of 6 September 1946
amending and supplementing the Government Decree of 7 July 1926, No 114 Coll., on the treatment of the service and pay ratios of auxiliary contractors, and extending the provisions of Sections 62 and 63 of the Staff Pragmatics (Law No 15 / 1914) to certain civil servants.
The Government of the Czechoslovak Republic hereby orders pursuant to Section 210 of the Act of 24 June 1926, No. 103 Coll., on the modification of the pay and certain service conditions of civil servants (Law of 24 June 1926):
Government Decree No. 114 / 1926 Coll. as amended by the Decree No. 19 / 1944 Coll. is amended as follows:
1. For Paragraph 41 is inserted under the title
"D. Deadly."
new § 41a) of the following wording:
"(1) For those who were left with an assistant bailiff who died in the service or who actually took a provision in accordance with § 31 to 34 until his death, or who would have received it in the event of an incapacity for earnings, he shall, under the conditions laid down in paragraphs 2 to 4 - without prejudice to other provisions of provision - be liable to death, in the event of the death of an assistant bailiff for service, a quarter of the pension base (§ 31, par. 3), otherwise a triple amount of the monthly subsistence salary of the deceased.
(2) The death toll belongs to the widow. However, if the spouses do not live in the married community, they are not a death widow, but that the spouses live separately for the sole cause of the child's upbringing, for health considerations or for economic or similar reasons that were not inherent in their personal relations.
(3) If the widow is not entitled, the death toll is first due to the married descendants who were in the care of the deceased, and if these are not, to the married descendants who paid the cost of the funeral of their own money adequate, or, if otherwise provided, treated the deceased in his last illness before death.
(4) The provisions of paragraph 3 apply mutatis mutandis to the benefit of legal heirs after a free or widowed child-free subsidiary.
(5) In all other cases, death grants may be authorised, in whole or in part, after the assistant administrator referred to in paragraph 1, to persons who have shown that they have paid the cost of the funeral or treated the deceased in his last illness before death. '
2. The heading above Paragraph 42 reads:
"E. Different provisions."
Paragraph 62 of the Staff Regulations (Act No 15 / 1914) and Article 63 of the same Act as amended by Act No 2 / 1920 Coll. applies mutatis mutandis to civil servants in the auxiliary office service covered by the Government Regulations of 7 July 1926, No 113 Coll., on the treatment of the service and pay ratios of civil servants in the auxiliary office service, as well as to auxiliary civil servants whose claims on the provision salaries are governed by the provisions of Part One, Part II, Government Regulation No. 114 / 1926 Coll., after the case of survivors of those employees.
This Regulation shall enter into force on the day of its publication; All members of the government will do it.
