THE LAW
of 13 December 1988
on the competence of federal central government bodies
The socio-economic development of the Czechoslovak Socialist Republic, increasing the efficiency of the economy in the interest of a higher level of creation of material and spiritual values for the life and work of the people, and implementing a comprehensive rebuilding of the economic mechanism requires a new definition of the role of central government bodies operating at federation level and forming an integral part of the Single Executive Management Centre together with central government bodies of the Republic.
The mission of the Single Executive Management Centre is to ensure, in cooperation with all its federal and Republic components, the unity of state policy and, on the basis of the socialist economic system, the unity of economic management and social development of the Czechoslovak Socialist Republic and the proportional development of both Republics.
In order to achieve these objectives, the Federal Assembly of the Czechoslovak Socialist Republic decided on this law:
FEDERAL CENTRAL AUTHORITIES OF THE STATE GOVERNMENT, IN ITS WHOLE MEMBER OF THE GOVERNMENT OF THE CZECH SOCIALISTIC REPUBLIC
GENERAL PROVISIONS
The Federal Central Government, headed by a member of the Government of the Czechoslovak Socialist Republic (hereinafter referred to as "the Federal Ministries'), exercises the administration of the Federation in the areas entrusted to them. Their leading task is to participate in and implement the single state policy of the Czechoslovak Socialist Republic.
As part of the Single Executive Management Centre, Federal ministries are responsible for the uniform security of strategic objectives and objectives of economic and social development. The basic functions of economic and social development management apply through comprehensive state plans of economic and social development of the Czechoslovak Socialist Republic (hereinafter referred to as the "state plans'), generally binding legislation, targeted improvement of the economic mechanism and direction of economic development.
(1) Federal ministries are involved in the creation of a comprehensive forecast and the setting of long-term objectives and guidelines for scientific, technological, economic and social development in matters of nation-economic planning and the drafting of national plans.
(2) In cases provided for by law, federal ministries carry out tasks in the implementation of state plans and in the direction of economic development.
(3) Federal ministries analyse the development of the fulfilment of the objectives, objectives and proportions of the State plan in their field of competence. They shall apply and, where appropriate, propose the application of national economic governance instruments in accordance with the national five-year plan, depending on their nature, either in the performance of cross-cutting functions or in the management of the national economic sectors and complexes.
Federal ministries are involved in the formulation of financial and price policy concepts and are taking measures to safeguard them, drawing up documents for the draft federal budget and the draft price development plan, drawing up documents for proposals for financial instruments and checking compliance with financial and price discipline.
Federal ministries are involved in the creation and implementation of scientific and scientific and technological policies, including industrial rights and the concept of state investment policy, in matters of scientific, technological and investment development. They participate in the development and approval of technical standards, the conduct of state testing and the improvement of the quality of products, works and services.
Federal ministries are involved in the development of the concept of creating and protecting the environment and ensuring the conditions for its implementation.
(1) Federal ministries are involved in the creation and implementation of the concept of state employment policy, state wage policy, labour productivity and the efficient use of labour; process the supporting documents for the draft wage adjustment rules and carry out wage checks.
(2) Federal ministries are involved in the development of state social policy and take care of the development of social activities of organisations in particular in the field of safety, hygiene and health at work and the care of working conditions.
In the field of external economic relations, federal ministries participate in and implement the concept of involving sectors and disciplines in the international division of labour, in particular socialist economic integration.
(1) Federal ministries create conditions for the development of business and competition and take anti-monopoly measures.
(2) Federal ministries are the founders of state-owned enterprises, perform the functions of economic management bodies under the conditions and to the extent laid down by law and control their economic and social activities.
(3) Federal ministries establish other socialist organisations under special regulations; manage and control their activities under the conditions laid down in these Regulations.
(4) Federal ministries, as founders or, where appropriate, promoters of socialist organisations, are required to take care of the rational organisational structure of the production technical, scientific and circulatory base and of its consistency with the guidelines for the development of the national economy.
(5) Federal ministries provide information to socialist organisations on the state and intentions of the development of the economy of the sector and sectors, on the state and trends of the world economy and on social development, environmental development and the management of natural resources.
(1) Federal ministries shall monitor and evaluate the application and operation of the instruments of the economic mechanism in their field of competence and submit proposals to improve them.
(2) Federal ministries carry out controls in their field of competence as an integral part of their management, organisational and conceptual activities.
