Order of the Minister of Justice
of 20 December 1950
on rates for legal and notarial activities.
The Minister of Justice hereby orders, pursuant to § 7 (1) of Act No 322 / 1948 Coll., on Advocate General, under § 32 (1) of Act No 201 / 1949 Coll., on Notarianism, and § 138 (1) of Act No 142 / 1950 Coll., on Civil Procedure:
(1) Legal and notarial performance shall be remunerated at an official rate.
(2) The rate of performance shall not include remuneration, fixed at a rate of similar performance of the same or similar type (in the same or similar type of proceedings).
(3) In justified cases, a derogation from the rate may be granted, subject to the agreement of the respective regional association of lawyers or the respective regional notarial corps.
The remuneration shall not include and be paid in particular:
1. Expenditure on judicial fees, postal and other paid expenditure,
2. reimbursement of travel expenses connected with the performance of external work;
3. compensation for missed time
(1) The remuneration is due for the full settlement of the case entrusted to it, without distinction, if it is for performance before, before or outside the courts, the Office or the public administration. In legal and administrative proceedings, a special remuneration shall be paid for the activity in each seat.
(2) The remuneration for each performance shall be determined by a fraction of the total remuneration, depending on the workload and working time that had to be spent on such performance compared to the workload and working hours that had been spent or would have been spent in the usual course of the complete execution.
In its own case, the lawyer is entitled to a remuneration at a rate only if it relates to a matter relating to the conduct of the lawyer.
Detailed rates of remuneration, as well as cases where remuneration is not applicable, and the conditions and amount of compensation for the time missed are laid down by the Ministry of Justice and will be published in the relevant official list (§ 5 (1) of Decree No. 235 / 1949 Coll., on planning and other pricing).
(1) This Regulation shall enter into force on 1 January 1951.
(2) This Regulation shall apply to legal and notarial activities carried out after its entry into force. In cases not completed on the date on which its entry into force takes effect, the remuneration for the performance carried out from that date shall be determined in accordance with the principle set out in Article 3 (2).
