Ministry of Industry and Trade

of 7 August 1995

determining the method and amount of compensation for the limitation of ownership rights on forest land and forest land for outdoor electricity lines and for pipelines

The Ministry of Industry and Trade pursuant to § 45 (6) of Act No 222 / 1994 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on State Energy Inspection ("the Act ') provides:

§ 1

Subject matter

This decree sets out the method and amount of compensation for the limitation of the rights of owners of forest land and forest areas pursuant to § 19 (5) of the Law and § 26 (7) of the Law.

§ 2

Method of refund

(1) A one-off refund in CZK is granted to the owner of the land and forest land

(a) premature washing of forest land on a 4 m stretch of forest land along the one side of the foundations of the support points of the external power line and 2 m in width to each side of the high pressure and very high pressure pipeline ("free lane"),

(b) failure to perform the production function in the free lane.

(2) Periodic replacement for continuous maintenance of the free lane is granted to the owner of the land once every two years of CZK 1.50 / m2 according to the maintenance actually performed.

(3) The refund shall not be granted if the maintenance of the free lane is not carried out in such a way that it is passable.

§ 3

Refunds

(1) The replacement in CZK for the early washing of the N1 forest under § 2 (1) (a) is equal to the price of the toll unmaturity calculated as the product of the price of the Ha 1 forest crop and the percentage of its toll unmaturity Mn given for each group of forest trees (2) in Annex 1 to this Decree and the total area p free lane along the electric line or above the pipeline in m2, calculated according to the following formula:

N1 = Ha.

This replacement includes removal of strains and branches from the free lane.

(2) The amount of the annual compensation in CZK for the withdrawal of the performance of the wood-producing function of the free lane N2 is equal to the product of the adjusted potential rent from the forest r listed in Annex 2 to this Decree and the total area p free lane in m2, calculated according to the following formula:

(3) The total amount of the compensation in CZK for the lifetime of the outdoor electricity or gas pipeline (hereinafter referred to as "equipment life") referred to in Paragraph 2 (1) (b) shall be determined as the product of the number of years of life of the Lz plant and the annual compensation for the withdrawal of the performance of the N2 free lane production function plus 10%, calculated according to the following formula:

N2 whole = Lz. N2.1,1

The 10% increase covers the adverse production impact of a free strip on the edge of the surrounding areas.

§ 4

Efficacy

This decree shall take effect on the day of its publication.

Explanatory notes

Data on the representation of forest crop groups on their age, grade and linkage shall be obtained from the forest economic plan, shall be verified and, where appropriate, adjusted according to the actual state of forest crop (Section 22 (2) of Act No. 61 / 1977 Coll., on Forests; Sections 2 and 3 of the ČNR Act No. 96 / 1977 Coll., on Forest Management and on the State Administration of Forestry).

A set of forest types SLT is an applied unit of the typology system of the Czech Republic bringing together forest types according to ecological affinity expressed by economically significant characteristics of the site. Forest types are drawn in forest type maps. SLT data are part of the forest economic plan of forest owners.
