),
4. motor propulsion vehicles (M),
5. steam propulsion vehicles (P),
6. special propulsion vehicles up to and including 40 km.h-1 (SV1),
7. special propulsion vehicles with an operating speed exceeding 40 km.h-1 (SV2);
8. traction vehicles on the tram track (TR),
9. traction vehicles on the trolleybus track (TB),
(b) the type of runway or railway category concerned
1. the national, regional and tug runway (C);
2. Trawl (VL),
3rd Special Track (SP),
4. runway special only for handling trips in the depot (SP-D),
5th tram track (TR),
6. tram track only for handling operations in the depot (TR-D),
7th trolleybus (TB) runway. ';
19. In Article 15, the following paragraph 2 is inserted after paragraph 1:
"(2) According to Section 13, the professional competence to control a cableway is demonstrated for the relevant type of cableway. '
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
20.
(1) For the control of another type of traction vehicle on the same type of track or railway category, the competence shall be demonstrated by an additional examination before the test panel, from the knowledge of the design, maintenance and control of the type of traction vehicle.
(2) For the management of cableway installations of another type, the competence shall be demonstrated by an additional examination before the test panel, from the knowledge of the design, maintenance and management of the cableway.
(3) The condition for carrying out an additional test is:
(a) on a national track, on a regional track and on a tractor, training aimed at knowledge of the design, maintenance and removal of defects of a given type of propulsion vehicle of at least three weeks and driving training in driving and operating of a given type of propulsion vehicle under supervision of at least four weeks, and, in the case of an additional test to demonstrate the competence to drive a steam-powered vehicle, also evidence of the knowledge of the operator of the locomotive cute12), the practice of operating the locomotive boiler of at least four weeks, and, in the case of the operation of the electric or motor propulsion vehicle on a national, regional or on a tractor for at least one year, carried out immediately before the completion of the supplementary test;
(b) on a special training course aimed at knowledge of the design, maintenance and removal of defects of a given type of propulsion vehicle of at least one week and driving training in driving and operating of that type of propulsion vehicle under supervision of at least one week;
(c) cableway training in the management of the relevant type of cableway track (operation and maintenance of the cableway track, knowledge of ropes, detection and removal of defects, use of rescue equipment, operation of a replacement power source) of at least one week and operation of the propulsion (control) of the cableway track under supervision of at least one week. ';
21. The following Article 16a is inserted after Article 16:
(1) For the management of the same type of traction vehicle, except for the tractor, on the regional and national track, the competence shall be demonstrated by means of a differential test before the test panel, from the knowledge of the rules for the operation of the runway and the operation of railway transport and the conditions for the construction and operation of the runway.
(2) The condition for a differential test is:
(a) secondary education with graduation examinations (10);
(b) a licence to drive a particular type of traction vehicle;
(c) experience in the management of the relevant type of driveline for at least one year, carried out immediately prior to the split test;
(d) the completion of the training of theoretical knowledge according to the content of the test referred to in Annex 4, Part A, B or D, according to the type of propulsion vehicle concerned, points 1 and 2;
(e) driving training in the driving and service of the relevant type of driving vehicle on a national and regional runway under supervision of at least four weeks. ';
22.
(1) Achieving the professional competence of persons to carry out revisions or inspections and tests of relevant technical installations (16) in operation requires:
(a) secondary education with graduate examinations (10) or higher education16a) engineering, electrical, construction or transport focus;
(b) professional practice in the design, construction, manufacture, assembly, operation or repair of designated technical equipment
1. for a period of at least three years if the applicant has a higher education (16a);
2. for a period of at least five years, if the applicant has a secondary education with a graduate examination (10);
(c) training for the activity of a person who is competent to carry out revisions or inspections and tests of the relevant designated technical equipment for a period of at least three months under the supervision of a person who is competent to carry out revisions or examinations of the relevant designated technical equipment for a period of at least three years,
(d) a test of professional theoretical knowledge for the activity of a person competent to carry out revisions or inspections and tests of the relevant designated technical equipment before the examination panel; the content and expertise of the test is given in Annex 5, Part A;
(e) competence in electrical engineering with qualifications
1. "person instructed" means a person competent to carry out revisions or inspections and tests of pressure equipment, gas equipment, lifting equipment, transport equipment, containers and swap bodies, welding and defectoscopy;
2. "expert" means a person competent to carry out revisions or inspections and tests of electrical equipment.