Federal ministries are in charge of the proper regulation of the Federation in their section. They are preparing draft laws of the Federal Assembly and regulations of the Government of the Czechoslovak Socialist Republic. Under the Federal Assembly's laws and within their limits, they issue generally binding legislation if they are empowered by law to do so. They shall monitor and control, within their competence, how those provisions apply, assess their effectiveness and take the necessary measures.
The Federal Ministries shall, in their responsibility, provide tasks related to the negotiation of international agreements, the development of interstate relations and international cooperation in the economic and scientific and technical fields and in other areas. Federal ministries ensure within their competence the tasks that result for the Czechoslovak Socialist Republic from international treaties as well as from membership of international organisations.
Federal ministries are responsible for defence and security tasks of the Czechoslovak Socialist Republic. To the extent provided for by law, it makes the measures necessary to safeguard the needs of the armed forces and to prepare state bodies, socialist organisations and citizens for defence. They prepare the necessary proposals and submit them to the Government of the Czechoslovak Socialist Republic or to the Council of State Defence.
(1) Federal ministries are actively involved in the performance of the tasks of the Single Executive Management Centre; in so doing, they shall cooperate closely, exchange information and supporting documents and coordinate their activities with a view to achieving a consistent, comprehensive, efficient and efficient provision of the objectives and objectives of economic and social development.
(2) Federal ministries are required to regularly inform the public of their activities.
(1) Federal ministries are required to cooperate consistently with the competent authorities of the Republics in particular in the preparation, creation and implementation of a single state economic and social policy, draft laws of the Federal Assembly and other generally binding laws, international treaties, instruments of the Economic Mechanism, measures to guide the development of the economy and other significant measures of the Government of the Czechoslovak Socialist Republic. They take advantage of their analyses, the concepts of sector development and other materials. They rely on their experience and deal with their incentives.
(2) In carrying out tasks in matters falling within the common competence of the Federation and the Republics and in providing for other important tasks of the Socialist State, the Federal Ministries are required to act in close coordination with the central government authorities of the Republics, in particular in those areas of state administration and the fulfilment of cross-cutting functions in a single management centre where such synergies are necessary for the successful realisation of the strategic objectives and objectives of the single state policy of the Czechoslovak Socialist Republic. To that end, in particular:
(a) together with the relevant central authorities of the Republic, develop draft State plans and national budgets;
(b) in cooperation with the relevant central government bodies of the Republics, develop draft concepts of financial and price policy, scientific and scientific and technological policy and state investment policy, creation and protection of the environment, state employment policies and state wage policies, social policies, agricultural and public nutrition policies and foreign trade policy in matters ensuring the fulfilment of the needs of the internal market in the Republics and the needs of the sectors managed by the Republicans;
(c) in cooperation with the relevant central authorities of the Republics, develop draft principles of state policy in the areas of implementing the fundamental functions of the Socialist State, in particular in the field of foreign policy, internal order and security of the State in matters relating to the security of the needs of the Republics;
(d) in cooperation with the relevant central government bodies of the Republics, develop draft national policy concepts for national economic complexes, sectors and disciplines in matters relating to the needs of sectors managed by the authorities of the Republics.
(3) Federal ministries shall monitor the performance of the tasks arising from the uniform application of the Federation's state policy and shall take care, in coordination with the competent authorities of the Republics, to generalise positive experience and to address any deficiencies. They shall discuss the measures to be taken in this respect.
(4) Federal ministries may require the supporting documents and other information they need for their activities from the competent authorities of the Republics. To the extent and in the manner laid down by this Act and by specific provisions, they may, in agreement with the authorities of the Republic, request supporting documents and other data from socialist and other organisations within the competence of the Republics. The Federal Ministries shall provide the competent authorities of the Republic with the supporting documents and other information necessary for their activities.
(1) In order to ensure uniform security of state policy of the Federation, federal ministries shall, in agreement with the authorities of the Republics, ensure the consistent development of those areas which fall within the competence of the Republics. Federal ministries create the conditions for coordinating the resolution of issues of common interest arising from the need for uniform security of federal state policy throughout the territory of the Czechoslovak Socialist Republic.
