DECLARATION
of 31 January 2018
amending Decree No 342 / 2012 Coll., on animal health and protection, on movements and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities, as amended
The Ministry of Agriculture provides pursuant to Article 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 182 / 2008 Coll., Act No. 227 / 2009 Coll., Act No. 308 / 2011 Coll., Act No. 359 / 2012 Coll., Act No. 279 / 2013 Coll., Act No. 264 / 2014 Coll., Act No. 139 / 2014 Coll., Act No. 250 / 2014 Coll., and Act No. 302 / 2017 Coll., for the implementation of § 42 (10), § 59 (6), § 64b and § 64c (b).
Čl. I
Decree No 342 / 2012 Coll., on animal health and protection, on the movement and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities, as amended by Decree No 429 / 2013 Coll., Decree No 313 / 2014 Coll. and Decree No 164 / 2016 Coll., is amended as follows:
1. in § 1 (h) and § 27, first sentence, the words "without master animals" shall be inserted after the word "catch."
2. In Article 1 (p), at the end of the text, the word "a 'is deleted.
3. In Article 1, at the end of point (q), the dot is replaced by a comma and the following points (r) to (v) are added:
"(r) professional veterinary activities carried out by livestock farmers, their list and details of their implementation by livestock farmers,
(s) details of the performance of the veterinary professional tasks of injecting medicinal products in livestock by the livestock farmer;
(t) other professional activities carried out by livestock farmers, their list and details of their implementation by authorised livestock farmers;
(u) the content, scope and organisation of specialised professional training with a view to carrying out other professional veterinary tasks, the manner and organisation of the verification of knowledge acquired, the certification and the keeping of a list of persons who have completed such specialised professional training; and
(v) the content, scope and organisation of specialised training with a focus on the inspection of hives with the dismantling of the bee work, certification and the keeping of a list of peers. ';
4. In Paragraph 18 (d), the word "healthy 'is deleted.
5. Paragraph 20 (4) is deleted.
6. The title above § 27 reads:
"Professional courses for catching and handling animals without master, stray and abandoned animals, including in animal shelters, and for the collection and disposal of pet carcases
(Paragraph 42 (10) of the Law) '.
7. In Articles 35 (4) and 38 (4), "at least 5 years' is replaced by" the validity of the certificate issued '.
8. The following Sections 39a to 39i are inserted after Section 39:
„§ 39a
Professional veterinary activities carried out by livestock farmers
(K § 64b (1) of the Act)
(1) The livestock farmer is authorised to carry out:
(a) listening and palpitations;
(b) body temperature measurements;
(c) examination of birth routes intravaginally at the time of birth with normal course,
(d) keeping livestock under normal delivery;
(e) non-invasive sampling for laboratory testing, in particular milk, urine for spontaneous urination, faeces for fainting;
(f) by a probe to the bunker; and
(g) non-invasive veterinary acts which may be carried out without numbness if the aim is to prevent damage to health, maintain and improve the health of livestock.
(2) The professional veterinary activities referred to in paragraph 1 shall be carried out by the livestock farmer in compliance with principles and procedures ensuring prevention against pollution and transmission of micro-organisms, biosecurity principles and safety of work.
§ 39b
Details of the performance of the veterinary professional tasks of injecting medicinal products in livestock to livestock farmers
(K § 64b (2) of the Act)
(1) Breeders of livestock are entitled to inject medicines if:
(a) has received instructions from the treating veterinarian for the injection of medicines,
(b) the treating veterinarian has established a diagnosis,
(c) has been instructed by the treating veterinarian on the route of administration, indication, dosage, time of administration of the medicinal products, contraindication, negative effects, withdrawal period and target species; and
(d) has been instructed by the treating veterinarian to store the medicines.
(2) When injecting medicinal products, the breeder shall comply with the principles and procedures ensuring prevention against pollution and transmission of micro-organisms, the principle of safe and effective administration of the medicinal product, the protection of animals and animal and animal husbandry, diseases communicable from animals to humans, other diseases and principles of occupational safety.
