THE LAW
on the acquisition and improvement of professional competence to drive motor vehicles
Parliament has decided on this law of the Czech Republic:
INTRODUCTORY PROVISIONS
Subject matter
This law implements the relevant provisions of the European Community1) and provides for
(a) conditions for the operation of driving schools;
(b) the manner in which the teaching and training of applicants for professional competence in driving a motor vehicle (hereinafter referred to as "the acquisition of a driving licence") and the rights and obligations of applicants for the acquisition of a driving licence,
(c) the rights and obligations of the driving school operators and teachers;
(d) the conditions for granting and withdrawing certificates for teachers of teaching and training (hereinafter referred to as the "professional certificate"), the test commissioner's licence and the mandate to carry out checks on drivers;
(e) the method of carrying out the tests for obtaining a driving licence;
(f) the way in which drivers are taught and trained in improving driver proficiency;
(g) requirements for and rights and obligations of a natural or legal person carrying out teaching and training in improving the professional competence of drivers;
(h) issuing a driver's professional licence;
(i) proficiency checks for motor vehicles in the spot assessment;
(j) the competence of administrative offices and State supervision.
OPERATING AUTOSCHOLS
Registration for driving school
(1) Operating a driving school means providing teaching and training to obtain a driving licence. A driving school may be operated by a legal or natural person on the basis of a trade licence issued under a special law (1a) and a registration to operate a driving school. Registration for the operation of the driving school is issued by the municipal authority of the municipality with extended scope. The competent authority shall be the municipal authority of the municipality with extended scope according to the place of establishment of the applicant. The operator of the driving school may also be the organisational component of the State which ensures the defence and security of the State (hereinafter referred to as the "organisational component of the State '). The organisation body of the State may only teach and train to obtain a driving licence and improve the professional competence of its employees and persons in the service relationship or employees and persons in the service relationship of other organisational units of the State providing State defence and security.
(2) The municipal authority of the municipality with extended scope shall issue a registration for the operation of the driving school on written request if the applicant demonstrates that:
(a) is the holder of the relevant trade licence or, where the applicant is an organisational component of the State, is the holder of the instrument of incorporation which implies that he is teaching and training to obtain a driving licence;
(b) meet the technical conditions for the operation of a driving school under this Act.
(3) If these conditions are met, the applicant shall be entitled to issue a registration for the operation of the driving school.
(1) An application for registration to operate a driving school must include:
(a) the company, registered office and legal form of the legal person and its identification number, if the applicant is a legal person, or the name, surname and permanent residence, identification number, business name and date of birth of the natural person, if the applicant is a natural person;
(b) the scope of the teaching and training provided;
(c) the name, surname, permanent residence and date of birth of natural persons who will provide education and training;
(d) the name, surname, permanent residence and date of birth of natural persons to provide medical training;
(e) how training vehicles are secured;
(f) a description and location of the car park or other training areas excluding the operation of other vehicles (hereinafter referred to as the "training area") or the driving trainer and the address and designation of the teaching and teaching areas.
(2) The application for registration to operate a driving school must be supported by:
(a) a document certifying the applicant's legal relationship to the self-training centre or to the training area or to the driving trainer, to the teaching and teaching spaces and to the training vehicles;
(b) valid professional certificates of persons who will teach and train to obtain a driving licence;
(c) a trade certificate or, where the applicant is an organisational component of the State, an establishment certificate.
(3) The documents referred to in paragraph 2 shall be presented by the applicant in certified copies or originals for inspection.
(1) In the decision to issue a registration for the operation of a driving school, the municipal authority of the municipality shall state with extended scope:
(a) a commercial firm, including legal form, registered office and identification number, in the case of a legal person, or the name and surname of the driver, date of birth, identification number, business name and permanent residence; where a responsible representative is appointed, also details of his or her person;
(b) the designation of teaching and teaching facilities;
(c) the extent of teaching and training provided;
(d) the time limit for starting the driving school;
(e) technical conditions for the operation of the driving school.
(2) If the application has been rejected, the municipal authority of the municipality with extended scope shall state in the decision the reasons for which no registration has been issued for the operation of the driving school.
(1) The operator of the driving school shall notify the municipal authority of the municipality with extended scope of all changes to the data and documents provided for in the application for registration to operate the driving school pursuant to Section 3 and provide evidence thereof within 15 days of the onset of the changes.
(2) The municipal authority of the municipality with extended application shall decide on the amendment of the data referred to in the decision following the notified amendments referred to in paragraph 1. The municipal authority of the municipality with extended scope shall issue a new registration document in the case of changes to the information referred to in § 4 (1) (a) to (c).
Withdrawal of registration for driving school operations
(1) The municipal authority of the municipality with extended scope shall decide on the withdrawal of registration for the operation of the driving school if the operator of the driving school:
(a) has repeatedly or grossly infringed the obligations laid down by, or on the basis of, this law;
(b) fails to comply with the conditions laid down in the registration for the operation of the driving school;
(c) no longer fulfils the conditions laid down in Paragraph 2 (2);
(d) request the withdrawal of the registration for driving school.
(2) The operator to whom the registration for the operation of the driving school has been withdrawn pursuant to paragraph 1 (a) or (b) may again apply to the municipal authority of the municipality with extended scope no earlier than 3 years after the decision to withdraw the registration for the operation of the driving school.
Registration to operate a driving school expires on
(a) the disappearance of a legal person holding a registration for driving school;
(b) the death of a natural person holding a registration for driving school; the continuing operation of a driving school in the death of a driving school operator is subject to special law 1a),
(c) when the decision taken by the municipal authority of the municipality with extended scope to withdraw the registration for the operation of the driving school became final.
Technical conditions for driving school operation
(1) Technical conditions for the operation of a driving school are:
(a) a driving licence or a driving licence;
(b) teaching and training facilities;
(c) teaching aids;
(d) a training vehicle.
(2) The technical conditions for self-training, training areas and teaching aids for practical maintenance are set out in Annex 1.
(1) A training vehicle may be operated in a driving school when teaching and training to obtain a driving licence,
(a) which, by its design and technical condition, complies with the requirements laid down in specific legislation (m2);
(b) which is equipped with a dual device approved in accordance with a specific regulatory provision (2) enabling the coupling and service brake control of the vehicle and, where appropriate, the accelerator; In the case of a vehicle with an automatic gearbox, a dual device for controlling the vehicle's service brake shall be sufficient; In addition, in the case of a tractor, an additional training teacher's seat shall be placed in its cabin, the location and execution of which shall be approved under the special legislation (2), in the case of a motorcycle, in addition to the dual device enabling clutch and service brake control, shall be provided with a dual control of the approved design under the special legislation (2), or an electronic device enabling the teacher to communicate with the pupil and the ignition control of the motorcycle;
(c) which is fitted with an additional interior mirror, if prescribed for that type of vehicle,
(d) which has been approved for teaching and training purposes by the municipal authority of the municipality with extended competence.
(2) The types of training vehicles for teaching, training and final testing to obtain individual categories and subcategories of driving licences and their technical conditions are set out in Annex 2.
(3) In a driving school, a vehicle may be used as a training vehicle designed for a disabled person who is not a training vehicle.
(1) A training vehicle shall be approved by the authority responsible for registration of a road motor vehicle in accordance with the Specific Act (2) for its use in driving training. The Authority shall approve the training vehicle at the written request of the vehicle operator.
(2) The application shall contain:
(a) the business name, registered office and legal form of the legal person and its identification number, if the applicant is a legal person, or the name, surname, permanent residence and date of birth of the natural person, if the applicant is a natural person;
(b) the factory mark of the vehicle,
(c) the year of manufacture of the vehicle;
(d) the vehicle registration number.
(3) The application must be accompanied by:
(a) evidence of a technical inspection of the vehicle (2), provided that a period of more than 1 year has elapsed since registration of the vehicle;
(b) by written consent from the owner of the vehicle, if the owner is not the applicant,
(c) a technical pass for the road vehicle and trailer;
(d) a certificate of registration for a road motor vehicle and trailer,
(e) documents certifying the change of the data entered.
(4) Upon approval of a training vehicle, the Authority shall record the official registration of a vehicle in a technical licence with the text "Approved as a training vehicle," and issue a new certificate of registration of a road motor and trailer in which it shall record a change in the use of the vehicle in the "Other records" section and shall label the date of the next periodic inspection and measurement of emissions on the vehicle registration plate table (2).
(5) The vehicle operator shall notify the competent authority in writing of the change of use of the vehicle before the training vehicle is withdrawn. The notification shall be supported by the written consent of the owner of the vehicle, if the owner is not the applicant.
(6) When the vehicle is withdrawn from the training, the Office shall indicate the change of use of the vehicle as specified in paragraph 4.
(1) A training vehicle with the exception of a motorcycle and a motorcycle crew shall be properly marked in the driving training and in the final test. The designation of the training vehicle shall be placed on the vehicle so that other road users can be seen on all sides and, in the case of a motorcycle crew, at a distance of at least 50 metres.
(2) The method of identification of the training vehicle by type of training vehicle, the method of identification of the motorcycle crew and the material from which the marking must be made shall be laid down in an implementing regulation.
The driver of the training vehicle shall, when using the training vehicle for his own use, remove or cover with an opaque cover the marking of the training vehicle.
COMPETENT ELIGIBILITY OF MOTOR VEHICLE RINGERS
CONDITIONS ACCEPTED TO TRAINING AND TRAINING TO ENFORCEMENT AND SPECIES OF TRAINING AND TRAINING
Conditions for admission to teaching and training
(1) Only a driving school operator may teach and train to obtain a driving licence. The driver-school operator shall, for teaching and training to obtain a driving licence, accept a person who:
(a) submit a written request; where the applicant is less than 15 years old, the application must be accompanied by the written consent of his legal representative whose signature has been verified by the competent authority;
(b) on the date of completion of teaching and training, the age prescribed for the granting of a driving licence for the group concerned in accordance with the special legislature (2a), the duration of which may not exceed 18 months from the beginning of teaching and training to the end,
(c) is not unfit for legal action;
(d) is medically fit to drive a motor vehicle in accordance with the special legislation2a);
(e) has a permanent or temporary residence in the Czech Republic;
(f) fulfil other conditions if they are required by special law 2a to obtain a driving licence;
(g) is not in the exercise of a penalty or penalty for the prohibition of driving.
(2) School pupils who have been granted a registration to operate a driving school for which the acquisition of a driving licence is a qualification condition for the pursuit of the profession for which pupils are preparing at school or for which driving is an optional (optional) subject may be included in teaching and training not earlier than two years before the age prescribed for the granting of a driving licence of the group concerned under the special legislature (2a). They may then pass the proficiency test on completion of teaching and training, even before reaching the prescribed age, with the right to be granted a driving licence after reaching it. These schools may then conduct teaching and training as an association within the meaning of § 16 (1), with the combination of the categories and subcategories of driving licences referred to in § 15 (1) being associated with group C and subgroup C1.
(3) The application for a driving licence must include:
(a) name, surname, title of applicant;
(b) the address of the permanent or temporary residence in the Czech Republic;
(c) the date and place of birth of the applicant;
(d) citizenship of the applicant;
(e) the group or subgroup of driving licences owned by the applicant;
(f) the group or subgroup of driving licences to which the applicant is requested to conduct teaching and training.
(4) The application for a driving licence shall be accompanied by evidence of the medical fitness of the applicant, which shall not be more than 3 months old at the time of the application. The medical fitness of the applicant may be documented in the application for a driving licence.
(5) The facts referred to in paragraph 1 (g) are substantiated by the applicant by a declaration of honour.
(6) The model application for a driving licence is laid down in an implementing act.
Types of teaching and training
(1) The operator of a driving school shall be entitled to provide, to the extent specified in the registration, the following types of teaching and training:
(a) basic teaching and training;
(b) associated teaching and training;
(c) expanding teaching and training;
(d) teaching and training according to the individual study plan;
(e) supplementary training and instruction.
(2) The driver-school operator shall ensure that the applicant for a driving licence obtains theoretical knowledge and practical skills by teaching and training in order to be able to:
(a) drive the vehicle in accordance with road traffic regulations;
(b) operate the vehicle in such a way that it does not create dangerous situations and adequately respond to their formation;
(c) identify operational hazards and their severity and demonstrate timely and correct response to these situations;
(d) identify technical defects in vehicles posing a safety hazard;
(e) respond to factors affecting action while driving the vehicle and retain the capabilities necessary for the safe driving of the vehicle;
(f) to provide effective first aid to injured persons in an accident.
Basic teaching and training
(1) Basic teaching and training is the preparation of the applicant for obtaining a driving licence for the relevant group or subgroup of driving licences, the scope of which is laid down in a separate law. The applicant may obtain basic teaching and training of driving licences for the following categories or subcategories of driving licences:
(a) AM Group,
(b) subgroup A1,
(c) Group A,
(d) sub-group B1,
(e) Group B,
(f) Group T.
