of 13 July 1949
on the acquisition and loss of Czechoslovak citizenship.
The National Assembly of the Czechoslovak Republic decided on the following Act:
Acquisition of citizenship.
I will.
(1) Citizenship may be granted at the request of persons residing in the territory of the Czechoslovak Republic for a continuous period of at least five years and, if they are not homeless, their nationality will cease to exist.
(3) Spouses may apply for citizenship in a joint application; each spouse's application shall be examined separately. Children under the age of 15 who have been joined by their father or mother in their application shall acquire citizenship with their father or mother.
Abandonment of citizenship.
Release.
(1) State citizenship shall cease to exist if the person is released from the State Union at his own request. Citizenship shall cease to exist on the date of service of the instrument of release.
(2) The spouses may apply for the release of citizenship in a joint application; each spouse's application shall be examined separately. Children under the age of 15 who have been admitted to their application by their father or mother shall cease citizenship with their father or mother.
Family members.
(1) A Czechoslovak citizen does not cease to marry a stranger or a homeless citizen.
(2) The need for citizenship with one spouse does not affect the citizenship of another spouse or children, unless otherwise provided for in this law.
Final provisions.
(1) General provisions on the acquisition and withdrawal of citizenship are no longer in force at the beginning of the Act.
In particular:
1. the provisions of § 28, the sentences of the second and § 29, 30, 31 and 32 respectively.
2. emigration patent of 24 March 1832, no 2557 sb.
3. Decrees of the Court Office governing citizenship,
4. Article L / 1879 on the acquisition and withdrawal of citizenship and Article IV / 1886 on the naturalisation of mass repatriants,
5. the provisions of Sections 2 and 3 of the Act of 9 April 1920, No. 236 Coll., supplementing and amending the existing provisions on the acquisition and renunciation of citizenship and the right to home in the Czechoslovak Republic,
6. order of the Minister of the Interior of 15 December 1926, No. 225 Coll., on the National Citizenship Card of the Czechoslovak Republic, as amended by Decree of 1 July 1928, No. 108 Coll.,
7th Act of 29 May 1947, No. 102 Coll., on the acquisition and withdrawal of Czechoslovak citizenship by marriage.
(2) This Act does not affect the Act of 29 April 1930, No 60 Coll., implementing the Convention of 16 July 1928 between Czechoslovakia and the United States of North America on naturalisation, the Act of 12 April 1946, No 74 Coll., on the granting of citizenship to countrymen returning to their country, the Act of 13 September 1946, No 179 Coll., on the granting of citizenship to countrymen from Hungary, and the Act of 28 April 1948, No 107 Coll., extending the period for applying for citizenship to countrymen returning to their country.
This Law shall take effect on 1 October 1949; It shall be implemented by the Minister for the Interior in agreement with participating members of the Government.
