DECLARATION
of 20 June 2024
on the details of the operation of certain building management information systems
According to § 333 (1) of Act No. 283 / 2021 Coll., the Act of Construction, as amended by Act No. 152 / 2023 Coll., ("the Act '), provides for the implementation of § 267 (5), § 268 (3), § 270 (3), § 271 (4) and § 273 (3) of the Act:
GENERAL PROVISIONS
Subject matter
(1) The Order provides for:
(a) the manner and conditions in which the parties are informed in accordance with Part Six of the Law and the persons concerned when issuing general measures under the law;
b) details of operation and data interface of the builder's portal,
(c) the particulars to be entered in the register of construction procedures;
(d) the method of recording operations and entering documents in the register of construction procedures, including the permissible formats;
(e) metadata belonging to an act or document;
(f) the period of retention of data in the register of construction procedures;
(g) details of the form and manner in which the project documentation and documentation are to be entered in the electronic file for the purpose of authorising the project;
(h) the management and data structure of electronic documentation records;
(i) the data structure of the electronic documentation records;
(j) the required project documentation formats;
(k) the storage period of data in the electronic documentation log and the data interface for access to it;
(l) the way in which the structures and installations are broken down for the purposes of their registration in the building identification number information system;
(m) the recorded data on construction and equipment and the method of allocating the building or installation identification number.
(2) If this decree uses the concept of building management information systems, this means the construction contractor's portal (hereinafter referred to as "the portal '), the registration of construction processes, the registration of electronic documentation, the building identification number information system and the building management information system.
NOTIFICATION OF THE INTERESTED PARTIES AND THE PERSONS CONCERNED
(1) The administrator of the building management information systems (hereinafter referred to as "the administrator") shall send the party, if requested by Part Six of the Act, information on the procedure to an e-mail address or a text message to a mobile phone.
(2) When issuing measures of a general nature under the law, the administrator shall, if so requested, send information on the procedure for proposing measures of a general nature to the person concerned at an e-mail address or a text message to a mobile phone.

Details of the portal's operation and data interface
(1) The user is logged into the web interface of the portal by showing his identity using an electronic identification device.
(2) The administrator allows at least the following:
(a) the receipt of the request and the receipt of the owner's observations of the public transport or technical infrastructure,
(b) confirmation of receipt by the owner of the public transport or technical infrastructure;
(c) access to electronic documents in the electronic file;
(d) sending information reports on the progress of the management;
(e) the submission of applications for and the insertion of electronic documentation for the project;
(f) information on the unavailability of information systems; and
(g) the connection of the civil engineering information systems and public administration information systems.
Digital operations
(1) The maximum size of the digital operation carried out through the portal into the building administration information system is 1 GB.
(2) The maximum size of the digital operation carried out through the portal to another public administration information system and towards the owner of the public transport or technical infrastructure is 100 MB.
(3) The maximum size of the digital operation referred to in paragraphs 1 and 2 shall not include the size of the electronic documentation.
EVIDENCE OF CONSTRUCTION PROCEDURES
Data on the registration of construction processes
(1) The building authority or the authority concerned shall include in the register of construction procedures at least:
(a) a unique identifier;
(b) the reference number;
(c) the date and time of service of the document, or the date of creation of the document by the construction office or the authority concerned; the date of creation of the document means the date of its registration;
(d) the details of the consignor to the extent specified for keeping the data of the consignor of the document in the name register; if it is a document created by the construction office or the institution concerned, the word "Custom 'shall be entered in the data;
(e) identification of the document from the records of the documents of the consignor, if the document is marked to it;
(f) the designation of the building office or the authority concerned which processes the document or which created the document; where the construction office or the authority concerned is designated to process or create a document by an authorised official person, the construction office or the institution concerned shall at the same time indicate its name and, where appropriate, its names and surnames;
(g) the details of the addressee to the extent specified for the keeping of the data on the addressee of the document in the name register and the date of dispatch;
(h) the file character and the shredding regime resulting from the assigned shredder mark, the shredding period, or, where applicable, the year of the inclusion of the document in the shredding procedure and any other facts determined by the construction office or authority concerned as a trigger event; and
(i) whether it is an electronic document or an analogue document.
(2) The building authority or the authority concerned shall at least enter in the register of construction procedures the details of:
(a) the type of procedure;
(b) the state of management; and
(c) the authorised official person or persons.
(3) The metadata belonging to an act or document entered in the register of construction procedures are identical to the metadata of the documents set out in the National Standard for Electronic File Service Systems.
(4) The details of the request for prior information of the authority concerned listed in Annex 1 to this Decree are entered in the register of construction procedures by the institution concerned.
(5) The information on the request for comments or the binding opinion of the authority concerned listed in Annex 2 thereto is entered in the register of construction procedures.
Means of recording operations and entering documents in the register of construction procedures
(1) The admissible formats of documents entered in the register of construction procedures are set out in Annex 3 to this decree.
(2) Documents entered into the register of construction procedures must not contain macros, scripts and other executable codes.
EVIDENCE OF ELECTRONIC DOCUMENTS
Details of the form and manner of insertion of project documentation and documentation for the authorisation of the project in the electronic file
(1) The electronic documentation and its components shall be entered in the electronic documentation log via the portal web interface or to that established portal data interface.
(2) Each drawing and each document are inserted into the electronic file as a separate file.
(3) Files entered into the electronic documentation log must not contain macros, scripts and other executable codes.
(4) The documentation processor also inserts a project documentation accompanying sheet in a machine-readable structured file in the electronic documentation log.
Required electronic documentation formats
(1) The required formats of electronic documentation and its components entered in the electronic file are set out in Annex 4 to this decree.
(2) The maximum size of the analogue drawing and document that does not need to be processed by the designer is A3.
(3) The extension of the file format inserted into the electronic file log constituting the external file format character shall at any time correspond to the data type of the file.
IDENTIFICATION NUMBER INFORMATION SYSTEM
Construction and equipment breakdown
Construction and equipment shall be broken down for registration purposes in the information system of the building identification number
(a) project-based projects that arise within the framework of the information systems of the construction administration;
(b) space-based for units and sub-areas resulting from construction; and
(c) technically and constructively for building and engineering objects, for construction and individual units and for built-in technical and technological systems and their components.
Recording of construction and installation data
The data from the application and from the accompanying sheet of the project documentation or documentation for the authorisation of the project registered in the information system of the building identification number are set out in Annex 5 to this Decree. The list of values for selected construction and installation data is set out in Annex 6 to this decree.
Allocation of construction or installation identification number
(1) Where the construction or installation is not assigned a building identification number, the construction office or the authority concerned shall assign the building identification number to the construction works and installations through the building management information system in the register of the building identification number information system.
(2) In the case of the allocation of a duplicate identification number or where several building or installation identification numbers have been assigned, the construction office or the authority concerned shall determine under which building or installation identification number the construction or installation shall be kept in the register of the building identification number information system and shall record it in the registration of the building identification system.
(3) The construction office or authority concerned shall, without undue delay, invalidate the building identification number or equipment which has ceased to exist or has been merged with another construction or installation.
FINAL PROVISIONS
Time of storage of data and documents in building management information systems
(1) The period of retention of the data and the closed files, documents and documents attached thereto shall be governed by the rules of the file issued by the controller.
(2) The time limit for the data and documents attached thereto shall run from the date of removal of the construction or installation to which the data, documents and documentation were linked.
EFFECTIVE
This Decree shall take effect on 1 July 2024.