(2) In order to develop the single Czechoslovak economy efficiently, federal ministries shall ensure, in accordance with national plans and the needs of sectors managed by the authorities of the Republic. The single Czechoslovak economy sector, managed by the authorities of the Republics, also provides for the needs of sectors managed by federal authorities in accordance with the State plans.
(1) In the interests of uniform implementation of state policy throughout the territory of the Czechoslovak Socialist Republic, members of the Government of the Czechoslovak Socialist Republic, together with the relevant members of the Governments of the Republics, shall ensure synergies and coordination.
(2) The members of the Government of the Czechoslovak Socialist Republic discuss draft measures in the area of joint competence of the Czechoslovak Socialist Republic and both Republics before submitting them to the Government of the Czechoslovak Socialist Republic with members of the governments of the Republics, where the proposed measures affect them; If no agreement is reached, they shall inform the Government of the Czechoslovak Socialist Republic, which shall decide.
(1) Federal ministries shall inform the public of proposals for serious measures relating in particular to the standard of living, health protection, social and cultural needs of citizens.
(2) Federal ministries perform their tasks in cooperation with the Czechoslovak Academy of Sciences, use in their activities the knowledge of other scientific institutions and workplaces of the scientific research base and involve them in particular in work on solving problems of a conceptual nature.
SPECIAL PROVISIONS
Federal Ministry of Strategic Planning
The Federal Ministry of Strategic Planning is the central authority of the Czech and Slovak Federal Republic for the long-term strategy of economic and social development.
(1) The Federal Ministry of Strategic Planning, together with the Central Authorities for the National Economic Strategy of the Republics and in cooperation with the Central Authorities of the Federation and Republics, coordinates the preparation of the Economic and Social Development Strategy of the Czech and Slovak Federal Republic, draws up its proposals and presents them to the Government of the Czech and Slovak Federal Republics.
(2) The Federal Ministry of Strategic Planning in the process of preparing and developing an economic and social development strategy of the Czech and Slovak Federal Republics, in particular, draws up proposals:
(a) the basic guidelines, the material and systemic conditions of economic and social development and the state policy of structural change;
(b) the concept of scientific development and scientific and technological policy;
(c) the concept of economic defence and state security;
(d) long-term concepts for the involvement of the Czechoslovak economy in the world economy;
(e) the main objectives of living conditions and living standards of the population.
The Federal Ministry of Strategic Planning evaluates the implementation of the economic and social development strategy of the Czech and Slovak Federal Republic, as well as the measures taken to implement it and its effectiveness.
Federal Environment Committee
The Federal Committee on the Environment is the central body of the state administration of the Czech and Slovak Federal Republic for the Environment.
(1) The Federal Committee on the Environment, in close cooperation with the Central Authorities of the Republics on the Environment and other Federal Central Authorities of the State Administration and Central Authorities of the Republic, is working on a proposal for a state environmental policy and its methods of implementation. After discussion in the governments of the Republic, the proposal for this policy is submitted to the Government of the Czech and Slovak Federal Republic.
(2) The Federal Committee on the Environment, in close cooperation with the Central Authorities of the Republics on the Environment and other Central Authorities of the Federation and the Republics, the manner in which national environmental policy is implemented, in particular:
(a) propose national environmental policy implementation programmes, including selected environmental protection structures, mainly financed by the Federation budget;
(b) coordinate the national environmental information system following international agreements;
(c) encourage and support solutions to selected scientific and technical environmental problems;
(d) propose economic instruments for implementing state environmental policy.
(3) The Federal Committee on the Environment coordinates the performance of tasks in the area of spatial planning and construction rules in matters affecting both Republics or affecting the interests of neighbouring States.
(4) The Federal Committee on the Environment carries out international cooperation within the competence of the Federation and coordinates international cooperation within the competence of the Republics.
(5) The Federal Committee on the Environment is subject to state supervision of nuclear safety.
Federal Ministry of Foreign Affairs
The Federal Ministry of Foreign Affairs is the central authority of the Czechoslovak Socialist Republic for Foreign Policy.
The Federal Ministry of Foreign Affairs ensures relations between the Czechoslovak Socialist Republic and other states and international organisations. It manages, coordinates and ensures the implementation of the foreign policy of the Czechoslovak Socialist Republic. It ensures the application of the foreign policy interests of the Czechoslovak Socialist Republic in the activities of both federation and republic bodies.
