DECLARATION
Ministry of Agriculture
of 25 June 1996
implementing certain provisions of the Plant Variety, Seeds and Propagating Plant Act
According to Articles 21 (3), 22 (8), 23 (2) and 28 (6) and 28 (7) of Act No. 92 / 1996 Coll., on Varieties, Seeds and Propagating Plants ("the Act '):
§ 1
(1) The types of plants whose basic propagating material may only be put into circulation with pickled fruit are wheat, rye, triticale, barley, maize, flax and sugar beet.
(2) Certified propagating material of the species referred to in paragraph 1 need not be marinated unless the presence of harmful organisms does not exceed the values listed in Annex 2 to this Decree.
§ 2
(1) The minimum distances of the propagation crop from other crops of the same or related species which are a condition for the recognition of the crop are given in Part 3 of Annex 1 to this Decree.
(2) The requirements for pre-crops in previous years for the species concerned, the fulfilment of which is a condition for the recognition of the crop, are set out in Part 2 of Annex 1 to this Decree.
(3) The requirements for the characteristics of the propagation crops of each species, the fulfilment of which is a condition for their recognition, are set out in Part 4 of Annex 1 to this Decree.
(4) The requirements for the characteristics of propagating material of each species, the fulfilment of which is a condition for their recognition, are set out in Part 5 of Annex 1 to this Decree.
§ 3
(1) The evaluation of seed crops shall be carried out at a time when plant development is most appropriate for the assessment in terms of their decisive characteristics. Each crop shall be evaluated at least once. The frequency of evaluation by species is set out in Part 2 of Annex No 1 to this Decree.
(2) The evaluation shall be made:
(a) the overall state of the crop by assessing the uniformity, balance, involvement and fitness of the plants and, where appropriate, the degree of lodging and the expected yield;
(b) purity of the species,
(c) the authenticity and purity of the variety;
(d) perforation of the crop,
(e) the health status of the crop;
(f) the isolation of the crop by establishing whether:
1. the crop is protected against unwanted pollination by related species or other varieties, or, where appropriate, from the transmission of dangerous diseases and pests;
2. there is no risk of mechanical additions of other species or varieties which are difficult to remove from seed or seed varieties.
(3) A crop which does not comply with the requirements for the category in which it was applied for may be recognised, with the consent of the applicant, in the category which corresponds to the assessment of the crop.
(4) The crop is not recognised for the presence of quarantine harmful organisms or for the strong occurrence of other defects.
§ 4
The certification of propagating material and sampling shall be carried out as follows:
(a) before sampling, the applicant shall submit a decision on the recognition of the crop to the Central Control and Examination Institute (hereinafter referred to as "the Institute");
(b) a sample shall be taken by the authorised official from the propagating material after final treatment at a stage where it cannot be confused. For seed intended for sowing, a sample may be taken before such treatment. In this case, the Institute shall take a control sample to determine the germination capacity after soaking,
(c) basic seed may be accepted, on request, with a germination capacity of up to 10% lower than that laid down in Annex No 1, only if such seed is used for the establishment of a propagation crop;
(d) if, after recognition of any handling of propagating material which may affect its quality, the applicant submits an application for new sampling and checking,
(e) seed shall not be accepted if:
1. in its appearance, it does not correspond to purified seed, in particular if it contains removal of removable ingredients or shows characteristics which cannot be considered normal for seed;
2. contains live storage pests, except for the mite, provided that at the same time a predatory Cheyletus eruditus mite is detected in the seed in such a quantity that a maximum of 100 harmful mites are placed on one of its specimens;
3. contains quarantine harmful organisms;
(f) seed of winter cereals of a category of certified propagating material used for sowing in the year of harvest on production areas may be put into circulation before completion of the germination test carried out by the Institute. The condition is that the seed complies with the requirements laid down in Annex 1 to this Decree and the germination capacity of the seed in its natural state is at least 5% higher than that laid down in that Annex.
§ 5
(1) The list of species the basic propagating material of which may be produced for a specified number of generations from recognised basic propagating material, the maximum number of such generations and the method of labelling thereof are set out in Annexes 3 and 4 to this Decree.
(2) The list of species whose certified propagating material may be produced from certified propagating material derived directly from recognised basic propagating material, the number of generations and the manner in which it is labelled is given in Annexes 3 and 4 to this Decree.
§ 6
(1) Specific grades of basic and certified propagating material are recognised in peaches, pears, hops, apple, quinces, apricots, walnuts, slime, cherries, cherries, strawberries, gooseberries, currants, raspberries and vines.
(2) For the species referred to in paragraph 1, the specific quality classes of propagating material shall be marked as follows:
(a) viral material, if it is propagating material which has been found free from all known viruses and organisms similar to those naturally occurring within the genus on the basis of internationally recognised methods. Viruses and virus-like organisms listed in Annex 6 to this Decree are considered known,
(b) material tested for viroses, if it is propagating material found, on the basis of internationally recognised methods, free from economically significant viruses and virus-like organisms listed for each species in Annex 7 to this Decree.
§ 7
The characteristics which must have standard propagating material are set out in Annex 1 to this Decree.
§ 8
(1) The requirements for the official label of propagating material are:
(a) a label of inseparable material the size of which shall be at least 110 x 67 mm for seed and seed potatoes and at least 120 x 20 mm for bundles of plants;
(b) an adhesive label of at least the same size,
(c) printing of packages of at least the same size.
(2) The colour of the distinguishing of the official labels by category of propagating material and the models of the official labels are set out in Annex 4 to this Decree.
(3) In the case of packages which could be removed or damaged by an official label, an official label should also be inserted inside the package.
(4) The following measures shall be regarded as official insurance:
(a) seal made of uncoloured sheet,
(b) a sticker or self-adhesive tape unremovable without breaching;
(c) a sewn label for machine-sewn containers;
(d) the valve closure of the seed pressure-sealed packaging, if the packaging has no other opening, the closure shall be at least 22% of the width of the package and shall be seeds corresponding to the size of at least the seed of the wheat,
(e) self-adhesive or welding closures of paper or plastic packaging which do not have a different opening and cannot be opened without breaching;
(f) machine-stitched packaging to prevent confusion.
(5) The measures referred to in paragraph 4 shall not apply to bulk seed potatoes where the applicant demonstrates the origin of the seed by means of a delivery note and a copy of the decision to recognise the seed.
(6) The following particulars shall be used to indicate the propagating material:
(a) the treatment of seed by abrasion, incubation, packaging, in strapping strips;
(b) calibration,
(c) sorting,
(d) for coated seed, the number of seeds per unit of weight;
(e) the method of chemical treatment.
§ 9
(1) The weight or number of pieces which are considered small packages are given for each species in Annex 5 to this Decree.
(2) Small packages shall bear the particulars set out in Annex 5 to this Order.
§ 10
Transitional provisions
(1) In recognition of the crops set up before the law is in force, this decree does not apply, and in recognition of the crops of clover and grasses it has been applied since 1 January 1998.
(2) The seeds of clover and grasses prepared from pre-application crops can also be sampled from unrecognised crops, but no later than 31 December 1997.
(3) Official labels and seals used prior to the application of a law which does not comply with the requirements of this Decree may be used until 30 April 1997.
§ 11
Repeal
In the Decree of the Ministry of Agriculture, Forestry and Water Management and the Ministry of Justice No. 62 / 1964 Coll., which issues implementing regulations for the plant development law, as amended by Act No. 132 / 1989 Coll. and Decree No. 162 / 1996 Coll., Part 1 is deleted.
§ 12
Efficacy
This decree shall take effect on the day of its publication.
