amending Decree No 359 / 2016 Coll., on details to ensure the management of a radiological emergency
The State Office of Nuclear Safety sets out, pursuant to § 236 of Act No. 263 / 2016 Coll., the Atomic Act, as amended by Act No. 83 / 2025 Coll., to implement § 9 (2) (c), § 24 (7), § 25 (2) (a) to (c), § 68 (2) (j), § 69 (2) (d) and (e), § 149 (6) (d), § 153 (3), § 154 (3), § 155 (3) (a) and (b), § 156 (4) (a) to (e), § 157 (3), § 158 (3), § 211 (2) and § 220 (2) thereof:
Čl. I
Decree No 359 / 2016 Coll., on details to ensure the management of a radiological emergency, is amended as follows:
1. in Article 3 (1) (a), "(g)" is replaced by "(e)";

„§ 4
Requirements for the establishment of an emergency planning zone
[Articles 24 (7) and 149 (6) (d) of the Atomic Act]
(1) In the event that the analysis and assessment of the radiological emergency referred to in Annex 1 to this Decree shows that radiation accidents may occur on a nuclear installation or at a Category IV workplace, the applicant for authorisation pursuant to Sections 9 (1) (b) and (e) and 9 (2) (a) and (d) of the Act shall be prepared for the establishment of an emergency planning zone in the vicinity of a nuclear installation or site of Category IV, as referred to in Annex 2 to this Regulation or Annex 3 to this Decree.
(2) The documentation for determining the area of the emergency planning zone referred to in paragraph 1 shall include a design of a circular area of which:
(a) the centre S corresponds to the centre of the smallest circle, which includes the projection of the ground plan of the building with a nuclear reactor, or of all the buildings with nuclear reactors located on the site of the nuclear installation, or the projection of the ground plan of a building with a Category IV workplace, or of buildings with a Category IV workplace in one place; Model for determining the centre The area of the emergency planning zone is shown in Figure 1 of Annex 4 to this Decree; and
(b) the radius R is equal to the distance from the centre S, which defines the area where, in the event of a radiation accident, it is necessary to plan in advance the introduction of urgent protective measures for persons present in the accident on the basis of the impact analysis carried out.
(3) On the basis of the documentation for the establishment of the emergency planning zone, the Authority will establish an emergency planning zone in the vicinity of a nuclear installation or a Category IV site, taking into account urban, off-road, demographic or climatic conditions, and, where appropriate, other factors of interest in the territory. The Office shall establish an external border in such a way that it does not divide individual houses, dwellings or populated areas.
(4) The Authority will define within the area of the emergency planning zone 16 sectors of the emergency planning zone, which are the parts of the centre angle circle section covering the area of the emergency planning zone 22,5 ° so that the axes of these sections intersect on the centre S determined in accordance with paragraph 2 (a) and that the number 1 axis corresponds to the azimuth 0 °; the model of the geometric distribution of the area is set out in Figure 2 of Annex 4 to this Regulation. '
3. in Article 9 (1) (a), the words "radiation accidents or" shall be deleted;
4. In Paragraph 9 (4), the words "mass means of transport 'shall be added at the end of the text in point (e).
5. in Article 12 (4) (a) (2), "stage" is replaced by "category."
6. In Article 12 (6), the words "preparedness for response 'are replaced by" emergency exercises'.
7. In Article 12 (7), the words "including an overview of the training and emergency exercises' shall be added at the end of the first sentence.
8. In Article 14 (4), the text "C 'is deleted.
9. Paragraph 14 (5) reads:
"(5) Response preparedness shall be further documented:
(a) records of familiarisation with the approved internal emergency plan to be carried out on:
1. staff members on taking up their duties and external staff on taking up their duties with the holder of the authorisation, and at least once a year, to the extent that they are assigned,
2. persons intended to respond immediately after their designation and at least once a year to the extent appropriate to their inclusion in the management or performance of the response; the holder of the authorisation shall verify that knowledge by examination and record the test;
3. other persons located in the nuclear facility's secure area or in the workplace with sources of ionising radiation prior to their entry into the guarded area or into the workplace;
4. Neighbours within 1 month of the acquisition of legal power of the Authority's decision approving the internal emergency plan;
(b) records of the natural person's familiarisation with the intervention instruction immediately after his or her designation for the performance of the intervention under this instruction;
(c) records of the knowledge of the approved emergency plan of all persons intended to ensure the transport of radioactive or fissile substances and natural persons designated to perform the intervention that is carried out prior to the start of the shipment, to the extent appropriate to the type and nature of the management and response activities; where the emergency plan is part of an internal emergency plan, the identification shall be part of the information referred to in point (a);
(d) records of knowledge verification in education and training carried out at least once a year within the scope of Section 5; the holder of the authorisation shall verify that knowledge by examination and record the test;
(e) an annual response preparedness report, which shall include an overview of the exercises, emergency exercises and verification of the functionality of the technical means carried out for the calendar year, together with an indication of the deficiencies identified; where persons intended to carry out and manage the response are divided into response shifts, the list of exercises and emergency exercises shall include information on which training response or emergency exercises have been carried out; and
(f) evidence of contractual detention by other persons required to carry out a response to a radiation accident or a radiation accident. ';
10. in Article 15 (1) (a), the words "at least" shall be inserted after the word "at least" and the words "up to 12 years of age" shall be inserted after the words "the dosage and age of the persons who use the antidotes shall be followed by a package leaflet or, where appropriate, by a doctor's recommendation depending on the health of the person concerned,";
11. in Article 15 (1) (b), the word "at least" shall be inserted after the word "contains."
12. In Paragraph 16 (1) of the Introductory Part of the provision, the words "approved for 'are replaced by the words" intended to ensure the management of a radiological emergency at'.
13. in Article 16 (2) and (3):
"(2) Where persons intended to carry out and manage the response are divided into response shifts, the verification referred to in paragraph 1 (b) (1) and (2) shall be carried out by at least one response exchange.
(3) Verification of the intervention instructions for carrying out activities in the use of ionising radiation sources in Category II workplaces on which carotage or defectoscopic work is to be carried out with equipment containing a sealed radionuclide source shall be carried out at least once every 4 years. "
14. in Paragraph 17 (2), at the end of point (a), the word "a" is replaced by a comma.
15. In Article 17, at the end of paragraph 2, the dot is replaced by "a 'and the following point (c) is added:
"(c) intended to address a radiological emergency."
16. in Article 17 (3) (b), the word "accident" shall be replaced by the words "emergency."

