DECLARATION
Federal Ministry of Transport and Communications
of 11 October 1988
fixing the fixed amounts of compensation for small failures in the operation of the train on national railways and tugs
The Federal Ministry of Transport and Communications provides in the agreement with the participating central authorities pursuant to § 8 (2) and § 29 of Act No. 51 / 1964 Coll., on Railways:
Organisations which, by their activities (e.g. investment, maintenance or repair work, in the construction and reconstruction of communications or in the line of operation, by inserting bridge commissions) and citizens who, by their actions (e.g. by failing to alert on a level crossing, damage to a level crossing device, entry or entry into a cross-section), cause a minor failure in the operation of a single train on a national rail or train, by extending its journey time between stations by no more than 92 minutes, or by stopping or stalling an individual train in a station, stop or on a line by no longer than 180 minutes, are obliged to provide compensation to the train undertaking in fixed parts pursuant to § 2 or § 3.
The amount of compensation for the extension of the journey time of an individual train shall be determined in accordance with the Annex which forms part of this Regulation. (2)
The amount of compensation for stopping or stalling a single train shall be 396 Kčs for the first and only start of 5 minutes and 82 Kčs.2 for each additional start of 5 minutes)

This Decree shall take effect on 1 January 1989.

1) An organisation which establishes and operates a runway (§ 6 (1) of the Railway Act).
2) When the journey time of an individual train is extended by more than 92 minutes and when the individual train is stopped or delayed by more than 180 minutes, the generally mandatory legislation shall be followed.