§ 39c
Other professional veterinary activities carried out by livestock farmers for which a certificate of professional competence is required
(K § 64b (3) of the Act)
(1) The livestock farmer who has obtained a certificate of competence is entitled to carry out:
(a) castration of male animals under 7 days of age in pigs and under 8 weeks of age in bovine, ovine, caprine or rabbit not suffering from an anatomical defect in sex organs;
(b) tail shortening in piglets under 7 days and lambs under 8 days,
(c) defrosting or controlling the growth of horns in calves and kids aged up to 4 weeks by chemical cauterization, heat cauterisation by an apparatus which develops the necessary heat for at least 10 seconds;
(d) treatment and treatment of hooves, hooves and claws of animals;
(e) removal of spurs, ridges, last wing cells, shortening of beaks, claws, trimming of interpheres during the first day of life of poultry, removal of claws and shortening of the upper part of the beak in musk ducks up to 21 days of age;
(f) the cauterisation of the beaks of fowl less than 10 days old intended for the production of table eggs; and
(g) adjustment of teeth of suckling piglets.
(2) The professional veterinary activities referred to in paragraph 1 shall be carried out by the livestock farmer in compliance with the principles and procedures ensuring the prevention of pollution and the transfer of micro-organisms in the use of surgical instruments, the protection of animals and animal husbandry, diseases communicable from animals to humans, other diseases and respect for occupational safety.
Content, scope and organisation of specialised professional training with a focus on carrying out professional veterinary activities by livestock farmers, the manner and organisation of the verification of knowledge acquired, certification and the keeping of a list of persons who have completed this specialised professional training
(K § 64b (4) of the Act)
§ 39d
(1) Specialised professional training with a focus on carrying out other professional veterinary tasks is organised by the organiser within 10 hours of specialised training.
(2) The content of specialised training is:
(a) teaching the performance of the veterinary professional tasks provided for in Article 39c (1);
(b) an overview and principles of the correct use of the equipment and equipment necessary for such activities;
(c) principles and procedures to ensure the prevention of pollution and transmission of micro-organisms, the principles of biological safety, knowledge of health risks and the safety of work in carrying out such activities; and
(d) legislation relating to the activities referred to in points (a) to (c).
§ 39e
(1) At the end of the specialised training provided for in § 39d, its participants shall be subjected to the examination before the examination panel, which shall be of three members. The chairman and other members of the examination committee shall be appointed and removed by the organiser from the representatives of the Ministry of Agriculture, the State Veterinary Administration and the organizer. The organizer determines the date and place of the exam. The test shall take the form of a written test.
(2) The written test is compiled by random selection of 30 test questions prepared by the organizer from the field of specialised training according to § 39d. Three possible answers are assigned to each question, more of which may be correct. Each correct answer is evaluated by 1 point. The duration of the written test shall be 45 minutes. For a successful written test, at least 75% of the correct answers must be obtained.
(3) Test result shall be assessed by the Test Panel at stage: test taken, test not taken. The test shall be carried out if the participant has passed a successful written test. The examination referred to in paragraph 1 shall be carried out by the Chairman of the Examination Committee in a report indicating the name and surname of the members of the Examination Committee, the date and place of the examination, the identification details of the participants in the specialised training and the results of their evaluation. The protocol shall be signed by all members of the examination committee. The Protocol shall be registered and kept by the organiser for the duration of the certificate issued.
(4) On the basis of the successfully completed examination referred to in paragraph 1, a participant in specialised professional training shall obtain certificates of competence to carry out other professional veterinary tasks provided for in Section 39c. The model certificate is set out in Annex 11 to this Order.
(5) A specialist training participant in accordance with § 39d who has not passed the examination may ask the organiser in writing to repeat it not earlier than 3 months after the date on which he was notified that he had not.
(6) The specialist professional training participant referred to in § 39d who has not submitted the examination and has not requested it to be repeated no later than 6 months from the date on which it was notified that he had not completed the examination shall undergo a re-specialised training before the next examination.
§ 39f
(1) The organiser shall keep a list of participants in specialised training provided for in Section 39d in electronic form.
(2) The list of participants consists of data on:
(a) the name and, where appropriate, the names and surnames of the participant in the specialised professional training, the date and place of birth and the address of the participant in the specialised professional training; and
(b) the date and result of the examination according to § 39e.
(3) Entry into the list of participants shall be carried out by the organiser without undue delay after the examination by the Examination Committee pursuant to § 39e, but no later than 5 days from the date of evaluation by the Examination Committee.
