DECLARATION
of 13 April 2004
on the protection of animals during breeding, public appearance or segregation
The Ministry of Agriculture provides, pursuant to Article 29 of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended by Act No. 77 / 2004 Coll., ("the Act ') for the implementation of Article 8 of the Act:
Subject matter
(1) This Decree lays down the conditions for the approval of animal protection rules at public appearance or supranational leave (1) for persons who organise public appearances or the establishment of animals and for the approval of animal protection rules for breeders' associations and organisations or entrepreneurs involved in animal husbandry and the conditions for the submission of information and documents to the staff of the surveillance bodies.
(2) This decree shall not apply to experimental animals and to breeding and dressage of wild animals carried out under specific legislation.
Application for approval of animal protection rules at the time of public appearance or withdrawal of animals and application for approval of animal protection rules for breeding
(1) The model for the application for approval of the animal protection rules for the public withdrawal or dispatch of animals is set out in Annex 1 to this Regulation.
(2) The model for the application for approval of animal protection rules for breeding is set out in Annex 2 to this Decree.
The following Annexes are an integral part of an application for the approval of animal protection rules for the public withdrawal or withdrawal of animals or an application for the approval of animal protection rules for breeding:
(a) the rules on which approval is sought, in two identical copies;
(b) the order of approval of which is proposed on the technical data medium;
(c) the power of attorney of the person empowered to represent in administrative proceedings, unless the statutory authority acts in administrative proceedings,
(d) a declaration of consent to use the information provided for the purposes of the information system of the State Veterinary Administration and of the Animal Protection Authorities.
The requirements of the animal protection rules in the public appearance or dispatch of animals
(1) The order of protection of animals in the event of public appearance or dispatch of animals contains:
(a) in the case of a breeder holding a public appearance or establishment of animals (hereinafter referred to as "the applicant"), the name and registered office of the legal person and the name, surname and permanent residence of the natural person;
(b) where the applicant is not the person who, as the organiser, is responsible for the preparation and conduct of individual public appearances or animal movements for compliance with and control of animal protection rules and for ensuring the protection and care of animals, the manner in which that person is provided for in respect of individual public appearances or animal movements; the name of the particular organiser responsible for public appearance or withdrawal for the protection of animals and their well-being shall always be indicated when submitting an application under the law and special legislation2) to the competent authority,
(c) the species and, where appropriate, the sex and age category of animals involved in the public appearance or dispatch of the animals;
(d) the manner in which animals are handled with the description and characteristics of the activities carried out with the animals in public appearance or withdrawal; in the case of dressage of animals, a detailed description of the individual exercises or tricks and environments in which they are carried out, including the way in which animals used are protected against suffering and the way in which animals are secured against leakage;
(e) the preparation, characteristics and description of the equipment, equipment, handling aids, demonstration or other activity carried out with animals, in particular in the dressage, performance tests or sports competitions involving animals, a description including the establishment of restrictions on individual species, breeds or age categories of animals in relation to the activity carried out, safety of well-being and protection of animals, in particular restrictions on the participation of lactating females and females in the second half of pregnancy; where special equipment and equipment are used, their description and manner of use which does not cause suffering to animals,
(f) the provision of well-being and protection of animals on premises where public appearances or drafts are carried out, including a description of the premises for housing, their size, equipment and safety for the protection and well-being of animals, the surface area of the premises used, the manner and frequency of daily feeding and drinking, the requirements for the security of the necessary feedingstuffs and their necessary supplies, the method of protecting the animals against suffering;
(g) the provision of well-being and protection of animals where they are moved or transported to public outlets or facilities, the type and dimensions of the equipment used, its equipment in relation to the welfare of animals, in particular the protection against damage to health, injury, pain, and, mutatis mutandis, where the loading or unloading of animals is carried out, the description of the equipment used and their equipment, the longest period during which the animals will be allowed to move outside the transport premises, unless they are provided for by law or specific legislation, 3)
(h) the method of first aid and veterinary care,
(i) the way in which persons who are actively involved in the public appearance or dispatch of animals in relation to the protection of animals and their well-being and the way in which they check compliance with the rules by the organiser;
(j) the conditions and facts under which the organiser is entitled to suspend or exclude the person who has infringed the conditions and to remove the animal from the public appearance or participation in the removal of the animals,
(k) the validity and effectiveness of the Regulations, the signature of the applicant,
(l) the stamp of the Central Commission for Animal Protection ("the Central Commission") and the signature of its statutory authority.
(2) In the event of a change in the animal protection rules in the event of a public appearance or withdrawal of animals, a new application must be submitted pursuant to § 8 (3), (6) of the Act.