Federal Ministry of Foreign Affairs
(a) to protect the rights and interests of the Czechoslovak Socialist Republic and their citizens abroad;
(b) manage Czechoslovak representative offices abroad;
(c) carry out tasks in securing contacts with foreign authorities in the Czechoslovak Socialist Republic and abroad;
d) perform the tasks of managing the assets of the Czechoslovak State abroad.
The Federal Ministry of Foreign Affairs, to the extent provided by the Government of the Czechoslovak Socialist Republic, carries out tasks in securing international contacts in matters falling within the exclusive competence of the Republics.
Federal Ministry of Foreign Affairs
(a) coordinate and, where appropriate, ensure the preparation of the negotiation and national negotiation of international agreements;
(b) ensure the declaration of international treaties by which the Czechoslovak Socialist Republic is bound;
(c) monitor compliance with and implementation of international treaties with regard to the application of foreign policy interests of the Czechoslovak Socialist Republic.
Federal Ministry of National Defence
The Federal Ministry of National Defence is the central authority of the Czechoslovak Socialist Republic for the security of defence of the Czechoslovak Socialist Republic and the authority for the management and management of the Czechoslovak People's Army and for the management of civil defence.
The Federal Ministry of National Defence is responsible for the implementation of the concept of military policy of the Czechoslovak Socialist Republic and proposes the necessary measures to the Government of the Czechoslovak Socialist Republic, the Defence Council of the State and the President of the Czechoslovak Socialist Republic as Chief Commander of the Armed Forces.
Federal Ministry of National Defence
(a) the draft principles of defence management of the Czechoslovak Socialist Republic and coordinate the activities of central authorities and socialist organisations in preparation for defence;
(b) a proposal for a comprehensive plan for the construction of the Czechoslovak People's Army;
(c) the basic tasks of preparing citizens to defend the Czechoslovak Socialist Republic and proposing measures to implement them;
(d) the concept, focus and main civil defence tasks.
Federal Ministry of National Defence
(a) manage the construction of the Czechoslovak People's Army and ensure its versatile readiness and continuous command to the troops;
(b) develop the use of the Czechoslovak People's Army in a state's security alert and manage military intelligence;
(c) ensure the integrity of the airspace of the Czechoslovak Socialist Republic and the coordination of military air traffic with civil air traffic;
(d) develop measures to safeguard the Czechoslovak People's Army with all kinds of armaments, combat technology and materials; carry out quality checks on the products intended to safeguard State defence with supplier organisations.
Federal Ministry of National Defence
(a) organise and implement measures to mobilise the Czechoslovak People's Army, to keep records of citizens subject to military obligations and to keep records of means of property which will be provided in armed readiness for the use of the armed forces of the Czechoslovak Socialist Republic;
(b) calls on the people of the Czechoslovak Socialist Republic to fulfil a military obligation and, to the extent of its competence, sets out the manner in which this obligation is to be exercised.
Federal Ministry of the Interior
The Federal Ministry of the Interior is the central authority of the Czechoslovak Socialist Republic for the field of internal order and security, unless the special law provides otherwise.
(1) The Federal Ministry of the Interior draws up a draft concept of the security policy of the Czechoslovak Socialist Republic and ensures that it is implemented within a defined scope.
(2) The Federal Ministry of the Interior manages the National Security Corps within the defined scope and is the authority for command of the Border Guard and the troops of the Ministry of Interior.
Federal Ministry of Interior for Security Policy Implementation
(a) prepare the focus of the main tasks of the National Security Corps, the Border Guard and the troops of the Ministry of Interior;
(b) prepare the principles of organisation of the National Security Corps, the Border Guard and the troops of the Ministry of Interior;
(c) lay down the principles of uniform service in the National Security Corps and ensure the development and unification of methods and means of security work;
(d) establish the principles of the political and training system of members of the National Security Corps, the Border Guard and the troops of the Ministry of Interior;
(e) provide for medical security for members of the National Security Corps, Border guards and troops of the Ministry of Interior;
(f) creates the conditions for the participation of organisations and citizens in the implementation of the security policy.
Federal Ministry of Interior proposes the Government of the Czechoslovak Socialist Republic
(a) measures for the uniform implementation of the security policy;
(b) the basic principles of organisational construction and of the overall figures of the National Security and Border Guard Corps.
The Federal Ministry of the Interior is performing the tasks of protecting the state borders of the Czechoslovak Socialist Republic.