(2) The minimum number of hours of basic teaching and training is given in Annex 3.
Joint teaching and training
(1) The combined teaching and training is the preparation of the applicant for obtaining a driving licence for a combination of two or more categories and subgroups of driving licences. The combined teaching and training may be carried out provided that the applicant fulfils the conditions laid down by special law for each category or subgroup of driving licences.
(2) An applicant for a driving licence must obtain, through combined instruction and training, such theoretical and practical knowledge as if he had received teaching and training for each category or subgroup of driving licence separately.
(3) The combined teaching and training, other than driving training, shall be carried out within the limits set by the curriculum for the maximum number of hours for the group or subgroup of driving licences in a given combination of combined teaching and training. This range of teaching hours shall be extended proportionally by the necessary number of teaching hours required for teaching and training of a topic specific to each other group or subgroup of driving licences in a given combination of combined training.
(4) Training in the driving of a vehicle shall be carried out to the extent specified for each group or subgroup of driving licences in a given combination of combined training.
Expanding teaching and training
(1) Extending teaching and training is the preparation of the applicant for the extension of the already acquired driving licence by another group, or group or subgroup, or subgroup of driving licence, as appropriate. Extended teaching and training may not be provided to an applicant who has obtained a driving licence exclusively for category AM or category T and who requests the acquisition of a driving licence for another group or subgroup of driving licences.
(2) In the context of the extension of teaching and training, a combination of expanding and combined teaching and training may be carried out in accordance with § 16.
(3) The minimum number of hours extending teaching and training is set out in Annex 3.
Teaching and training according to the individual study plan
(1) Teaching and training under an individual study plan is the preparation of the applicant for obtaining a driving licence for all categories and subcategories of driving licences, except for categories D, D + E and subgroups D1, D1 + E.
(2) Theoretical preparation shall be adopted by the applicant for a driving licence through a separate study and compulsory consultation to the extent specified in the curriculum.
(3) In the course of teaching according to the individual study plan, at least one hour of consultation shall be carried out for each four hours of teaching set out in the curriculum for the group or subgroup of driving licences. There may be a maximum of 5 pupils in the group.
(4) The scope of the training must not be less than the number of teaching hours specified in the curriculum for the group or subgroup of driving licences.
Additional teaching and training
Additional instruction and training may only be provided to an applicant for a driving licence who:
(a) he has completed teaching and training to obtain a driving licence, but he has not yet been granted a driving licence under the Special Law 2a), but no longer than the period referred to in Paragraph 39 (5) of that Law,
b) applies for an extension of the driving licence from the group A entitled to drive a motorcycle with a power limit of not more than 25 kW or a power / weight ratio of not more than 0,16 kW / kg per group A entitled to drive a motorcycle with a power ratio exceeding 25 kW or a power / weight ratio exceeding 0,16 kW / kg,
(c) requests the extension of a driving licence with a restriction on vehicles equipped with an automatic transmission to a driving licence without that restriction.
The curriculum for teaching and training applicants for driving licences
(1) The subject of teaching and training applicants for driving licences shall be the acquisition of the necessary theoretical and practical knowledge, skills and habits to drive motor vehicles on the road.
(2) Teaching contains
(a) teaching of vehicle traffic regulations;
(b) instruction on the control and maintenance of the vehicle;
(c) teaching management theory and safe driving principles;
(d) education of medical training.
(3) Training contains:
(a) training in vehicle driving;
(b) training for practical maintenance of the vehicle;
(c) practical training of medical training.
(4) The scope of teaching and training is broken down by type of teaching and training and by group or subgroup of driving licences for which the teaching and training are carried out.
(5) The content and scope of each type of teaching and training to obtain driving licences are laid down in the implementing act.
CERTIFICATE FOR THE IMPLEMENTATION OF THE TRAINING AND TRAINING
(1) Individual subjects, with the exception of the subject of medical training, may be taught by persons holding a professional certificate. The Regional Office shall decide on the issue of a professional certificate. In the professional certificate, the Regional Office shall indicate the subjects which the teacher is entitled to teach. The Regional Office shall keep a record of the professional certificates issued to the extent indicated therein. The model of professional certificate shall be laid down in an implementing act.