(4) When keeping the list of participants, the organiser will ensure that all the information referred to in paragraph 2 is kept, regular backup of the data from which the data contained in the list of participants can be reconstructed. Data backup shall be carried out without undue delay after the entry of the data referred to in paragraph 2 in the list of participants.
Content, scope and organisation of specialised training with a focus on the inspection of bee colonies with the disassembly of bee works, certification and keeping a list of bee visitors
(K § 64c (4) of the Act)
§ 39g
(1) Specialised training with a focus on the inspection of hives and disassembly of the bee's work is organised by the organiser in the range of 8 hours of theoretical teaching and 8 hours of practical exercise.
(2) The content of specialised training is:
(a) theoretical teaching aimed at obtaining knowledge in the field
1. dangerous diseases of bees and their clinical manifestations in hives,
2. the current occurrence of bee diseases,
3. information sources on the current disease situation,
4. bee diseases,
5. zoohygieny of bee breeding and good practice in bee breeding,
6. legal issues related to the occurrence of bee diseases; and
(b) practical exercises aimed at obtaining skills during the inspection of hives at the post, disassembly of the bee work and assessment of the clinical status of adult bees and bee fruit and of sampling, marking, storage and dispatch to the laboratory for the required examination.
§ 39h
(1) At the end of the specialised training provided for in § 39g, its participants shall be tested before the examination committee, which is three members. The Chairman, who is a representative of the State Veterinary Administration, and other members of the Examination Board, shall be appointed and removed by the organiser from the representatives of the State Veterinary Administration and the organiser. The organizer determines the date and place of the exam. The test shall take the form of a written test and a practical part.
(2) The written test is compiled by random selection of 30 test questions prepared by the organizer from the field of specialised training according to § 39g. Three possible answers are assigned to each question, more of which may be correct. Each correct answer is evaluated by 1 point. The duration of the written test shall be 30 minutes. For a successful written test, at least 75% of the correct answers must be obtained. If the participant has not achieved the necessary evaluation for a successful written test, the practical part of the test shall no longer be performed.
(3) The content of the practical part is a survey of the colony with the disassembly of the bee's work and sampling for laboratory examination. For the successful composition of the practical part, it is necessary to perform a flawless inspection of the colony with the disassembly of the bee's work while fulfilling all conditions and principles of working with infectious material.
(4) Test result shall be assessed by the Test Panel at stage: test taken, test not taken. The test shall be performed if the participant has passed the successful written test and has complied with the practical part. The examination referred to in paragraph 1 shall be carried out by the Chairman of the Examination Committee in a report indicating the name and surname of the members of the Examination Committee, the date and place of the examination, the identification details of the participants in the specialised training and the results of their evaluation. The protocol shall be signed by all members of the examination committee. The Protocol shall be registered and kept by the organiser for the duration of the certificate issued.
(5) On the basis of the successfully completed test referred to in paragraph 1, a specialist training participant shall obtain a certificate of aptitude for the inspection of bees with the disassembly of the bee work. The model certificate is set out in Annex 12 to this Order.
(6) A participant in specialised training under Paragraph 39g who has not passed the examination may request the organiser to repeat it in writing not earlier than 3 months after the date on which he was notified that he did not.
(7) A participant in a specialised training under Paragraph 39g who has not passed the examination and has not requested its repetition within 6 months of the date on which he was notified that he had not passed the examination shall undergo re-training before the next examination.
§ 39i
(1) The organiser shall keep a list of participants in the specialised training provided for in Section 39g in electronic form.
(2) The list of participants consists of data on:
(a) the name and, where applicable, the names of the participant in the specialised training, the date and place of birth and the address of the participant in the specialised training; and
(b) the date and result of the test according to § 39h.
(3) Entry into the list of participants shall be carried out by the organiser without undue delay after evaluation of the examination by the examination committee in accordance with § 39h, but no later than 5 days after the date of evaluation by the examination committee and an updated list of persons holding the certificate referred to in paragraph 5 shall be provided without delay by the State Veterinary Service.
(4) When keeping the list of participants, the organiser will ensure that all the information referred to in paragraph 2 is kept, regular backup of the data from which the data contained in the list of participants can be reconstructed. Data backup shall be carried out without undue delay after the entry of the data referred to in paragraph 2 in the list of participants. ';
9. the following Annexes 11 and 12 are inserted after Annex 10:
