THE LAW
of 25 April 2012
on the European Citizens' Initiative
Parliament has decided on this law of the Czech Republic:
Subject matter
This law regulates certain procedures and conditions for exercising the right of a citizen of a Member State of the European Union to participate in the democratic life of the European Union through a European citizens' initiative (hereinafter referred to as the 'citizens' initiative '), following the directly applicable regulation of the European Union1.
Verification of declarations of support for the citizens' initiative
The declaration of support for the citizens' initiative under the directly applicable European Union1) is verified by the Ministry of the Interior.
The Ministry of the Interior shall verify the declaration of support for the citizens' initiative and issue a confirmation to the group of organisers of the citizens' initiative in accordance with the directly applicable European Union Regulation (1) within 3 months of the date of receipt of the request of the group of organisers of the citizens' initiative.
Other activities in the civil initiative sector
The Ministry of the Interior shall carry out the tasks of the contact point providing information and assistance to groups of civil initiative organisers free of charge on the civil initiative section.
Transfers
(1) A member of the group of organisers of the citizens' initiative commits an infringement by submitting a declaration of support for the citizens' initiative under the directly applicable European Union1)
(a) although he knows that the personal data of one of the signatories in the declaration of support form of the citizens' initiative
1. are fictional, or
2. have been entered in this form by a person other than the signatory; or
(b) after signature and registration by one of the persons mentioned therein, in the form of a declaration of support for the citizens' initiative,
1. personal data; or
2. fabricated personal data.
(2) A fine may be imposed for the offence referred to in paragraph 1 until:
(a) 100 000 CZK if the offence referred to in (a) (1) is committed,
(b) 200 000 CZK if the offence referred to in (a) (2) is committed,
(c) 300 000 CZK if the offence referred to in (b) (2) is committed,
(d) 400 000 CZK if the offence referred to in (b) (1) applies.
(3) The transfers under this law are discussed at first instance by the Ministry of the Interior.
Efficacy
This Act shall take effect on the day of its publication.
