of 13 April 2004
on the procedure for carrying out the classification of carcasses of animals for slaughter and the conditions for issuing certificates of professional competence for that activity
According to Article 18 (m) of Act No. 110 / 1997 Coll., on Food and Tobacco Products, and amending and supplementing certain related laws, as amended by Act No. 119 / 2000 Coll., Act No. 306 / 2000 Coll., Act No. 146 / 2002 Coll. and Act No. 274 / 2003 Coll., ("the Act '):
Basic concepts
For the purposes of this decree:
(a) by the classifier - a person meeting the conditions for the implementation of classifies1) laid down by law and by this decree, which carries out the classification of carcasses 2) of the animals for slaughter;
(b) the indication - the identification of the carcase of animals for slaughter by quality class according to the immediately binding provisions of the European Community (3) (hereinafter referred to as the "European Communities") and this decree and in accordance with the specific legislation.4)
Classification and labelling of carcases of pigs for slaughter weighing between 60 and 120 kg
(1) The classification of carcases of pigs for slaughter with a weight of 5) between 60 and 120 kg is carried out in accordance with the provisions of the European Community (6), using the standard presentation of the carcase according to the provisions of the European Community (5), the methods approved for the Czech Republic by the Regulation of the European Communities (6a) and the methods set out in Annex 6.
(2) Classification of carcases of pigs for slaughter with the taking-over weight referred to in paragraph 1 may be carried out with the production of cropping,
(a) before deboning; or
(b) after evisceration and removal of the skin from the body of the pig at slaughter after basic cuts and shortened cuts referred to in paragraph 3;
using a method suitable for this method of classification and approved in accordance with paragraph 1.
(3) The primary cuts shall be made parallel to the dorsal line at a distance of 8 to 20 cm from the nipples on the abdomen; the cut at the back of the body (cut short) shall be carried out in the lumbar landscape in such a way that the thickness of the fat can be measured including the skin above the centre of the middle buttocks. The cut in the front of the body is conducted through the shoulder parallel to the ears, at a distance of 10 to 20 cm behind the root of the ears.
(4) After the classification referred to in paragraphs 1 and 2 has been carried out, the carcase of the pig slaughter shall be marked in accordance with the rules of the European Communities. 7) When using the classification label, in addition to mandatory data (7), the classifier number shall be included on the label.
(5) The order of each cut slaughtered shall be determined by a continuous series of numbers, each per slaughter day. This number shall be marked on the carcase of each cut slaughtered and each half-carcase and shall be identical to the serial number of the carcase in the classification report.
Classification and labelling of carcases of pigs for slaughter weighing less than 60 kg and over 120 kg
(1) The carcase of pigs for slaughter weighing less than 60 kg and over 120 kg shall be classified in the quality class set out in Annex 1.
(2) After the carcase has been classified, the carcase shall be marked with the quality class referred to in paragraph 1. The marking shall be carried out in the same way as the carcass marking provided for in Section 2.
Classification and labelling of carcases of bovine animals and sheep for slaughter
(1) The classification and marking of carcases of bovine animals for slaughter or sheep for slaughter shall be carried out in accordance with the rules of the European Community (8), (9) When using the classification label, the label shall, in addition to mandatory data (8), indicate the categories of animal A, B, C, D or E9a) and the classifier number.
(2) The standard presentation according to the provisions of the European Community (9b) and the methods referred to in the European Communities (10) shall be used for the classification of the carcase of bovine animals or sheep for slaughter.
Protocol on classification and the manner and extent of communication of the results of classification
(1) The models of the classification protocols ("the Protocol") are set out in Annexes 2 to 4.
(2) The protocol processes the classifier for the whole group of slaughter animals of the same species from one supplier delivered on one day. Protocols must be numbered in such a way that for one food business operator (11) operating the slaughterhouse form a comprehensive numerical series.
(3) The food business operator operating the slaughterhouse shall send the reports on the classification of pigs for slaughter and cattle for each calendar month to the person responsible for carrying out the central livestock register no later than the fifth working day of the following month. 12) When data are transmitted in a way that allows remote data transmission, the person responsible for keeping the central livestock register shall approve the format of the data file sent.
Professional competence of natural persons to carry out the classification
Training
(1) The training of natural persons for the implementation of the classification of carcasses of slaughter animals (hereinafter referred to as "the applicant") is carried out by the Ministry of Agriculture 13) (hereinafter referred to as "the Ministry") through the Research Institute of Animal Productions Prague - Uhroneves (hereinafter referred to as the Research Institute).
(2) The applicant submits an application for training to the address of the Research Institute. The model of the application is set out in Annex 5.
(3) The research institute shall notify the applicant in writing of the time and place of training.
(4) Before training, the applicant shall receive a range of subjects to be the subject of training, including a list of recommended study literature.
