on the control of air-conditioning systems
The Ministry of Industry and Trade provides pursuant to § 14 (4) of Act No. 406 / 2000 Coll., on Energy Management, as amended by Act No. 177 / 2006 Coll., Act No. 165 / 2012 Coll. and Act No. 318 / 2012 Coll., for implementation of § 6a (5) of the Act:
§ 1
Subject matter
This decree implements the relevant European UnionRegulation (1) and sets out the scope, frequency and manner of the control of air-conditioning systems and the model and content of the report on these inspections.
§ 2
Scope of control of air conditioning systems
(1) Control of the air conditioning system applies to an air conditioning system which regulates the internal environment for the use of persons.
(2) Each air conditioning system shall be assessed separately regardless of the number of other air conditioning systems that are part of the building.
§ 3
Method of monitoring the air conditioning system
Control of the air conditioning system includes:
(a) evaluation of the documentation and documents of the air conditioning system;
(b) visual inspection and inspection of the operability of accessible air-conditioning system facilities;
(c) assessment of the maintenance of the air conditioning system;
(d) assessment of the air-conditioning system dimension compared to the requirements for building cooling;
(e) an assessment of the effectiveness of the air conditioning system; and
(f) recommendations on the economically feasible improvement of the existing state of the air conditioning system.
§ 4
Air-conditioning system control report
(1) The report on the control of the air conditioning system contains:
(a) identification of the building and air conditioning system;
(b) a detailed description of the building and the air conditioning system;
(c) the assessment of the air-conditioning system in accordance with Section 3;
(d) information on an energy specialist;
(e) the date of the inspection; and
(f) other information which is a scheme of air conditioning system, photo documentation carried out during inspection and a copy of the approval of the energy specialist.
(2) The model of the air-conditioning system control report is set out in Annex 1 to this Regulation.
(3) In the absence of a first check carried out under this Decree or a first check after the air conditioning system has been put into service, a cross may be provided in the parts of the report on the control of the air conditioning system referred to in paragraph 1 (a), (b) or (f), unless they have been amended since the previous check. For the assessment of the air-conditioning system dimensioning compared to the requirements for the cooling of the building which is part of the air-conditioning system assessment referred to in paragraph 1 (c), it is not necessary to repeat the assessment if the previous control has not changed the cooling consumption of the building concerned due to the measures taken. Such a report shall include a previous report on the control of the air-conditioning system, which shall contain the completed parts of the report referred to in paragraph 1.
§ 5
Frequency of air-conditioning system checks
The frequency of the checks, including the date by which the first inspection of the air conditioning system after its entry into service, is given in Annex 2 to this Decree.
§ 6
Transitional provision
Checks on air-conditioning systems carried out before the date of entry into force of this Decree shall be considered as air-conditioning systems under this Decree.
§ 7
Repeal
Decree No. 277 / 2007 Coll., on the Control of Air-Conditioning Systems, is deleted.
§ 8
Efficacy
This Decree shall take effect on 1 August 2013.

* Note: Electronic monitoring of the air conditioning system is considered to be continuous monitoring, where, in particular, energy consumption values and internal air temperature and flow parameters of the supplied and circulated air are continuously electronically transmitted to the air conditioning system control system, which evaluates them and regulates the operation of the air conditioning system.
