DECLARATION
of 11 January 2021
amending Decree No. 246 / 2001 Coll., laying down conditions for fire safety and performance of state fire control (Fire Prevention Order), as amended by Decree No. 221 / 2014 Coll.
According to Section 101 (a) of Act No. 133 / 1985 Coll., on Fire Protection, as amended by Act No. 203 / 1994 Coll., Act No. 237 / 2000 Coll., Act No. 320 / 2015 Coll. and Act No. 229 / 2016 Coll., ("the Act '), the Ministry of Interior provides for the implementation of Act No. 6c of the Act:
Decree No. 246 / 2001 Coll., on the establishment of conditions for fire safety and performance of state fire control (Fire Prevention Order), as amended by Decree No. 221 / 2014 Coll., is amended as follows:
1. In Section 7, at the end of paragraph 4, the sentence "For an object listed in Annex 6 and subject to the conditions laid down in this Annex, a check shall be carried out on the operation of a fire safety device within the scope laid down by the legislation, the normative requirements (13) and accompanying documentation of its manufacturer at least once every 20 months, unless the manufacturer provides for a shorter period. ';
2. The following Annex 6 is added:

The exemption provided for in Paragraph 7 (4) second sentence may be applied subject to the following conditions:
(a) the exemption applies to fire safety equipment which is not accessible for operational or safety reasons and a physical check of the operation cannot be carried out otherwise;
(b) the exemption may be applied to a fire safety device or part thereof where the performance of an operational check is physically feasible; and
(c) the nuclear operator shall keep records of the installations referred to in (b) for which this derogation is applied; Part of the register shall be the agreement of the manufacturer of the fire safety equipment to operate the equipment under the conditions of the exemption applied.

Efficacy
This Decree shall take effect on 1 February 2021.
