DECLARATION

amending Decree of the Ministry of the Environment of the Czech Republic No. 395 / 1992 Coll., implementing certain provisions of the Czech National Council Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended
The Ministry of the Environment provides pursuant to § 81 (10) and § 90 (5), (6) and (7) of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 238 / 1999 Coll.:
Decree No. 395 / 1992 Coll., implementing certain provisions of the Czech National Council Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Decree No. 105 / 1997 Coll., No. 200 / 1999 Coll. and No. 85 / 2000 Coll., is amended as follows:
1. In Paragraph 10 (7), the words "three months before the basic examination for the design of the processing of the forestry economic plan (8) 'are replaced by the words, including footnote 8):" or the forest economic curriculum in the time limit set by the State administration of the lesse8).
8) Paragraph 26 (3) of Act No. 289 / 1995 Coll., on Forests and on the amendment and addition of certain laws (Forest Act). "
2. In Articles 10 (8) and 12 (2), the words "Czech Nature Protection Institute 'are replaced by the words" Czech Nature Conservation Agency'.
3. Paragraph 20 (2) reads as follows:
"(2) The Nature Protection Authority shall equip the guardian with an identifiable official stamp which the guardian is obliged to return when his office is terminated. Details of the performance of the service badge, licence and official stamp are given in Annex IV. ';
4. The first sentence of Paragraph 20 (5) reads: "In order to verify the knowledge of the rights and obligations of nature guards under Section 81 (3) (f) of the Act, the competent nature conservation authority shall organise qualification examinations." At the end of this paragraph, the following sentence is added: "Knowledge of the rights and obligations of the rapporteur under § 81 (3) (f) of the Act shall be verified by the competent nature protection13) by an oral interview with the applicant."
Footnote 13) reads as follows:
"13) Sections 77 and 78 of Act No. 114 / 1992 Coll. '.
5. In the second sentence of Paragraph 20 (12), "paragraph 3 'is replaced by" Paragraph 81 (3) of the Act'.
6. in Article 20, paragraphs 3, 4, 8, 9, 10 and 11, including footnote 13, are deleted;
Paragraphs 5, 6, 7 and 12 shall become paragraphs 3, 4, 5 and 6.
7. In Annex IV, in the part "Type II. Guard's service card ', in the fourth paragraph, the dot at the end is replaced by a comma and the following text is added:
"- detain the person caught in violation of the legislation on nature and landscape protection to establish his identity and surrender it to the authority of the Czech Police Department; persons caught are obliged to obey,
- to require assistance or cooperation from the authorities of the Czech Police or municipal police, if they are unable to carry out their duties by themselves and by means. "
8. Annex V is amended as follows:
(a) For the entry "Bohemian Peat" under the heading "Catastral territory" the word "Rice house" shall be replaced by the word "rice house."
(b) For the entry "Brousek's Mill" under the heading "Catastral territory" the word "Court" shall be replaced by the word "Court."
(c) For the entry "Black and Black Lake" under the heading "Catastral territory" the words "Iron Ruda II" shall be replaced by the words "Elizabeth."
(d) For the entry "Red Blato" under the heading "Catastral territory" the word "Bynov" is replaced by the word "Byňov."
(e) the entry "Donor - Radostín peat" is replaced by the following:

(h) The entry "Polar ponds - Slanisko Nesyt 'is replaced by the following:

(j) For the entry "Lovoš" under the heading "Catastral territory" the word "Oparno" shall be replaced by "Oparno."
(k) the following entry "Small and Large Shield" is inserted after the entry "Lovoš":

(t) For the entry "Salajka ', the abbreviation" MK' shall be replaced by the abbreviation "MŠK 'under the heading" Established'.
(u) the following entry "Slanisko u Nesyt 'is inserted after the entry" Seat':

(bbb) The following entries "In the ponds' and" Gardens under the Háj 'are deleted in the section provided for in the sentence "To the category" Natural reserves'.
This decree shall take effect on the day of its publication.