(1) The Federal Ministry of the Interior ensures the performance of state administration in matters
(a) issuing travel documents, authorising entry into the territory of the Czechoslovak Socialist Republic and authorising the residence of foreigners;
(b) national borders, their measurement, marking, maintenance and conduct of the frontier documentary work;
(d) State symbols of the Czechoslovak Socialist Republic.
(2) The Federal Ministry of the Interior proposes legislation on the protection of state, economic and professional secrets and controls its compliance and manages and controls the cipher service methodically.
The Federal Ministry of the Interior shall ensure the prevention of the transport, import and dissemination of goods of foreign origin the content of which is contrary to the law protected by interests or infringes international treaties.
The Federal Ministry of the Interior provides a unified telecommunications network for the National Security Corps, the Border Guard and the Interior Ministry's troops.
Federal Ministry of Finance
The Federal Ministry of Finance is the central administration of the Czechoslovak Socialist Republic for Finance and Prices.
The Federal Ministry of Finance is responsible for the design and implementation of the financial and budgetary policy of the Czechoslovak Socialist Republic.
Federal Ministry of Finance
(a) develop the principles of the financial and budgetary policy of the Czechoslovak Socialist Republic for a five-year period as part of the preparation of a five-year state plan;
(b) propose to the Government of the Czechoslovak Socialist Republic the framework principles of subsidy and depreciation policy, as well as the adjustment of levies, taxes and charges to a defined extent;
(c) propose to the Government of the Czechoslovak Socialist Republic an adjustment to the method of securing the revenue of the Federation's state budget, drawing on its expenditure and relations between the Federation's state budget and the state budgets of the Republics and amending the principles of budgetary management.
(1) The Federal Ministry of Finance submits to the Government of the Czechoslovak Socialist Republic
(a) in cooperation with the State Planning Commission, a proposal for a five-year budget perspective of the Federation;
(b) the draft State Budget of the Federation;
(c) a draft federal final account.
(2) The Federal Ministry of Finance provides the Government of the Czechoslovak Socialist Republic with an overview of the five-year budget projections, state budgets and state accounts for the Czechoslovak Socialist Republic.
(3) Federal Ministry of Finance
(a) draw up a proposal for the financial part of the State plans (in relation to the aggregate financial plan);
(b) carry out financial management analyses for the Czechoslovak Socialist Republic according to the supporting documents provided by the federal authorities and authorities of the Republics to the extent agreed with the central government authorities of the Republics for Finance.
(4) Under this Act, the Federal Ministry of Finance issues generally binding legislation on the way in which the basic funds are amortised by all socialist organisations.
The Federal Ministry of Finance shall ensure the uniform implementation and application of the Federal Assembly's laws on levies and taxes, as well as the laws on charges relating to or related to the exercise of the powers of the Federation bodies.
Federal Ministry of Finance
(a) oversees the implementation of the foreign exchange monopoly of the Czechoslovak Socialist Republic;
(b) propose to the Government of the Czechoslovak Socialist Republic, in cooperation with the Federal Ministry of Foreign Trade and the Federal Ministry of Foreign Affairs, the concept and economic conditions of government loans granted and received in external relations; ensure, together with the Federal Ministry of Foreign Trade, their implementation;
c) with the Czechoslovak State Bank submit proposals to the Government of the Czechoslovak Socialist Republic for adjustments to the foreign exchange economy.
The Federal Ministry of Finance presents with the State Bank to the Czechoslovak Government of the Czechoslovak Socialist Republic draft principles for determining the rates of the Czechoslovak Crown on foreign currencies.
The Federal Ministry of Finance ensures the processing of financial, monetary and foreign exchange issues arising from the participation of the Czechoslovak Socialist Republic in the Council of Mutual Economic Assistance and prepares proposals for the procedure of the Czechoslovak delegations in the bodies of the Council of Mutual Economic Assistance on these issues.
The Federal Ministry of Finance proposes and provides, to the extent authorised by the Government of the Czechoslovak Socialist Republic, in an agreement with the Federal Ministry of Foreign Trade, the State Planning Commission, the Federal Price Office and the State Bank, the Czechoslovak Financial Economic Instruments in Foreign Trade and the method of applying financial economic relations related to the implementation of foreign trade in so far as they affect state budgets; it shall finance these relations and ensure their application in relation to organisations managed by federal authorities.