(2) The professional competence of a person who is competent to carry out the revisions or inspections and tests of the designated technical equipment concerned, as demonstrated by the examination referred to in paragraph 1 (d), must be verified every five years by an attest examination before a panel appointed by the Technical Service. The testing test shall verify in particular the knowledge of changes to related legislation and technical standards.
(3) In order to extend the scope of the authorisation of a person qualified to carry out revisions or inspections and tests of the relevant designated technical equipment to other designated technical equipment or other activity, an additional test shall be carried out before a panel appointed by the Technical Service. The additional test shall verify in particular the knowledge of the related legislation and technical standards relating to the extension of the scope of the authorisation.
(4) Achieving competence for activities in the testing of designated technical pressure equipment under an international contract, which is bound by the Czech Republic and which has been declared in the Collection of International Agreements 16b), requires:
(a) the competence to carry out the inspections and tests of the designated pressure equipment referred to in paragraph 1;
(b) compliance with the conditions of paragraph 6.8.2.4.6 of the Regulations on the International Carriage of Dangerous Goods by Rail of Dangerous Goods (COTIF16b).
(5) The applicant shall provide evidence of compliance with the conditions referred to in paragraph 4 to the competent administrative authority.

23. in Paragraph 18 (1):
"(1) The test shall be made up of at least three members of the test committee, with at least one member of the panel holding a licence to drive the relevant type or type of track-side vehicle, if the test is from the control of the track-side vehicle, or holding a certificate of competence to carry out the revisions, inspections and tests of the relevant designated technical equipment, if the examination is by a person qualified to carry out the revisions or inspections and tests of the relevant designated technical equipment. The Railway Administration shall appoint a Examination Board and its Chairman, who shall be an employee of the Railway Administration. ';
24. in Paragraph 18 (2) (b), including footnote 16c,
"(b) he has demonstrated that he has not been convicted of a criminal offence committed by negligence relating to an activity authorised or to an offence committed intentionally, a record of the Register of Penalties and a similar document issued by the State in which he has remained continuously for more than three months in the last three years. The extract must not be more than 90 days old. The recognition of a proof of integrity issued by the competent authority of another Member State of the European Union shall be subject to the special law 16c). This extract does not need to be submitted in the supplementary test according to § 16 and the difference test according to § 16a,
16c) Act No. 18 / 2004 Coll., on the recognition of professional qualifications and other competence of nationals of Member States of the European Union and amending certain laws (Act on the Recognition of Professional Qualifications). '.
25. in Article 18 (5), the words "species" shall be inserted after the words "relevant."
26. in Paragraph 18 (5), the last sentence is deleted.
27.
(1) The person driving the railway vehicle and the person competent to carry out the revisions or inspections of the relevant designated technical equipment shall demonstrate, at the request of the person in charge of State supervision, his competence by submitting a valid licence to drive the railway vehicle or the certificate of competence to carry out the revisions or inspections and tests of the relevant designated technical equipment.
(2) The licence to drive a groove vehicle contains at least the name and surname of the holder, the date and place of birth of the holder, the photograph of the holder, the signature of the holder, the type of driving vehicle or the type of cableway for which the holder is competent, the type of track for which the holder is competent to drive the groove vehicle, the date of issue of the licence, the date of validity of the licence, the name, seat and stamp of the railway administration which issued the licence and the licence number. ';
28. Point 3 of Part A of Annex 4 reads as follows:
'3. Maintenance and control of the vehicle, vehicle structure necessary for its control and maintenance
3.1. Electric chassis drive, power systems, traction characteristics, adhesion properties, tachogram of driving, speedometers
3.2. Basic concepts of electrical engineering
3.3. Construction of electric power vehicles
3.4. Mechanical part of the vehicle, defects, diagnostics and possible disposal
3.5. Electrical part of the vehicle, defects, diagnostics and possible disposal
3.6. Pneumatic part of the vehicle, brakes, fault conditions, diagnostics and possible removal
3.7. Operation, maintenance and operational treatment of the vehicle
3.8. Vehicle control and operation technology, vehicle emergency control
3.9. Solving emergencies and dangerous situations, ecology of operation. "
29. Point 3 of Part B of Annex 4 reads as follows:
'3. Maintenance and control of the vehicle, vehicle structure necessary for its control and maintenance
3.1. Motor vehicle drive, power transmission, traction characteristics, adhesion properties, tachograph, speedometer
