THE LAW
of 17 June 1993
amending and supplementing Act No. 29 / 1984 Coll., on the System of Primary and Secondary Schools (School Act), as amended by Act No. 188 / 1988 Coll., Act No. 171 / 1990 Coll., Act No. 522 / 1990 Coll. and Act No. 134 / 1993 Coll., Act No. 564 / 1990 Coll., on State Administration and Self-Government in Education, and Act No. 76 / 1978 Coll., on School Equipment, as amended by Act No. 31 / 1984 Coll.
Parliament has decided on this law of the Czech Republic:
In Paragraph 4 (1), the sentence "Education and education are free of charge. 'is replaced by the sentence" In schools which are part of a system of primary and secondary schools, citizens are entitled to free education.'
The Act of the Czech National Council No. 564 / 1990 Coll., on State Administration and Self-Government in Education, is amended as follows:
1. In Paragraph 14 (2), the following sentence is added at the end: "Where a child carries out compulsory schooling in a school set up by another municipality, the municipality in which the child resides shall agree with that municipality on the conditions for compulsory schooling. In such a case, the municipality in which the child resides shall pay the municipality in which the child performs compulsory schooling its non-investment costs for the child. '
2. Paragraph 14 (3) is replaced by a comma at the end and the words "unless otherwise provided for by this law 'are added.
3. the following Part Five is inserted after Part Four:
CONTRIBUTION TO THE PARTIAL REIMBURSEMENT OF THE NON-INVESTMENT COSTS OF THE MOTHER SCHOOL, SCHOOL SPECIES AND SCHOOL CLUB
The municipality may, under the conditions laid down by this Law, collect a contribution for the partial reimbursement of non-investment costs of parent schools, school satellites and school clubs (hereinafter referred to as "costs'). The allowance shall be paid by the parents of the child or other legal representatives (hereinafter referred to as" the payer ').
(1) The allowance provided for in Paragraph 19a shall be paid to a municipality which establishes a parent school or a school club or a school club for an account always set up for a parent school or a school club.
(2) The municipality shall make use of a contribution to cover part of the costs of the relevant parent school, school cooperative or school club. If the contribution is used for workers' wages and teaching aids, the municipality will refer it to the School Office.
(1) The obligation to pay the contribution under Paragraph 19a, its amount and its maturity shall be governed by a general binding decree.
(2) The amount of the allowance shall be determined by the municipality after consultation with the School Office in such a way that it does not exceed 30% of the costs incurred per child.
(3) In the event that the contribution is not paid in time or at the correct amount, the municipality may provide in the order issued pursuant to paragraph 1 that the payer pays the periodic penalty payment. The amount of the periodic penalty payment may not exceed the amount of the contribution due.
(1) The allowance provided for in Paragraph 19a shall not be paid if, after payment of the allowance, the sum of the income of the members of the household in which the child lives falls below 1,25 times the amount needed to ensure nutrition and other basic personal needs.4)
(2) In exceptional cases, the municipality may exempt the payer from paying the contribution in whole or in part, normally for one year.
The provisions of Sections 19a to 19d do not apply to private and church preschool facilities, school cooperatives and school clubs.
3) § 3 (2) of Act No. 463 / 1991 Coll., on Life Minimum. § 1 of Decree No. 81 / 1993 Coll., which increases the amount of the life minimum.
4) § 3 (3) of Act No. 463 / 1991 Coll. § 2 of Government Decree No. 81 / 1993 Coll. '
4. Parts five and six shall be referred to as Parts six and seven.
The Act of the Czech National Council No. 76 / 1978 Coll., on school establishments, as amended by the Act of the Czech National Council No. 31 / 1984 Coll. and the Act of the Czech National Council No. 390 / 1991 Coll., is amended as follows:
1. In Article 3, the following paragraph 7 is inserted after paragraph 6:
"(7) A kindergarten can set up interest groups. Activities in interest groups can also be attended by children who do not attend kindergarten. Interest ring activities may be carried out in return for payment. The remuneration shall be used for the partial reimbursement of the non-investment costs of the parent school. ';
2. In Paragraph 20 (1), the words "interest activities' shall be inserted after the word" education '.
3. In Paragraph 20, the following paragraph 2 is added:
"(2) A school satellite or a school club may set up interest rings. Under local conditions, pupils who are not enrolled in a school club or a school club may participate. Activities in interest circles may be carried out against payment. The remuneration shall be used for partial reimbursement of non-investment costs. ';
Paragraph 2 shall become paragraph 3.
4. The following Paragraph 45a is inserted after Paragraph 45, which includes footnote 5:
Special Act 5) lays down the conditions under which the parents of children or their legal representatives are required to contribute to the partial reimbursement of the costs of the maternity school.
5) Sections 19a to 19d of Act No. 564 / 1990 Coll., on State Administration and Self-Government in Education, as amended by Act No. 190 / 1993 Coll. '.
This Act shall take effect on the day of its publication.
