DECLARATION
of 13 April 2004
on the protection of animals during transport
The Ministry of Agriculture provides, pursuant to Article 29 of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended by Act No. 77 / 2004 Coll., ("the Act ') for the implementation of § 8c (2), § 8d (1), § 8e (4), § 8f, § 8g (1), § 8h (3) of the Act and in agreement with the Ministry of Transport to implement § 8k (6) of the Act and in accordance with European Community law: 1)
§ 1
Route plan
The model of the travel plan is set out in Annex 1 to this Decree.
§ 2
Training and certification of professional qualifications of the carrier transporting animals
(1) Training to obtain a certificate of professional qualification of the carrier transporting animals (hereinafter referred to as the "training course") shall take place in training centres which have been granted accreditation of the user facility by the Central Commission for Animal Protection (hereinafter referred to as the "Central Commission").
(2) The training course is held within the range of 8 teaching hours of theoretical teaching and 4 teaching hours of practical exercise.
(3) The participant in the training course is informed
(a) with basic legislation on the protection of animals and ensuring their well-being during transport, with animal health conditions under specific legislation, (2) with a procedure for the processing and control of the journey plan, with the formalities and requirements for means of transport, with their cleaning and disinfection;
(b) with requirements for the feeding and feeding of selected species of animals, with the causes and symptoms of animal stress, with the recognition of a healthy animal, with the means of killing the animals,
(c) with the principles of safety of work3) in the transport of animals, in the knowledge of technology and in the use of equipment for handling animals.
(4) At the end of the training course, its participants shall be subjected to a written test and practical examination by a three-member examination committee. In the event of failure to fulfil the test, the candidate shall be invited to an oral interview before the examination committee. Its chairman and other members shall be appointed by the Chairman of the Central Commission from the experts of the veterinary administration and training centre, one of the members of the Examination Commission shall always be the representative of the Central Commission. The members of the Examination Board shall be qualified in accordance with Section 26 of the Act, the certificate of qualification of the carrier obtained by that course or practice in the activity of the animal protection authorities for a period of three years.
(5) The test result shall be assessed as passed or failed.
(6) A report shall be drawn up by the examination panel on the course and the outcome of the examination, indicating the names and surnames of the members of the examination panel, the date and place of the examination, the list of participants in the training course and the results of their evaluation. The protocol shall be signed by all members of the examination committee. The protocol shall be registered and kept at the training centre for a minimum period of 5 years. A copy of the Protocol shall be submitted to the Central Commission.
(7) The Central Commission shall issue a certificate in the Czech language and a certificate of the person transporting the animals in the Czech and English languages to the participant of the training course that passed the examination. The model certificate of professional qualification of the carrier transporting the animals is set out in Annex 2a to this Decree. The model of the certificate of the person transporting the animals is set out in Annex 2b to this Decree.
(8) A participant in a training course who has failed to pass the examination may apply for a repeat of the examination no later than 3 months after the failed attempt.
(9) The recognition of professional qualifications or other qualifications acquired by nationals of the Czech Republic or of the Member States of the European Union or by their family members in another Member State of the European Union shall be governed by a special legislation. 4)
(10) Where the recognition body, under a special legislative provision (4), only partially recognises the professional qualifications referred to in paragraph 9, the applicant may take a difference test before the Examination Board. The object of the differential test is the legislation of the European Communities on animal protection in transport.
§ 3
Registration procedure and registration of animal carriers
(1) A natural or legal person intending to transport animals for commercial purposes over 50 km (hereinafter referred to as "the carrier transporting animals") shall submit in the registration procedure a request for registration of the carrier carrying animals, indicating the identification of the applicant, in particular the name of the company or name, registered office, id, if granted, telephone, fax, e-mail, in particular the name and surname, permanent residence, telephone, fax, e-mail.
(2) The Annex to the application is:
(a) the certificate of professional qualifications of the carrier transporting the animals in accordance with Article 2 or the certificate of the employee of the carrier or of a third party who provides transport of the animals as a guide;
(b) an extract from the Register of Penalties or, where appropriate, a similar register confirming the integrity of the carrier or the integrity of the staff member or third party in relation to the protection of animals not more than three months old; the natural person has demonstrated integrity through an extract from the Register of Penalties or documents issued by States in which he has remained continuously for more than 3 months in the last 3 years. The recognition of a proof of integrity issued by the competent authority of another Member State of the European Union shall be subject to specific legislation, 4)
(c) a declaration of equipment by means of means of transport containing the identification of the means of transport and proof of its technical competence or of proof of compliance with the approved type under specific legislation; the applicant who wishes to use means of transport by road intended for the transport of animals, together with the application shall also send a list of means of transport by road, the model of which is given in Annex 3; all types of means of transport shall be indicated below:
1. a description of the equipment and capability of the means of transport complying with the conditions of specific legislation5) and of the law identifying the species and categories of animals for which the means of transport is intended or, in the case of a container which is not a specified product under specific legislation, 5) a description specifying the total maximum weight of the selected species of animals transported, as defined in Annex 7, for each species of animals which is expected to be transported by means of the means of transport;
2. a description of the equipment of the animal supply and feeding tools, the provision of first aid for the corresponding type of animals transported, the means of immediate stunning and bleeding of the farm animal at the necessary slaughter, and where it is part of the means of transport for loading and unloading animals, or, where appropriate, the equipment for dividing the space of the animal into individual floors, their security and functionality;
3. documentation of the means of transport intended for records of the transport carried out and, in the case of transport of animals, for more than 8 hours, supporting documents for the registration of travel plans;
4. documentation of the means of transport intended for cleaning and disinfection records;
(d) a declaration of consent to the use of the information provided within the information system6) State Veterinary Administration.
(3) The Regional Veterinary Administration or the City Veterinary Administration (hereinafter referred to as the Regional Veterinary Administration) will register the carrier transporting animals if it is found that the carrier fulfils the conditions laid down in Section 8k (2) of the Act. In addition, it shall assign a veterinary approval number consisting of a country code (CZ) and a maximum of 12 digits, and shall issue it in the Czech and English languages with the registration of the carrier transporting the animals.
(4) The Regional Veterinary Administration shall immediately notify the State Veterinary Administration of the registration of the carrier transporting the animals, which shall publish a list of registered carriers within the information system. 6)
(5) The carrier shall notify the competent authority of the veterinary administration without delay of any change to the information contained in the registration sheet of the carrier transporting the animals.
(6) The model of the register of the carrier transporting the animals is set out in Annex 4 to this Decree.
§ 4
Requirements for loading equipment, water consumption and transport space
(1) The requirements for loading equipment, in particular bridges, ramps or gangways, are set out in Annex 5 to this Decree.
(2) The daily water consumption requirements for feeding animals and the indicative daily feed consumption requirements are set out in Annex 6 to this Decree.
(3) The requirements for the size of the space for the transport of selected species of animals in means of transport by type of animal and type of transport are set out in Annex 7 to this Decree.
§ 5
Specific provisions for rail transport
(1) Any railway vehicle used for the transport of animals must bear a symbol of the transport of live animals on the chassis. Where special railway wagons for the transport of animals are not available, the animals shall be transported in covered railway wagons suitable for high speeds and equipped with sufficiently large ventilation holes or a system effective even at low speeds. The inner walls of railway wagons shall be of wood or other suitable material, shall be completely smooth and shall be provided at appropriate height with bars or circles to which the animals may be attached if necessary.
(2) The animals must be loaded in such a way that the staff of the animal protection authorities supervising compliance with the obligations laid down by law and specific legislation, the consignor or the guide can move between them.
(3) The means of transport for the transport of animals which are normally tied must be the means of tying the animals. Where the loading area needs to be split, bulkheads must be used to create separate sections corresponding to the number and type of animals transported which do not prevent efficient ventilation.
§ 6
Special provisions for road transport
(1) The means of transport shall be secured against animal leakage and shall be equipped with a cover protecting the animals against weather effects.
(2) In means of transport for the transport of animals which are normally tied up, there must be equipment to bind the animals. Where the loading area needs to be split, bulkheads shall be used to form separate sections corresponding to the number and type of animals transported and to avoid effective ventilation.
§ 7
Specific provisions for shipping
(1) Animals may be transported on open decks only if they are in properly secured containers or other facilities which effectively protect the animals against the effects of the sea and weather.
(2) The animals must be bound or placed in pens or containers.
(3) Alleys allowing access to each of them must be left between the pens, containers or vehicles carrying the animals.
(4) All parts of the vessel in which the animals are transported shall be cleaned, drained and kept in good hygiene.
(5) During the voyage, facilities for killing animals approved by the competent State authority or in accordance with specific legislation shall be available. 7)
(6) Before departure, vessels transporting animals shall be supplied with sufficient drinking water if they are not equipped with equipment for its production and sufficient suitable feed. In doing so, account must be taken of the species and number of animals transported and the length of the journey.
(7) The possibility of isolation of sick or injured animals and the provision of first aid must be ensured during the voyage.
(8) Paragraphs 1 to 7 shall not apply to animals carried in railway wagons or road goods vehicles loaded on a ferry or similar vessel.
