on the level and method of reimbursement of the costs effectively and effectively incurred to provide information from the database of participants of publicly available electronic communications service and to provide operational and localisation data
Pursuant to Article 150 (5) of Act No. 127 / 2005 Coll., on Electronic Communications and on the amendment of certain related laws (Act on Electronic Communications), as amended by Act No. 310 / 2006 Coll., Act No. 304 / 2007 Coll., Act No. 247 / 2008 Coll., Act No. 153 / 2010 Coll., Act No. 468 / 2011 Coll., Act No. 252 / 2017 Coll., Act No. 311 / 2019 Coll., Act No. 150 / 2021 Coll., Act No. 374 / 2021 Coll., and Act No. 23 / 2025 Coll., to implement Section 97 (12) of that Act:
Amount of information costs from the participant database
The costs of providing information from the database of participants in a publicly available electronic communications service shall be reimbursed at the cost of processing the request for such information. The amount of these costs is set out in Part I of the Annex to this Order.
Amount of cost of operating and localisation data
(1) The cost of providing traffic and location data is borne out at the level of the cost of processing the request for the provision of traffic and location data. The amount of these costs is set out in Part II of the Annex to this Decree.
(2) Where the request for the provision of operational and localisation data contains several acts listed in the Annex to this Order, costs corresponding to the sum of the costs of carrying out the relevant operations shall be included in the cost accounting.
Method of reimbursement
(1) In the case of reimbursement of costs pursuant to Article 1, the person responsible for the reimbursement of costs shall send the bill to the contact point of the authorised authority which applied for information from the database of participants in the publicly available electronic communications service.
(2) In the case of reimbursement of costs pursuant to Section 2, the person responsible for the reimbursement of costs shall send the bill to the contact office of the authorised authority which applied for the provision of operational and localisation data.
(1) Cost accounting shall be issued for the calendar month.
(2) The bill of charges shall be delivered by the person to whom the costs are to be paid by the twenty-fifth day of the month following the month in which the claim for reimbursement was made pursuant to paragraphs 1 and 2. The cost accounting for November shall be delivered by the person no later than 10 December of the same year.
(3) In the justified case, the person to whom payment of costs is due may, with the agreement of the authorised authority, issue a cost accounting at a different frequency from that referred to in paragraph 1.
(4) The maturity of the cost accounting shall be 30 days from the date of its receipt.
Common provision
The amount of the costs listed in the Annex to this Order in the column "Standardised application 'shall be used only if the authorised authority submits an application in electronic form in a format enabling its automated processing and the person responsible for the reimbursement of costs uses a device enabling the automated processing of applications by the authorised authority for the provision of operational and localisation data or information from the database of participants in the publicly available electronic communications service. In other cases, the amount of the costs indicated in the column" Other applications' shall apply.
Efficacy
This Decree shall take effect on 1 July 2025.