(5) Training consists of theoretical lectures and practical training. In the case of training for the classification and labelling of carcasses of bovine animals for slaughter, the tenderer shall also receive practical training in slaughter operations under the guidance of an experienced classifier of at least 14 days in addition to theoretical lectures and practical training. At the end of the training, the candidate shall take a vocational examination (hereinafter referred to as "the test ') consisting of a theoretical and practical part.
Test
(1) The examination shall be carried out before a three-member examination committee (hereinafter referred to as the "Commission") appointed by the Ministry so that the chairperson is always a representative of the Ministry, the other members of the Commission being experts from the Central Audit and Examination Institute of the Agricultural and Research Institute. A written document shall be provided to the applicant for successful completion of the theoretical and practical part of the examination.
(2) The President shall direct the deliberations of the Commission and shall decide on the issues at issue relating to the examination.
(3) The Commission is bound by a set of questions and rules approved by the Ministry for the examination.
(4) If the candidate does not pass the test, the test may be repeated not earlier than 15 days after the date of the unsuccessful test.
(5) The corrective test shall only be carried out by the tenderer on the part in which he has failed. A new deadline will be set for candidates who could not attend the test or repair test for serious reasons.
Certificate of competence
(1) Certificate of professional competence issued by the Ministry on request. The application shall be accompanied by:
(a) proof of completion of the examination referred to in Article 7 (1);
(b) medical certificate, 15)
(c) proof of completed education and required practice under Section 4a (5) of the Act.
(2) The certificate of competence issued by the Ministry shall include:
(a) an indication of the method (s) for which the applicant has passed the test;
(b) a personal number.
(3) The certificate shall be valid for 5 years from the date of issue.
(4) The classifier may request the Ministry to extend the validity of the certificate.
(5) The application may be lodged not earlier than 3 months before the expiry of the certificate. The application shall be accompanied by a medical certificate and a certificate of completion of at least two courses for the classification of slaughter animals, within 5 years of the issue of the certificate of competence, at the Research Institute. A period of at least 24 months between courses must elapse.
(6) The Ministry will assess whether the conditions for issuing the certificate continue to be fulfilled and, if so, extend the validity of the certificate for a further 5 years. The application shall be decided by the Ministry within 30 days of the date of the application.
(7) Where, during the period of validity of the certificate, the classifier has lost medical fitness to carry out the classification or has interrupted the performance of the classification, it shall notify the Ministry of this fact no later than 30 days after the date on which it became aware of that fact.
Repeal
The following shall be deleted:
1. Decree No 112 / 2001 Coll., on the method of carrying out the classification of carcases of pigs for slaughter and the conditions for issuing certificates of professional competence for that activity,
2. Decree No 354 / 2001 Coll., on the method of carrying out the classification of carcasses of bovine animals and sheep for slaughter and the conditions for issuing certificates of professional competence of natural persons for that activity.
Transitional provision
(1) The methods set out in Annex 6 shall apply until approval of the methods implementing the classification referred to in Article 2 (1).
(2) An operator of a food business operating a slaughterhouse (17) with an average weekly slaughter of 200 to 400 pieces of pigs for the previous calendar year, using a two-point method on 1 May 2004 at the latest, may use this method of classification.
(3) Graduated training and, where appropriate, a completed vocational examination, according to existing legislation, by a candidate who has not yet been certified in accordance with Article 8, shall be deemed to have completed the training and, where appropriate, a completed vocational examination under this Decree.
Efficacy
This decree shall take effect on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.

Methods for grading carcases of pigs for slaughter
APARATIVE METHODS AND METHOD OF THEIR USE:
1. the method of apathy classification of probe instruments:

- the method may be used for classification under Paragraph 2 (1) of this Decree,
2. Apparative method for ultrasonic classification of instruments:
IS-D-05
- the method may be used for classification under Paragraph 2 (1) of this Decree.
Based on the input data, i.e. the thickness and depth of the muscle at the given measuring points, the following equations of the relevant classification method shall be used to determine the proportion of muscle (Y):

yISD-15, yISD-05 - the proportion of muscle in the carcase (%),
SISD - 15, SISD -05 - the thickness of the fat including the skin measured between 2 and 3 last ribs, 70 mm laterally from the cutting line; the measurement is conducted perpendicular to the hanging carcase so that on the inside of the body the distance of the measurement axis is 40 mm from the cutting line;
MISD-15, MISD-05 - muscle thickness measured between 2 and 3 last ribs, 70 mm laterally from the middle line; The measurement shall be conducted perpendicular to the hanging carcase in such a way that the distance of the axis of measurement from the line of the half-cut is 40 mm on the inside of the body.