(9) If the animals are transported in road vehicles loaded on board the ship, the following measures shall be taken:
(a) the loading part must be properly attached to the vehicle. The vehicle and its loading part shall be fitted with anchorages for its fixed attachment to the vessel. In the case of carriage on covered decks, effective ventilation corresponding to the number of vehicles carried shall be ensured. The vehicle transporting the animals shall be located close to the fresh air supply;
(b) the compartment in which the animals are transported must have a sufficient number of holes for air supply or other equipment ensuring adequate ventilation. The animal transport section shall be sufficiently spacious at all levels and shall ensure efficient ventilation of the space above the animals in their natural erected position;
(c) each part of the section for the transport of animals must be accessible in order to allow the animals to be treated, fed, powered and, where necessary, modified ventilation conditions.
§ 8
Specific provisions for air transport
(1) The animals must be transported in containers or pens appropriate to the species concerned.
(2) Taking into account the type of animals transported, it is necessary, in particular, to verify, secure and prevent the animals from being exposed to extremely high and extremely low temperatures and changes in atmospheric pressure during transport in aircraft cargo areas.
(3) On aircraft transporting live animals, the competent authority shall be at the disposal of an approved establishment to kill animals corresponding to the safety of air traffic and to a specific legal act. 7)
§ 9
Special conditions for the transport of animals in containers
(1) Animals of different species must not be placed in one container.
(2) All container walls shall be provided with sufficiently large openings to ensure a constant adequate flow of air. The size of these openings shall be such that the animals cannot come into contact with persons handling the container and cannot be injured.
(3) On all walls, including the bottom and upper walls, there shall be spacing bars to ensure the air flow around the containers, even if they are set closely.
§ 10
Specific conditions for the transport of poultry and domesticated rabbits
(1) (2) containers shall be used for the transport of poultry or domesticated rabbits, including those considered to be controlled under specific legislation.
(2) Sufficient feed and water may not be available
(a) for adult animals, where it is assumed that the journey will take less than 12 hours, the loading and unloading period shall not be counted;
(b) for pups, if the journey is completed within 72 hours of their birth and if less than 24 hours are expected.
(3) The minimum size requirements for containers are set out in Annex 7 to this Decree.
§ 11
Special conditions for the transport of dogs and cats
(1) For the transport of dogs and cats, including those considered to be controlled under specific legislation2), the animals transported shall be fed at intervals of less than 24 hours and fed at intervals of less than 12 hours.
(2) The consignment must be accompanied by written instructions for feeding and drinking.
(3) The females in heat must be separated from the males.
§ 12
Specific conditions for the transport of other mammals and birds
(1) Calming agents should only be administered to animals under exceptional circumstances, under the supervision of a veterinarian. Information on the submission of these devices shall be recorded in an annex to documents accompanying the animal to its destination under specific legislation2.
(2) The transport containers shall bear the symbols of the standing position of the animals. In the case of animals which may cause human injury by biting or otherwise, this shall also be indicated by a written warning or a graphic symbol.
(3) If the consignment is not accompanied by a guide, the documentation and, as appropriate, the transport container shall be accompanied by clear written instructions for feeding, watering and special care of the animals.
(4) Individuals of animal species subject to specific legislation (8) must be accompanied by a document. They must be transported as quickly as possible to their destination.
(5) The transport must be preceded by an adequate period of preparation during which animals, if their biological characteristics and the condition of domestication so permit, are gradually placed in containers or otherwise prepared for transport.
(6) Birds must be transported in the dark.
(7) Transport containers with marine mammals shall not be built on each other and shall be so placed that the guide can access them.
(8) The transport of experimental animals is regulated by specific legislation.
§ 13
Specific conditions for the transport of cold-blooded vertebrate animals
Cold-blooded vertebrate animals, including those considered to be controlled goods under specific legislation, (2) must be transported in containers and under such conditions as are relevant to the type of compartment, ventilation, temperature and security. Individuals of animal species subject to specific legislation, (8) must be accompanied by specific documentation laying down specific conditions.
§ 14
The consignor shall, in cooperation with the carrier transporting the animals or the guide providing for the transport of the animals, discuss the arrangements for ensuring transport without undue delay, including the rotation of road vehicles drivers, in particular in the case of transport pursuant to § 12 or § 13. The competent inspection authorities, the supervisory authorities and the consignee shall inform the animals of the progress of the transport in advance and during the journey, so that they are transported as quickly as possible to the place of destination and are satisfied.
§ 15
Efficacy
This decree shall take effect on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.

4. Transport of pigs
(a) Road and rail transport
All pigs must have sufficient space to lie or stand in a natural position. In order to comply with this minimum requirement, the stocking density for pigs of approximately 100 kg should not exceed 235 kg / m2.
With regard to breed, growth and physical condition, the above minimum area requirements may be increased. In view of the weather conditions and duration of the journey, the minimum area requirements referred to above may be increased by up to 20%.