„§ 18
Method and frequency of verification of effectiveness and consistency of emergency and crisis plans
[K § 156 (4) (b) and § 211 (2) of the Atomic Act]
(1) Verification of the effectiveness and consistency of the internal emergency plan and the external emergency plan must be carried out at least once over a period of 6 calendar years by jointly practicing the scenario for a radiological accident created on a nuclear installation or site of Category IV, for which the emergency planning zone is established and which is classified as Hazard Category A or B.
(2) The verification of the effectiveness and consistency of the national radiation emergency plan and emergency and crisis plans must be carried out at least once over a period of 5 calendar years by jointly practicing the scenario for radiation accidents created on a nuclear installation, a workplace with sources of ionising radiation or operating in exposure situations as referred to in Article 2 (1) (a), (b) and (d), or the scenario with the effects referred to in Article 2 (2) of this Regulation.
(3) The exercises referred to in paragraphs 1 and 2 may be carried out simultaneously on the basis of one scenario.
(4) The exercises referred to in paragraphs 1 and 2 must be evaluated and corrected for the deficiencies identified affecting the content of the internal emergency plan or the national radiation emergency plan must be implemented immediately by updating those plans. "
18. in Paragraph 25 (2) (c), the words "checking preparedness for response under Article 12 (6)" shall be replaced by "emergency exercises."
19. in Paragraph 25 (2), the word "a" shall be replaced by a comma at the end of point (e).
20. In Paragraph 25, at the end of paragraph 2, the dot is replaced by "a 'and the following point (g) is added:
"(g) records of the knowledge verification referred to in Article 14 (5) (d).";
21. in Paragraph 25 (4), "and (f)" shall be replaced by "to (g)";
22. In Annex 1, in the explanatory note, the text "1 (g) 'is replaced by" 1 (e)'.
23. In the title of Annex No 2, the word "content 'is replaced by" supporting documents'.
24. In Annex No 2 to the Introductory Part, the word "Determination 'is replaced by the words" Documentation for determination' and the word "contains' is replaced by the word" contain '.
25. in Annex 2 (a), the words "if the frequency of the occurrence of a radiation accident is less than 1 x 10- 7 / year, points (b) to (i) are not implemented and the emergency planning zone is not fixed" shall be deleted.
26. in Annex 2 (i), the words "including them in the sectors referred to in Article 4 (3)" shall be deleted;
27. In Annex 2 (j) (3), the words "and the sectors referred to in point (i) 'are deleted.
28. In Annex 2, in the explanatory notes, the text "2. (g) 'is replaced by" 2. (b)' and the last sentence is deleted.
29. In the heading of Annex 3, the words "the content of the adaptation of the emergency planning zone 'are replaced by the words" the documentation for the determination of the emergency planning zone in the event of its adaptation'.
30. In Annex 3 to the Introductory Part, the words "The adaptation of the emergency planning zone * shall be replaced by the words" The supporting documents for the establishment of the emergency planning zone in the event of its modification * shall be replaced by the words "The documentation for the determination of the emergency planning zone *."
31. In Annex 3 (c), the words "the frequency of occurrence of a radiation accident referred to in point (b) is less than 1 x 10- 7 / year 'are replaced by the words" on the basis of an impact analysis carried out in accordance with Annex 1 to this Regulation, it is concluded that it is not necessary to plan the introduction of urgent protective measures in advance'.
32. In Annex 3 (d), the words "the frequency of occurrence of a radiation accident referred to in point (b) is equal to or greater than 1 x 10- 7 / year 'are replaced by the words" on the basis of an impact analysis carried out in accordance with Annex 1 to this Regulation, it is concluded that urgent protective measures should be planned in advance'.
33. In Annex 3 (l), the words "including them in the sectors referred to in Section 4 (3) 'are deleted.
34. in Annex 3 (m) (3), the words "and the sectors referred to in (l)" shall be deleted;
35. In Annex 3, the text "1 (g) 'is replaced by" 1 (e)' and the last sentence is deleted.

This Decree shall take effect on 1 July 2025.