Forms of animal protection rules for breeding
(1) The order of protection for animals in breeding includes:
(a) in the case of a breeder, breeders' association and an organisation or entrepreneur who submits the rules of protection of animals during breeding, if it is a legal person, name and registered office, and if the natural person is the name, surname and permanent residence;
(b) the objectives of the established animal welfare rules in relation to the protection and welfare of animals;
(c) the basic biological characteristics, known physiological and ethological requirements of the animal species by age category, or, where appropriate, by keeping the characteristics or characteristics of the animals to which the order applies;
(d) the principles for the building and operation of the objects, equipment and equipment for the breeding and care of the animal species and, where appropriate, the characteristics or description of the breeding technologies providing for those conditions, recommended systems and basic equipment for the care and well-being of the animals;
(e) the procedures laid down for the protection of the species concerned, for ensuring their health and well-being, in particular for the care of females at the stage of reproduction, for females and chicks after birth, the principles of monitoring the inheritance of health and the genetic characteristics observed;
(f) the means allowed where killing of an animal or a procedure to regulate the population is necessary;
(g) the conditions for the protection and well-being of the species in question in transport, a description of the method and equipment for transport provided that they are not provided for by law or specific legislation, 3)
(h) the validity and effectiveness of the rules on animal husbandry, the signature of the statutory body;
(i) the stamp of the Central Commission and the signature of its statutory authority.
(2) The order of protection of animals for farming or pet animals must be in accordance with the provisions of international agreements, 4) which bind the Czech Republic.
(3) Rows of animal protection in breeding are, as a general rule, revised and adapted over a five-year period according to current scientific knowledge, practical experience or recommendations of international breeding organisations and international animal protection organisations.
(4) In the event of a change in the animal protection rules for breeding, a new application must be submitted in accordance with Section 8 (7) of the Act.
(1) The order of protection of animals in the breeding of dogs, other than those referred to in Article 5 (1) and (2), contains the following conditions:
(a) the age limit for breeding animals which is:
1. for small breeds up to 50 cm of faucet height 15 months to 8 years for females, 15 months to unlimited in dogs,
2. For large breeds over 50 cm of faucet height 18 months to 8 years in bitches, 18 months to unlimited in dogs,
(b) in the case of bitches over 8 years of age, one exceptional pregnancy may be allowed if the breeder submits a certificate from the veterinarian of the examination of the animal approximately one month before the expected heat, bearing in mind that the health status of pregnancy allows for pregnancy without excessive risks;
(c) artificial insemination, which can only be performed by a person who is competent, (5) must not be used among individuals who have not previously reproduced in a natural way;
(d) during one calendar day, the breeding dog may cover only one female;
(e) the female suckling only the number of puppies corresponding to her health status as assessed by the veterinarian,
(f) the maximum number of litters for breeding female is 3 over a period of two calendar years; the ideal number is 1 litter per year; litter with only one puppy is counted as regular litter,
(g) the minimum age for taking puppies from the female is 50 days.
(2) The order of protection of animals in the production of cats, other than those referred to in § 5 (1) and (2), shall also include the following conditions:
(a) age restrictions on breeding animals in cats 1 year to 8 years of age, in cats from 1 year of age without restriction; in exceptional cases, cover may be allowed in cats from 10 months of age, provided that the breeder submits a report to the veterinarian on the overall health and somatic maturity of the particular animal;
(b) a breeding cat may be used to cover not more than two cats within 14 days;
(c) the maximum number of litters of a breeding cat is 3 over a period of two calendar years, including litters where only one cat is given birth;
(d) the cat must only breast-feed a number of kittens corresponding to its health condition as assessed by the veterinarian;
(e) the minimum age for cats is 70 days.
Provision of necessary documents and information by the animal shelter or rescue station operator
The operator of the animal shelter or rescue centre shall provide the following information and documents to the staff of the animal protection authorities supervising compliance with the law and legislation issued for its implementation:
(a) operating rules ensuring the protection of the welfare of animals and the organisation of work and working procedures laid down by specific legislation, 6)
(b) a list of the animals received, indicating the number, species, description including the identification marks, the weight, date and place of the finding of the animals or the indication of their original breeders, 7)
(c) a list of the animals issued and their new breeders, (7) including the date of transmission, the address where the animals will be kept or the places where the animals have been reintroduced into the original environment;
(d) records according to specific legislation, (2) in particular health records, inspection tests, quarantine and vaccination against rabies, documentation of treatment, preventive actions, mortality and, where appropriate, reasons for killing animals;
(e) records of animal leaks from the shelter;
(f) evidence of competence, 8)
(g) other necessary information and documents concerning the protection of animals.
Efficacy
This decree shall take effect on the day of its publication.
